I am responding to this requestMy Name is [redacted] I am the finance manager here at Cityline Auto BrokersI was also the person that sold Ms [redacted] her truck back on June 9, the car had over 124,at time of saleWE made sure the vehicle was in good condition and he did pass inspection for the customerSo according to Mass Lemon Law that was all I needed to doThe customer bought this car with no money down as she was in a situation at the time and I did what I could to help herAll she paid was sales taxShe was given a rebate of $towards her down payment thru CitylineI never heard from the customer again until I believe it was December which is now months laterShe stated that her truck was at dealership being looked at and that it needed alot of workI told her to come in and see me and we can try and help herShe never came in to see meI then again heard from her when she told me that the dealer where the truck was needed alot of work than expected I told her again to come and see me and she never didI can't help someone that does not come in to see meIt is an unfortunate situation but this car passed Ma State inspection and she drove it for monthsI do not know here driving habits and I do not know how many miles she put on it and if she ever maintained it with oil changes and so forthBut as MA Lemon Law States we did what we needed to do and made sure the car passed inspectionAsd a courtesy also we put a month power train warranty on all our cars we sell no matter how many miles it has at time of saleThis customer had a day or mile warranty thru an aftermarket company and she was even well past that time as wellSo at this time Cityline is not responsible to pay or fix anything to this customer or to the bankShe was well out of any warranty we offered and are obligated thru the Ma Lemon LawThis is an unfortunate situation and things happen with used cars and I feel bad for Ms [redacted] but at this time Cityline will not be paying anythingAs far as surrendering the vehicle voluntarily that was obviously something the new dealer that sold her new car probably told her to doI am unsure how she even got approved for a 2nd loan if she still had this open loan.? ? I have attached a copy of the bill of sale, odometer and Lemon Law guidelines which states what I am responsible for up to 124,milesThis vehicle was sold with more than that amount of miles so the Ma Lemon Law does not apply because the vehicle passed inspection.? As far as any text messages back and forthI do not recall ever telling the customer that nor would I tell any customer that it is illegal and against the law and now a days there as so many Spoof App that can make a text look like it comes from a certain number but it really does notWe are a professional dealership and do our best to help customers but Ms [redacted] is well out of any type of warranty and we are not responsible for anything.? ? ? ? ? ?

After we have worked on a deal for people with certain credit situations sometimes it takes time to get them approved and take numerous calls to and from certain banks to get an actual approval and as I stated earlier in my other response banks have to notify a consumer when they are turned down for creditIt is a Federal Law to do soAs far as threats [redacted] was no0t present when they occurred so I will not discuss that with herThe company policy of Cityline Auto Brokers when someone is approved they do not get their money back if they want to cancel the dealSo at this time Cityline will not be issuing a refund for the balance, We refunded half due to the holiday season and that was in my eyes a gift to do that as the receipt that [redacted] had signed clearly stated that if financing could not be provided then money will be refunded but an approval was obtained and she signed the receipt that clearly stated thatWhich her credit situation status her credit application was sent to numerous lenders so if some of them had turned her down they are obligated by law to notify her as to why she was turned down but I did have a bank that approved herI have again attached a copy of the bank approval as well as the signed receipt by the customer which clearly states we only issue refunds if an approval cannot be obtained.? So at this time Cityline Auto Brokers will not be issuing a refund for the remaining balance as we worked hard to get her approved and it is our company policy not to give refunds.Thank you [redacted] General Manager

