I fulfilled my 12-month contract and followed all written directions for canceling my membership. Mailed my written cancellation by certified return receipt postmarked January 30th, 2015. Followed my tracking Number and the mail was in their mailbox on January 31st. However, was never retrieved by Clayton Fitness until February 9th. Because of when they picked up their mail I am charged another months payment for Msrch!!! Totally not right!!!!

I canceled my membership via certified mail after my contract was over and my account was debited anyway and not canceled. Multiple calls not returnedAfter my contract expired with clayton fitness, I requested a cancelation per their rather odd policy of processing the request in writing and having it sent back to the gym via certified mail. No one at the facility will process a cancelation, even though they are handled right there on site, they must have the certified mailed form. They do not even allow you ti fill out the form there. No one at the gym will verify your membership details, or tell you when the account expires or when you have to cancel to make sure you do not get charged a fee. They reference a "billing company", but there is not one. All of the mail and the "corporate number" are all clayton fitness. The corporate number is just an answering machine, and calls are not returned. I have called 5 times in 24 hours and left 3 messages, along with speaking to someone at the front desk twice. I believe their cancelation practices are overly complicated to ensure at least one or two more months of membership payments after the accounts are canceled. This is a horrible practice and there is no customer service at all in place. I want my money refunded and I want the practices that this business uses to rip people off to be changed.Desired SettlementI want a refund of my 30.00 fee taken from my account after my membership was canceled and I want verification in writing that my account has been canceled and will not be charged again.Business Response The customer was charged for the March payment because it was the 12th payment of his one year agreement. He sent the cancellation form in one month early. His membership has now been cancelled as his contract obligation has been met.Consumer Response I disagree with the results but will take it up with my bank. I was told by two different employees of the company that feb was my last payment and I was never provided a copy of any contract. Companies should be held liable for the information there employees disclose and most are. I also do not recognize the contract as valid as I was never provided with one. Again, I'll take this up with my bank regarding the fraudulent charge. Final Business Response The customer is not due a refund. His agreement was completed when he paid the 12th payment of his one year agreement which was the March 2015 payment. The 30 day processing period on cancellations only applies to eligible cancellations. The customer was not eligible to terminate his membership until April 15, 2014. His final payment on his one year agreement was March 2015. His membership is now terminated and he may continue to use the facility until his expiration date of 4/15/2015.

After cancelling my membership last January (2014), I have inexplicably started receiving invoices again. I got a membership in 2013 with hopes of dropping weight to help alleviate back pain from my injury for which I am medically retired from the [redacted]. After having my membership just a few months, I came to know how serious my back injury truly was and I was quickly scheduled for spinal fusion surgery (August 2013). I went through the procedure for putting a medical hold on my membership. Before the medical hold expired, I knew that I would not yet be able to use a gym membership. I went to the gym to cancel my membership & was simply told, "We'll take care of it". Perhaps it was naive on my part to assume it was as simple as that, but I was extremely grateful that it was handled so simply with everything else I was dealing with/going through at the time; and with how wonderful everyone at the gym had been during my time attending there, I had no reason to doubt the veracity of the statement that it would, indeed, be taken care of. I never gave it any thought after that until I started receiving invoices this past winter. I called the number on the invoice & it was actually a multi-gym management company who at first didn't even seem to recognize what gym I was talking about. After roughly 30 minutes on the phone with them, they could not find any reason I was being charged anew & advised me to contact the gym. I contacted the gym & was told I needed to contact their account management. I can't seem to get a straight answer from anyone, but I certainly don't feel that I have an outstanding balance with this company. I cannot imagine that this is anything other than a miscommunication somewhere along the line. Please help... I am currently being told that I owe $225 on this account. Desired SettlementMy account to be cleared as I understood it to be over a year ago. My deepest appreciation to all concerned for their time & assistance in this matter.Business Response We received a freeze form from the customer in August 2013 requesting that the membership be frozen until February 2014 due to back surgery. Per this request, the member began billing again in 2014. The process for cancellation is simply sending in a form and no staff member should have said it would be handled as they are all trained in the proper procedure to give the member a cancellation form to be mailed. This is the first that I have heard of a complaint from this customer. I have reviewed his file and their are obviously some medical issues. Due to that fact, we will terminate his membership and clear his balance. It is our hope that he will get better and be able to be more physically active in the future. If the customer has any further issues, please have him call 919-[redacted] and leave a message. His call will be returned.

