Once again, please know that we are fully compliant with all state and federal laws regarding the publication of factual arrest information. We are not required to remove any records under the 1st Amendment. We have obtained these records under the applicable public information, open records, and/or freedom of information laws.  There are no laws that prohibit us from publishing factual events such as arrests, bookings, and/or violations.  As a courtesy, we will remove records that have been ordered not guilty, sealed, expunged, or non-disclosed under state statutory laws.  We also remove the records of individuals that have deceased. For these cases, we do require a copy of the court order, or a copy of the death certificate in order to process the removal. We as that Mr. [redacted] please reply to email [redacted] with the following. NOTE: All information is required for consideration1) A link to the record on our website he would like to remove (please copy and paste the URL)2) Full Name as it appears on the website 3) A copy, preferably in PDF, .JPG or .PNG  format, of the official documentation from his court of jurisdiction or sheriff's office - such as a Case Disposition, letter from the Clerk of Courts. or other official documentation – proving case not guilty, expunged, sealed, ordered non-disclosure, or an obituary proving the person is deceased. A screen shot of online records or a photo of the document is acceptable (please make sure the entire document is clearly readable).
NOTE: Deferred, reduced, nolo contendere, no bill, guilty, etc cases are not the same as court ordered sealed/expunged/non-disclosure/restricted cases and do not qualify for removals.  This will be our final response to this complaint as we clearly define our policy of removing arrest information legally published on our website and contact information.

Hello,
Thank you for allowing us a chance to respond. First, it's important to note [redacted] was not telling the truth when he stated he has not been able to communicate with us. Our contact information including phone number and email address are published on the home page of our...

website www.BustedMugshots.com, as well as a dedicated contact tab and form. Attached you will find the correspondence exchanged via email between [redacted] and our customer service team. We have legally and simply asked him to provide necessary court documentation as proof of his claim of his arrest record(s) expungement, but he has ignored this requirement for removal from our website. It's also important to note [redacted] has multiple arrests on our website, "BustedMugshots.com", as well as many others, including "Mugshots.com" which he referenced multiple times in his complaint. We have absolutely no relationship with that website and his complaint with them should be directed accordingly. Finally, as evidenced in the communication history we provided, [redacted] has not provided any sealing or expungement information for a single one of his multiple arrests: [redacted]
As we informed [redacted], please know that we are fully compliant with all state and federal laws regarding the publication of factual arrest information. We are not required to remove any records under the 1st Amendment. We have obtained these records under the applicable public information, open records, and/or freedom of information laws.  There are no laws that prohibit us from publishing factual events such as arrests, bookings, and/or violations.
As a courtesy, we will remove records that have been ordered sealed, expunged, or non-disclosed under state statutory laws.  We also remove the records of individuals that have deceased. For these cases, we do require a copy of the court order, or a copy of the death certificate in order to process the removal. We never accept payment of any find for a record removal nor do we have an "affiliate" which will remove an arrest record from our website for a fee. This issue is again with "Mugshots.com", not our website.
Unfortunately [redacted] did not submit authentic Florida expungement documentation that states that the arrest information has been sealed, expunged or court ordered non-disclosure,
which is a requirement for immediate removal from our website.  We also informed him that dismissed, disposed, nolle prosse, no action, no file, reduced charges, etc cases. are  not the same as court ordered sealed/expunged/non-disclosure records and do not qualify for removal until sealed or expunged. We directed him to review the laws for sealing or expunging an arrest record in Florida here: [redacted]
Once his arrest is expunged or sealed, we simply require he please send us the court documentation for immediate removal processing.
Best Regards,
[redacted]
