below.   1)      The crown molding I believe you are referring to came from the same manufacturer as the cabinets. It was painted with exactly the same paint and in the same way as the cabinets. Sometimes surfaces on different axis reflect the color around them differently. Shading may also be a factor. I am willing to arrange for a jobsite inspection to verify if you wish.2)      You received the correct shelving per the manufacturer’s specifications. If you had a specific requirement regarding these particular shelf sizes it was not communicated to me. You also indicate in your complaint that a discussion regarding shelf dimensions did not take place. Absent a special request, standard manufacturer specifications are used.3)      Following your email request for more specific measurements I met with both you and your wife and we reviewed all your questions. I took notes of the selections you made and the changes you requested. I then sent you a copy of the changes we came up with at that meeting based on the prior drawings, sent you a summary of my understanding of the changes, changed the drawings to reflect those changes and then provided new detailed drawings and elevations for review. You then signed those drawings before the cabinets were ordered. It is extremely clear in those signed drawings that the microwave cabinet that was installed is the same as what was authorized by you for purchase. Please see attached for your reference. The interior of the cabinet was painted to match the exterior of the cabinets in this case instead of the standard maple veneer because the backside of the cabinet may be visible in the microwave bay. That is an upgrade that I paid for at no charge to you.4)      I do not agree that the island is in the wrong location. However, by your own admission you agreed to the placement early in the construction process. The reason for the final walk through was to address any concerns that remained at the end of the project before collecting the final payment. Myself and my office have documented that we have attempted to contact you a minimum of  11 times since your original concern was raised on 3/24/15 so that you and I could come to an acceptable agreement. On March 26th we were told not to call back until the second week of April due to family problems. Other than that our calls and emails have remained unanswered until now. During that time you had regular communication with several members of my management team, made several payments and even entered into contracts for additional work.  Unless there are additional items that need to be addressed I believe that we have completed the work contemplated in the contracts and the final payment of $2000 along with the past due payment of $1000 for additional work is now due and should be paid in full. In the spirit of good faith and bringing this matter to a quick conclusion, I will contact you privately regarding potential settlement options:  [redacted]President From: [redacted] [mailto:[redacted]] Sent: Thursday, April 30, 2015 7:35 PMTo: [redacted]Subject: Your voice mail [redacted], I received your voice mail. The reason for the final walk through was to address any concerns that remained at the end of the project before collecting the final payment. Unless there are additional items that need to be addressed I believe that we have completed the work contemplated in the contracts and the final payment of $2000 along with the past due payment of $1000 for additional work is now due and should be paid in full.

In the spirit of good faith and bringing this matter to a quick conclusion, I will contact you privately regarding potential settlement options:

[redacted],

I received your voice mail. I am surprised to hear you say that you are surprised that the Revdex.com complaint was filed. I am sure you will be stunned at the reviews that I posted on a number of sites too.

We had informed your staff (Nathan) regarding about the items that are unsatisfactory and went as far as to provide him with a list. If it has not been communicated to you yet, I will summarize for you now:

Trim does not match cabinets. The whites are off and obviously not the same shade. Trim should be replaced with strips that match the cabinets.
We were never asked about our preference regarding bottom cabinet shelf lengths. They are cut short vs long which results in us having significantly less storage space. If asked we would have opted for the longer cut. We were never consulted. We want long shelves in the cabinets.
The cabinet housing the microwave is not what we expressed that we wanted. Not only did we verbalize this to you, we have emails in which we specifically asked for cabinet measurements. Had you provided us with a detailed catalog or drawings that included measurements of LxWxH this all would have been avoided. But you chose instead to install the incorrect cabinet. The cabinet interior is even a different color than all the other top cabinets. Combined with the shorter shelves we have several cubic feet LESS than what we had previously. Again, not what we ever asked for and I have this in writing. We want the cabinet replaced with one that is more in line with the size we requested.
The way the issue with the center island was handled was unsatisfactory, but we felt we had no choice but move forward and accept it at that time in hopes that there would be no more issues that would arise during our remodel. Clearly not the case, so it is included in our list of items with which we are dissatisfied. We expect some fair amount of compensation for the error.

