I entered Cityside as a guest. To enter the property, you check in with security to get through the gate and must display a parking pass provided on your windshield. There aren't parking rules provided -ever- to the guests entering the property; as such my car was illegally booting for violating parking rules I wasn't notified of- with my pass displayed in my windshield. I had no idea why I was booted, and neither did the tenant. I was informed by the boot company! I had to pay $65 for two boots to be removed from my car to have access to drive my own vehicle. I called the Cityside management office 8 times that day; no one ever answered. I asked the tenant if she's ever had anyone answer and she replied, "no, never." I had to call their main management company and request they contact me directly. Main sent an email. I never got a response from Cityside, even to this day. I filed a dispute through my attorney within the required 48 hour window to go in front of the board to get my money back. I never even received a response. I sent two follow up emails requesting communication, called the main management company twice more over 2.5 weeks and still never received a response. Finally, 12/23- a month after my attorney sent the dispute on my behalf, he received a letter stating "the Association's parking rules are very clear on parking", not even acknowledging my request for my money back, option for a meeting, nor any other recourse.
I have been warned by several of the security guards that this condo complex is "predatory" with their booting practices. It is believed the Association gets kickbacks from the booting company for the cars they predatorily boot constantly. Either way, it is illegal to boot someone without prior notification of rules.
Nowhere was I informed of any parking rules or requirements on the property. Never once have I personally gotten a response from the Cityside management. This is the most unprofessional, predatory business I've encountered. I'm shocked this is allowed.

Desired Outcome

Refund I want my $65 back for being illegally booted. There are no signs posted nor are the rules displayed anywhere nor was I provided with any parking rules in which I was then booted for violating.

The Rules and Regulations are clear on all parking matters. Please ask your friend to refer to the Governing Documents of the Association. Everyone, Owners and Tenants at the time of application, must acknowledge that they have read the rules and will abide by them. The rules and regulations are not clear anywhere to anyone, except supposedly the tenant. Where can I, as a guest, find the rules upon entering the property? Where is this publicly posted for the guests to see? What the tenant signed has nothing to do with your lack of providing guests with your rules or making them publicly visible, which could- and should- easily be printed on the required parking pass or included along with it; or signs should be posted. I did not sign anything agreeing to any parking rules as I was a guest. Nor did you do your duty of making me aware of them. The burden lies on the Association. There are also no signs posted anywhere, except for towing. Why are towing signs posted, but not parking signs? The tenant wasn't home until the next day, and it is not the tenant's burden to remember, and to be the responsible party, to provide their guests with the Association's rules. That is the responsibility of the Association to inform it's tenants and guests entering their property of rules and regulations. If this is not the case, why are signs posted in gyms and pool areas? I will settle for nothing less than my money back or I will pursue legal action.

It is the responsibility of the tenant and / or owner to inform their guest of the rules and regulations when invited by them, onsite. You were a guest invited by your friend the tenant who has read, signed and acknowledged that they, their invitees and their guest, will abide by the rules and that they would be responsible. You trying to create an issue when there isn't any. The fact remains that you were illegally parked and you were booted. The Association's Board of Directors had elected to hire the 3rd party booting company years ago so that when a boot has to be issued no one can claim bias or selective. It is unfortunate that your friend did not inform or guide you when it came to parking however this is of no fault of the Association.

No one else can legally sign for me. If it is the tenant's responsibility, then you should send the tenant a fine, not their guest. And there should be parking rules posted. I signed nothing and will not accept this fine for something I wasn't made aware of ahead of time. I'll see you in court.