I cancelled my fitness membership at Clayton Fitness in 01/2014 according to all their policies and they kept debiting my account until 04/2014.Clayton Fitness Inc. is running a scam that when you cancel your membership due to moving out of state they will keep drafting from your debit or checking even if you follow all their ridiculous rules.I had to send them not one request but registered mail but two with the evidence of moving out of town. The manager lied and claimed that she did not know what happened but she would terminate my membership account immediately. Then the company turns around a few days later and debits my account for another month's membership in April when I sent in the request to cancel with evidence in late January. This is fraudulent the company scams senior citizens and veterans from other members I have talked with.I am a disabled veteran they are scamming and stealing money from me by unauthorized debits.Desired SettlementI expect them to pay me for the months they debited my account 25.00 which would be Feb, Mar and April 2014 plus the registered mail charges and wasted gas and time on stopping their fraudulent business practices. They claim to be a "Christian family fitness center" designed to help the community and they are scamming their members that follow all the rules about cancelling the membership when moving out of town. This is a business that is running a fraud.There are several families that have had the same thing done to them when they moved out of town and Clayton Fitness, Inc. keeps stealing money from bank accounts after its members have cancelled according to their contract.I followed all their ridiculous rules and presented the evidence that I moved and they keep drafting (stealing) money from me. Clayton Fitness Inc. has extremely fraudulent business practices and deserved to be fined and/or shut down. Thank youBusiness Response A response was submitted promptly to the Revdex.com. See reference number [redacted]. The billing company did not receive the proper proof of relocation to terminate the account and continued to bill the customer. I reviewed the account, terminated the agreement and sent a request for the billing company to refund the customer for any billing past the 30 day period after the original request was received. All of this was done before the second cancellation request was received from the customer. I also called and left her a message telling her that it would be taken care of and that another notice did not need to be sent.

Clayton Fitness Inc. fraudulently debited from my mother's account even though we cancelled the membership & the membership was in my name not hers. My mother bought a membership for me at Clayton Fitness for Christmas present in Nov 2013, and the monthly dues of $.25.00 were charged to her debit card. We had to move unexpectedly in Jan 2014 and we cancelled the membership in late Jan and followed all their policies and jumped through all their hoops in showing evidence that we had to move. We had to send it by registered mail, TWICE, because they did not let us know anything about the first request they sent. They just ignored our first request. Clayton Fitness kept debiting her card for an extra 3 months and will most likely try to keep fraudulently stealing my mother's money each month. When called, the manager claimed she did not know what happened but she would terminate the membership immediately. Then a few days later,Clayton fitness debited for the month of April anyhow. They are committing fraud, stealing money that is not theirs and scamming other members as well. Thank you for your help and assistance. Desired Settlementthey need to send a refund of 75.00 to the above address and an extra $300.00 for the legal advice she had to seek for their scam. Business Response There was a call on the gym answering machine from Mrs. [redacted] on March 31, 2014. That was the first call received from her in regards to her cancellation. She had sent in the cancellation forms at the end of January 2014, but the billing company did not cancel the agreement due to lack of proof that the actual member, [redacted] had moved. After Mrs. [redacted]'s phone call, I reviewed the cancellation information and terminated the account. I also instructed the billing company to refund the March and April payment to the account as February should have been her last payment. I called Mrs. [redacted] to let her know why it had not been terminated and that it was resolved and the account was terminated.