Regarding a final walk through, I assume that this is for the purpose of closing out the contract and collecting final payment. This will not occur until each above items are directly addressed with "CHI will replace at it's own cost" OR "CHI will do nothing" ... but we are not paying anything additional beyond the amount originally agreed to, period.

I am not interested in pontificating with you. My time is too valuable and I have had more than enough of it wasted trying to manage through issues CHI has caused during this project. I am not open to conversation.

Tell me exactly what you intend to do about the above 4 items and I will respond to you with exactly what my plans are.

P.S. It is frustrating is it not. Making multiple phone calls trying to get hold of someone in order to have a conversation only to receive an untimely email response. You may wish to make a note of what your customers often feel like when they are trying to deal with you.

I am happy to hear you are willing to accept a conversation. I have documented 11 contact attempts, 9 by phone plus 2 additional calls since your original complaint. I have sent you a separate private email with proposed options to which I have not received a reply. If you did not receive that email please advise and I will be more than happy to resend. Your attached email implicitly stated that you were not interested in a conversation and therefore implied a written communication was all you would accept. I look forward to our conversation tomorrow.

I continue to look forward to a timely and amicable resolution.

In yet another example of communication issues, I have been awaiting your call. When an individual receives an email like the one below with a statement such as "I will contact you privately regarding potential settlement options" as the closing remark, it implies that the reader will be contacted. Why would you anticipate a reply from me? This type of error is exactly what got us to this point. So to be perfectly clear, "[redacted] call me tomorrow, Thursday May 7, 2015. I can be reached at [redacted]. If for some reason I cannot take your call leave a voice mail and I will get back to you at my first convenience." While I disagree with the majority of your statements below, I will hear you out as to options. On 5/6/2015 4:44 PM, [redacted] wrote:

Review: It took over 10 weeks to complete a 10 day kitchen.

When John first gave me the estimate, it was between $15-18,000. Then, when he came to write up the contract, the price was $20,500 – without the new floor.

1.I did not get what I ordered & paid for. My contract says “ForeverMark” Brand – made in New Jersey. I got Fabuwood – made in China. This is bait and switch and a breach of contract.

2.I ordered cabinets to go to the ceiling. I have a scratched 9” wood soffit above the cabinets where I really should have a shelf. This is not what I ordered. It is only a 7' wide room!

3.I have a pantry cabinet that was smashed when Kostas was installing the granite counter top. It was patched up & still looks like it was smashed and patched up.

4.The chair rail is wider than the molding so the blue cabinet does not sit against the wall.

5. The subcontractor installed the new tile flooring under the cabinets - it is only supposed to be under the appliances.

6. I went to open the cabinet door next to the microwave and there was so much plastic wrap stuck in between the microwave and the cabinet that the door would not open. Again, I had to wait for a worker to do the repair. John forced the door open so now it has a dent in it.

7. Not one cabinet door or drawer is even or aligned. In addition to the scratches above the cabinets, the door to one of the wall cabinets needed to be replaced.John told me I could not get a replacement door for only one cabinet. He said that they would have to remove all of the doors, refinish all of them & then bring them back. I said I didn’t want to live with that.

So, at the end of June, I went to the cabinet store, who called the cabinet co & ordered a new door. The door was delivered to my house on 7/**. On 7/**, the worker came to my house but he had no tools. He was supposed to return on 7/** with tools, but never showed up.

8. The GFI outlets are crooked & upside down. When I changed the outlet covers, the screws keep falling out. John told me I broke them.

No guarantee!Desired Settlement: I want the kitchen I signed up for - with unscratched cabinets to the ceiling. I want it installed by another contractor and paid for by John L[redacted].