This customer has made complaints with different agencies as well as a court complaintWe have referred this complaint to our attorney and they are handling this situation from there.Here at Cityline we strive for customer satisfactionThis particular complaint he has exceeded the warranty period by months and over miles. Every Bank I send an application to has to by law send a letter to the customer whether they were denied or approved it part of the Patriot ActI did have the consumer approved for financing and she was notified of this but due to her insurance being much more than she expected she wanted to cancel
the dealI had explained to her and her husband that our company policy which is clearly posted all over my dealership and on the receipt she was given that if a customer is approved for financing then we do not refund any moneyI explained to her and her husband that we will hold the $as a credit for when she is ready to buy a vehicleThis was in the middle of November I explained this to themThey persisted and kept on calling and mailing and calling and emailing and they were explained the same thing over and over againSo on December 15th seeing that it was Christmas season we had made a decision to refund her half of the money and hold the remaining $as a creditWe figured seeing it was Christmas season we had decided to do thisOn or about the 30th of December her husband had come into our office and asked for the remaining $at which time we explained to him again our company policy and out of the kindness of our hearts and being christmas season is the only reason we refunded half the depositAt that point he became very verbal and threatening towards my staff and IAt that moment I asked him to leave the dealership or I would call the policeHe threatened to burn my dealership and destroy all my carsHe did end up leavingAt which point we were happy he left as to no police needed to be calledSo again our company policy is that if someone leaves a deposit and they get financed they do not get their money back if they want to cancel the dealIn this particular case they wanted to cancel the deal due to the fact that her insurance was higher than they expectedI have no control over her driving record and her insurance ratesSo we will not be issuing any refund on the balance and it will be held for her as a credit once she is ready to purchase a vehicle. This company fixed *** *** TruckPer what the Mass State Inspection said it failed forHis vehicle failed inspection for an emissions issue we fixed it and the vehicle passed inspectionLemon Law Warranty only applies to vehicles under for miles when ** *** bought this vehicle it
had over that mileageWe had brought the vehicle back in to fix it for the failed emissions issue only nothing else is covered to be fixedHe was told this from the beginningI explained this to the City of Boston Consumer Affairs Division as wellHe bought a year old vehicle and he is expecting a brand new vehicleHe brought the *** to Quirk *** and they made all sorts of recommendations as to what they vehicle may needHis vehicle only failed Mass State Inspection for Emissions and we fixed that issueHe is not covered for anything else. We have made several attempts to explain this to ** *** and we even went as far as picking him up from train station when his vehicle was ready after we fixed emissions issueCityline Auto Brokers is not responsible to fix anything else on his vehicleAs was explained to him more than once by myself as well as the City of Boston Consumer Affairs DivisionHe is just running the gammot of people to call and file a complain with now.*** ***Thank YouCityline Auto GroupFinance Department*** *** *** *** *** ***

I waited over weeks for them to get approval and they had notSo at that time I requested my refund In addition, my husband was with my son and no threats were made except to social media to hurt his business No threat to call the police was made It had nothing to do with insurance I received a rejection letter and requested my money back No where on their form does it say I have to wait and determined amount of timeOnce I receive a rejection from a bank I have the right to request a refund I also have an email saying they will hold my money til ready to buy forcing me to buy from them This I also feel is u just

Todays Date is December 6th As of today neither myself or anyone employed by Cityline has heard of any of these complaints until we received this noticeThe vehicle was purchased on 8/12/with for milesLemon states we need to provide a day or mile warranty on the carWe
actually as a courtesy provide a day mile power train warranty thru a 3rd party company called cars protectionIn either case the day lemon law or the extended day warranty there is a $deductibleWe had received a call from customer a few days after purchase about a check engine light coming on and we immediately brought the car in a replaced the catalytic converter and one of the OSensorsWhen she brought the vehicle in she had stated to the salesman *** about recalls shed has seen online from the manufacturer*** had referred her to the dealer for the recalls as they are usually fixed for freeWe have never received any other phone calls from her regarding any oil leaks or transmission slippingIf we did receive a call of that nature we would have automatically stated to her that her lemon law warranty period is over but that she has an extended warranty still and that she can go to any mechanic or auto repair shop that does warranty work like that and file a claim and have them pay for any repairsIf in fact the transmission is slipping it would be covered under that warrantyThe oil leak may not be covered if it was a seal or a gasketSo at this time we have no obligation to fix this car for customer we had made any necessary repairs to correct the check engine light and the vehicle was returned to her fixedAs far as tire sensors and replacing a front tireNo complaint was ever made to us regarding these items and these items are not covered under any warranty as a tire could have been good when left and could have been damaged by drivers hitting a curb or pot holeSo a tire would not be coveredi am sorry for her misfortunes with this vehicle and as of today she is out of warrant anyways by date.?
