Initial Business Response /* (1000, 12, 2017/01/25) */
We are in receipt of the issues and concerns of [redacted].
We have been trying to resolve them, however communication with him has proven difficult. He was to have his portion complete by Nov 27th, so we could then come in and complete...

are necessary repairs. We reached out to him by various methods of communication from 11/27 - 12/18 with no response whatsoever. He contacted us on the 12/19 where we had a lengthy conversation about us getting in there to complete the project for him. He was not complete with the drywall or the nailers and wanted to argue this was all our fault. We reminded him that he agreed to this repair and told him we did make some errors and wanted to make things right, we just needed a date when he would be complete with the drywall. We ended the conversation that we would contact him on 12/30 as he had time off over the holidays to finish the drywall. He stopped in the Pueblo office that afternoon and paid his final payment. We called him 12/20 thanking him for the final payment, ensured him we were still going to do the repair, and or him to let us know as soon as the drywall was complete. Our next communication was 12/27 where we discussed the final inspection being done, which we scheduled for the 12/28. [redacted] contacted us on 12/28 upset by how he is having to cut three sides of his drywall. We asked him if his nailers were correct and he was upset by us asking. We then set up for an appointment for the branch and region manager to meet him on site Thursday 12/29 at 10am. We measured his nailers and explained to him they are not straight. Now he wants us to do the nailers and hang the drywall for free.
We are more than willing to work with [redacted] to address any issues related to Cleary Building Corp. That cooperation needs to be two sided, and he must complete the things necessary on his end before we can complete hours.
Respectfully,
[redacted]

Initial Consumer Rebuttal /* (3000, 14, 2017/01/27) */
(The consumer indicated he/she DID NOT accept the response from the business.)
1/27/17
In response to Cleary's response to your inquiry dated 1/25/17 for [redacted]. Below is the requirements from the Pueblo Regional Building Department dated 12/28/16 concerning the building that I had contracted with Cleary Building to construct. I have attached the report from the building department with this letter showing the issues with the frame.
Anchor bolts holding support post bases to concrete do not appear to be imbedded into concrete sufficiently. Need the specifications on bolt size, how deep the embedment must be, and torque specifications.
The spacing-location of support posts at exterior walls do not match plans. Plans call for 8 foot on center spacing. Need engineer to approve the current locations.
The roof trusses also do not appear to be in the proper location. Several tresses bear on door headers not support posts, engineer must approve these point-load locations.
How are the two gable-end trusses secured to their support posts? Cannot verify attachments, nails, bolts, what?
1Fasteners attaching metal roof panels to trusses are placed in the field, not on the panel ridges, is this correct per manufacture spec's?
In reading the response from Cleary that you received concerning my complaints and outstanding issues I am unable to finish my portion of the required drywall installation until the building issues have been resolved and the building frame approved. It is not feasible that I do anything at this point until the engineer has signed off on the building as safe and secure and the Pueblo Regional Building Department has issued the required approval.
From the beginning of this project the project manager has known that I work nights and cannot be reached except Thursday-Friday as I drive 1.5 hrs to work, work a 12 hr shift and then drive 1.5 hours home. When I have received a message from him I have returned the call as soon as possible in all situations.
I have pictures of the issues and can provide you copies at any time. I just want the issues to be addressed, engineer's approval that the building is secure and the County approval so that I can use the building as planned. This has been extremely frustrating so I would like to be able to move forward. I am still waiting to hear from Cleary as to was the fix is going to be since originally filing this complaint.
Respectfully,
[redacted]
