Review: Clark's TV & Appliance installed a dish washer in our kitchen, it leaked creating extensive damage to our kitchen floor that now needs to be replaced. They refuse to take responsibility for their faulty work and refuse to reimburse us for the cost to replace the flooring. Please read below for full details:

1. On February 4, 2013 we purchased a dishwasher from them to replace the previous appliance that no longer worked. They were payed to provide the new dish wash and install it as well.

2. They installed the new dish washer the following week. While installing the appliance, the installer said it was leaking and he would have to bring in another one. I was disappointed but pleased that he realized the new appliance had a malfunction.

3. About a week later they scheduled for the second one to be installed. This was a different installer/technician than the first professional who was here. He installed it and said everything was good to go.

4. The following day, we noticed there was a slow leak under our sink where he had made the connection to the new dish washer. I called them and they sent someone over to fix it. At that time, and having only running it one time, I also pointed out to him that the floor in front of the dishwasher had some give to it and was bowed a bit. I asked could it be from the weight of the new appliance be actually on the Pergo floor. He said he would have to run it by his manager. I heard nothing.

5. Another week later, after running it two more times, the floor started to more prominently warp and buckle. I called Clark's and explained the situation. They said it had nothing to do with the dish washer now being seated on the floor itself. At the time, I didn't consider it could have been from another leak of the appliance, because this was the second dish washer installed and they found the leak of the first one.

6. About another 3 to 5 days later I called Clark's again, saying it is getting worse (now a large 5'x12' area was damaged) and this only started after they installed the second dishwasher. They refused to send anyone out to look at it and said I should hire a flooring person/professional to look at it. Meanwhile, I continue to use the appliance once or twice a week as Clark's insists it can't have anything to do with their appliance.

7. About 4 days later the contractor [redacted], from [redacted] Floors came in and with one glance at the floor, immediately stated it was water damage. He unscrewed the bottom flap of the dish washer and we found about 2" of water laying under it.

8. I again called Clark's and finally they sent a man that I believe might have been more of a "senior" technician. After about a 1/2 hour of diagnostics, he verified this one was leaking too. After pulling the appliance out, the surrounding cabinet and drywall had water stains emanating from the area in the back of the appliance.

9. At first, Clark's didn't even want to allow me to return the appliance and get a refund, but they finally did and on 4-12-13 it was returned.

10. But my floor and some of the sub-floor needs to be replaced ($3159.00) and they said I would have to run it through [redacted], the manufacturer.

11. I then needed to mail full descriptions, photos of the damage and multiple estimates to them with a claim number. This was done on 5-9-13. Many weeks later it was then sent to their insurance company ([redacted]), then assigned to an agent and finally he came to our home to assess the damage for the claim. I was then told his materials and the dish washer in question would be sent to their engineers for final analysis of who was responsible.

12. A letter postmarked July 2nd was sent to us with a final conclusion from [redacted], the parent company of [redacted]). It states:

"it has been determined that no defective parts were found and that the cause of the loss appears to be an installation and/or servicing error. The initial unit was reported to have leaked as soon as it was installed, and the 2nd unit was not checked for a similar issue, and the repair technician did not effectively diagnose the problem during additional visit to the home. [redacted] regrets to inform you that liability for damages rests with the installer"

13. On July 10th I visited Clark's and talked with their representative [redacted]. I provided her the letter that was sent to me. I provided her with the multiple estimates obtained to repair the caused damages.

She stated, why should we pay for this, that is what you have home owners insurance for. Although when they thought the manufacturer was going to pay for it, they were good with that.

I tried to state that:

a. it was determined that they were responsible

b. their responsible to stand behind their work

c. why should have to pay my insurance deductible

d. why should it go on my homeowners insurance record as a claim. Possibly causing me additional money down the road...

She refused and repeated that is a home owner insurance issue.

I stated that I think it is fair to have a better answer from here with in 10 business days on how/when they were going to compensate me for the damage they caused. She again refused. I then stated that I would contact the Revdex.com or my lawyer if if she/they would not corporate further. From their she just kept "yelling" at me "that she will not be threatened, and she knows a threat when she hears one." Over and over. She told be I "was dismissed". I was shocked at the lack of professionalism, but I guess I should have not been that surprised, since the were adversarial through out the entire process once I reported the problem.Desired Settlement: My out of pock costs will be $3159.00. Since Clark's TV & Appliance is responsible for the damages, they should be accountable for it and pay/reimburse me for the full amount.

I am hopping the Revdex.com can help me as the consumer to mediate this on our behalf and help us simply receive what seams fair and just.
