The day the dumpster was removed illegally from my house around 2pm - I called around 8:30 am and specifically asked the company NOT to remove the dumpster. I WAS ASSURED that morning that the dumpster would remain . , (I still had two weeks on the contract) and I asked for my name to be put on the contract . My phone records show I called that morning. Furthermore I have an email from the contractor urging me to call you and change the names from [redacted] ( the contractor) to my name ! This was at 8:45 am same day . Not only did you illegally trespass on my property and removed the dumpster we paid for , you refused to change the name on the contract as well

On may 16, 2016 at 4:40 pm, an order was placed by a contractor working at [redacted] in [redacted] for the delivery of a 20 yd. dumpster at a price of $510. This is pricing included tonnage up to 4 tons of material with any additional weight to be charged 95$ per ton. The contractor was also given up...
to 45 day time period for which no rental charges would be incurred. The contract for this dumpster was between CL Noonan Container Service, Inc and said contractor, not a third party. The dumpster was delivered to the property on May 17th as requested and the contractor paid $510. The term of the contract would be from the point the dumpster was delivered until the removal date. On June 17th, 2016 the contractor contacted C.L. Noonan again and said that he did not want to be liable for any additional overages or rental fees that might occur beyond this day as he would no longer be working on the job. It was explained to the contractor that as is our practice since he ordered the dumpster directly from us and the contract is with him, he would definitely be liable for any charges until the dumpster was removed. At our customer's request, the dumpster was removed that day. The contractor did inform us that he had contacted his customer and let her know the can was being removed. It is our company policy that only the person or company who ordered the dumpster can request the removal. We do not get involved in contract disputes between contractors and third parties. On June 17, the homeowner at 11 Howe Road (the complainant) called our office requesting that the dumpster be kept on the property as she fired her contractor and hired a new one. All employees in our office are well versed in our company policies and would never have agreed to have one contractor take over for another contractor's agreement with us. We explained several times what our policy was and that and that only the contractor who ordered the dumpster can have it removed. While we understand the complainant's frustration at having paid her contractor, we cannot get involved in any agreement she may have had with her contractor. We told her that we would be more than happy to bring her another dumpster at a discounted rate, but that she would have to pay for it. the complainant refused.
