Hi Their, Mr [redacted] came to our dealership on 06/06/to purchase a Subaru Legacy Wagon Vin# [redacted] He was very excited about the car but had few concerns about itWe have offered him a free warranty to complete the sale and make him happier! For some reason, he thought by cancelling the FREE warranty he would get a refund! & he did! He paid $for the free warranty, & he got a refund of $in return! Farther more, He reached the warranty company & they turned his believes down! And before that we have tried to explain that to him, yet he insisted on getting his claimed Doller amount refusing to understandA supported docs are attachedPlease let us know how we can be a further help!

When the warranty company rejected your car claim, where you got the assumption a refund will be made to you by canceling a complementary warranty? We got the refund check. The $764, coasted you $0 from your pocket! That’s why it didn’t go on the main contract witch you should have a copy of!You know you didn’t pay for it!! It is a crime of fraud & harassment! I am rejecting this response because:You have once again completely failed to address the fact that you overcharged us $315.27 above the advertised price.  You lied to us when we asked why the total cost had changed.  You said you had miscalculated the tax, but actually you raised the price, then lied to deceive us.   We tried to resolve this issue with you, but you never answered our letter.  According to the sales contract, we can pursue these unfair and deceptive practices with the DMV Investigator, the City Attorney, and/or the District Attorney.  Unless you refund the overcharge, you leave us little choice.  The DMV seemed quite interested in this issue, by the way.   On the issue of the warranty, the Warranty Contract is quite clear.  It states on page 7 that if we “cancel this Contract within the first sixty (60) days, you [defined as the contract holder—meaning us] will be refunded the entire purchase price less any claims paid”.  The purchase price of $764 is clearly stated on page 1 of the contract.   You and your mechanic lied to us when you assured us the engine was not leaking.  Then you offered us the warranty “for our peace of mind” when I’m sure you knew full well it didn’t cover preexisting conditions.  For us to file a claim would have been fraudulent.   We did not make any claims.  Instead, we cancelled the contract within the first sixty days. Alpha Warranty Services sent the refund and you cashed the check.  You could send us the refund and not be out one single penny.  Instead, you decided to keep the money for yourselves.   If you do not refund the money, you leave us little choice but to file a complaint with the American Bankers Insurance Co of Florida who guarantees the warranty contract.  We will also inform Alpha Warranty Services that you seemed to want us to defraud them.   We have already spoken with the CA Department of Insurance, but have not yet filed a complaint.  They also suggested we try to resolve it with you first, but you never answered our letter.   Also, unless we receive a prompt refund for the warranty and the overcharge, we intend to recover our costs through the court system, and post our experience online to help others avoid our mistake of buying a car from Hoffman Auto Group.   Sincerely, [redacted] and [redacted]

In regards of the claims & complaints below, we have tried to please this costumer by all means, instead she & her hired friends went ballistic on the net firing complaints. And then she gave us the ultimatum to return the car or exchange it with another vehicle, which is a thing we do not...

do especially on a car was sold 4 months ago!
The car was sold AS IS & Hoffman Auto Group has no repair responsibly. Having her car broke down is just a nature of a used car. She denied her 2 days contract cancellation option is a proof that the car was in good running condition.

I am rejecting this response because: the company refuses to honor the terms of the contract which clearly states that we "will be refunded the entire purchase price less any claims paid".  The purchase price is clearly stated on page 1 as $764, not zero as Hoffman claims.  The company cashed the refund check from the insurance company, yet refuses to pay us our refund. In addition, we were overcharged over $300 which the company has not even addressed!
