Seventh Street Suite 1600 Cincinnati, Ohio 45202 Attention: [redacted] RE: Complaint By [redacted] Against Circle Storage Dear [redacted]: Please accept this letter as the response by Circle Storage to the complaint levied by [redacted] against the facility. First and foremost, our company prides itself in its customer service and we are sorry that [redacted] feels the way he does. We also regret any miscommunications which may have exacerbated [redacted] frustration and anger with the situation in which he found himself. We would like to address several of the specific allegations in [redacted] letter as well as add additional information which is necessary to give appropriate context. [redacted] states in his letter that he entered into a contract for two storage units with a partner who paid for those units and that he later added a third which he pays for himself. [redacted] also stated that he never missed a payment and that he always treated the facility respectfully and acted properly when there. [redacted] is correct about this information but he has not provided all the information to give complete context to the situation. [redacted]'s "partner" is  his father, [redacted]. The elder [redacted] was the owner of Circle Storage when he and [redacted] entered into their unwritten contract whereby [redacted] permitted [redacted] to use two units without paying for them. When [redacted] needed a third unit, he signed a contract like all of our other clients and began paying for that unit in accordance with the terms of the written agreement. [redacted] has since sold Circle Storage of Western Row to BDM Storage, LLC, a partially related third party, but [redacted] is not an owner in BDM Storage and no longer has a membership interest in Circle Storage of Western Row. Because BDM Storage is a related third party the members of BDM Storage continued to allow [redacted] to use the additional two units without payment. The two complimentary units [redacted] used have be me the most popular sizes at Circle Storage. Therefore at the request of a non-family related pa owner of BDM Storage and the third party manager of the facility, BDM Storage made the decision to ask [redacted] to consolidate his personal property in other less popular units albeit under the same to ms and conditions where [redacted] would not have to pay for the new units (he would have to continue to pay for the unit he had been paying for though). Several attempts were made to contact [redacted] via cell phone and through e-mail beginning on November 19, 2014. In this e-mail, a request was made for [redacted] to respond by the next day. Because of the failure to respond, the partners of BDM Storage appealed to [redacted] father, [redacted], to have a discussion with [redacted] regarding this issue. The two of them spoke on Friday, November 21, 2014 and according to the [redacted] father, [redacted] agreed to consolidate his units and return the popular units back to BDM by December 31, 2014. Unfortunately, [redacted] became frustrated with the management  company of Circle Storage, his father and the owners of the facility and began a social media campaign against the entity and his family who were offering him free services.
Circle Storage prides itself on the security and cleanliness of the facility as well as the customer service it provides. In the event any action needs to be taken against any tenant, such action is only taken in accordance with law and in consultation with its attorney if necessary. No such action has been taken against [redacted] or his units. As of the date of this response, [redacted] has voluntarily removed his personal property from all three units. [redacted] also made reference in his complaint several times that he believes Circle Storage only desires "proper middle class clients." [redacted] implication in his complaint that Circle Storage and its employees discriminate against individuals based upon their socioeconomic status is not only wrong it is offensive. As stated earlier, [redacted] paid for only 1 of the 3 units and was not required to sign a lease for the two complimentary units only because of the relationship to his father, who was an owner of the facility at the time [redacted] began using the complimentary units. It is very unfortunate that this situation has devolved to the point where [redacted] felt the need to respond in this manner. He has filed a complaint against a facility that merely wished to discuss with [redacted] his ability to move his personal property to less popular units. Again, Circle Storage and its owners and employees regrets the fact the [redacted] feels the way he does. This letter has addressed much of what [redacted] has asked of Circle Storage in his desired settlement. He has already removed all of his personal property so he does not need additional time to resolve that situation. No disciplinary action will be taken against any owner or employee of Circle Storage as it is not deemed necessary. Finally, it pains me personally to write this letter as [redacted] is  my brother. In my opinion, he has been treated fairly and appropriately and if he were not a related party his unresponsiveness would have been addressed long ago in a more formal manner. We appreciate the ability to respond to these allegations and are willing to entertain any additional questions or comments the Bureau or [redacted] may have. Sincerely, BDM Storage, LLC                                            [redacted] Member
