consider the following: Unless otherwise admitted or qualified herein, the Bank denies each and every allegation contained in Mr [redacted] ’s complaint In response to the body of Mr [redacted] complaint, the Bank admits Mr [redacted] has a home loan with the Bank The Bank lacks sufficient information to admit or deny what MsJohanna Pape told Mr [redacted] about loan payments being deducted from his checking account and therefore denies the same putting the proof of the same on Mr [redacted] The Bank denies the allegation that Mr [redacted] never authorized the Bank to deduct payments from his checking account The Bank admits there were times Mr [redacted] was behind on loan payments The Bank admits that payments were taken out of Mr [redacted] ’s checking account The Bank denies the allegation that no notice was given to Mr [redacted] about amounts being taken out of his checking account or the amounts taken out of his checking account The Bank lacks sufficient information to admit or deny the allegation that Mr [redacted] was unaware of payments being taken out of his checking account and his attempt to pay bills or purchase items he needed and therefore denies the same putting proof of the same on Mr [redacted] The Bank admits it charges $for overdraft fees The Bank admits that Mr [redacted] called the Bank on 1/25/and spoke with Jody [redacted] The Bank admits that on the telephone call with Ms [redacted] on 1/25/18, Mr [redacted] questioned overdraft fees being taken out of his checking account The Bank admits that on the 1/25/call with Ms [redacted] , Mr [redacted] alleged he did not authorize Johanna [redacted] to take payments from his checking account The Bank admits that on the 1/25/call with Ms [redacted] , Mr [redacted] requested that all overdraft fees be refunded The Bank admits that on the 1/25/call with Ms [redacted] that Mr [redacted] was informed by Ms [redacted] that the Bank had the right to exercise set-off on his checking account The Bank admits that on the 1/25/call with Ms [redacted] that Mr [redacted] disputed that he was not informed that money was taken out of his checking account The Bank denies that on the 1/25/call with Ms [redacted] that she became argumentative with Mr [redacted] The Bank admits that on the 1/25/call with Ms [redacted] that she informed Mr [redacted] that he was provided loan statements and checking account statements The Bank admits that Ms [redacted] stated to Mr [redacted] that she had spoken to MsJohanna [redacted] that same day The Bank denies that it disclosed any confidential information to MsJohanna [redacted] about Mr [redacted] ’s loan The Bank affirmatively states that its sole purpose in contacting MsJohanna [redacted] on 1/25/was to inquire as to whether a historical call log existed demonstrating any calls made to Mr [redacted] The Bank admits that MsJohanna [redacted] informed Ms [redacted] on the 1/25/call that she had previously made calls to Mr [redacted] The Bank admits that on the 1/25/call with Ms [redacted] , Ms [redacted] admitted she never attempted to call Mr [redacted] and that in response to Mr [redacted] ’s request to have his overdraft fees refunded she would need to talk to Greg [redacted] about Mr [redacted] ’s requests and that he was not in that day The Bank admits that Mr [redacted] called Mr [redacted] back the next day on 1/26/and spoke with Mr [redacted] and that Mr [redacted] explained he was confused The Bank admits that on the 1/26/call Mr [redacted] requested that overdraft fees be refunded to him The Bank admits that Mr [redacted] has requested a copy of his loan papers The Bank admits that on the 1/26/call with Mr [redacted] , Mr [redacted] again alleged that the Bank exercised set-off which resulted in overdraft fees in 2015, and The Bank affirmatively states that it did not begin to exercise set-off until September of The Bank admits that on the 1/26/call with Mr [redacted] , Mr [redacted] was informed that the Bank had the right to exercise set-off The Bank admits that on 1/26/call with Mr [redacted] , Mr [redacted] alleges that he was never informed of money being taken out of his account or the specific date money was taken out of his account but the Bank denies that he was never informed The Bank admits on the 1/26/call with Mr [redacted] , Mr [redacted] alleged that he felt it was the Bank’s obligation and duty to inform him each and every time any money or adjustment was taken from his checking account so that he had the correct knowledge of the dollar balance in his account The Bank denies that it committed any error The Bank admits that Mr [redacted] ’s checking account was temporarily closed and then re-opened The Bank lacks sufficient information to admit or deny whether Mr [redacted] called the Telebank Line on 1/27/and therefore deny the same putting proof of the same on Mr [redacted] David ALutz
