I ordered a bridesmaids dress for my friends wedding on February 14, 2015. I paid for the dress in full under my name and signed a contract between myself and the bridal store. When the dress came in with out notifying me or contacting me they released the dress to someone else who said they would "give" it to me. The shop does not have my dress and the person they released it to is refusing to give it to me. The shop is refusing to refund my money for the dress that is not in my possession and left the store with someone other than myself. The dress is in the home of someone who has many cats. My fianc, which lives in my home is highly allergic to cats, so the dress cannot be brought into my home. They have offered to dry clean the dress, but I paid for a new dress. I feel a dry cleaned one that was removed from the store is unacceptable and cannot be considered new. I was told by[redacted] the manager that the owner would be prepared to "fight me tooth and nail" on the issue.Product_Or_Service: Bridesmaid DressAccount_Number: Receipt #[redacted]Desired SettlementI want my money refunded for the dress because they gave it to someone else and that is not what I agreed to.Business Response The consumer stated that she was not notified or contacted when the dress came into the store and that we released it to "someone else who said they would give it to her". The consumer was contacted the day the dress arrived (as were all of the other bridesmaids in that wedding party). The Bride (a friend of the consumer) was also contacted and was told that her bridesmaids dresses were in and all of the bridesmaids had been contacted. Two weeks time had passed and several of the dresses had not yet been picked up. The Bride came into the store to pick up her sister's gown and since the others had not been picked up she said she would go ahead and pick them up. We have never had an issue and didn't see any issue with the Bride picking up the bridesmaid dresses.The consumer stated that the person that had the dress refused to give it to her yet when we spoke with the Bride she stated that the consumer (along with her fiancee') had picked up the dress the night that she filed this complaint. The dress was sealed in a bag from the store and was never in contact with any cats (which she stated her fiancee' was highly allergic to). We feel a refund is not in order because the consumer does have the NEW dress that was ordered by us in her possession at this time.
