On October 1, 2013, a TV was dropped off unpackaged for Clayton’s
to ship to Mr***. We were told Mr
*** purchased the item on *** and were asked to package it for shipping. Our
staff took a lot of time to make sure the TV was packaged and boxed properly. However, once the package leaves our shop how
it is handled is out of our control. Mr*** was called and informed how much the
packing charge was and asked if he wanted to insure the item. The insurance covers not only damage but loss
as well. Mr*** declined insurance,
which at that point, we should have refused to ship it. Mr
*** provided multiple pictures f the damaged television. He also stated that he had numerous pictures
of the unopened box it arrived in but has yet to provide any. The pictures we received were of packaging
that had already been opened- from which was impossible to tell the arrival
conditionIf the package looked damaged at the time of arrival, knowing what
was in it; Mr*** should have noted the damage on the delivery ticket or
refused the shipment. Mr*** was informed numerous times that
since he did not insure the package, the most *** would pay for loss would be
$and there was no point in filing a claim Rather than waste time and money filing a
claim Clayton’s offered Mr*** the $that would have been awarded to
Clayton’s if *** found the claim valid.
We spoke to our *** representative several times concerning this
matter, but since the item was shipped without any insurance the most ***
would allow would be the $100.00.
Mr*** is looking for $to repair a plasma TV that is
almost years old. As the price of
technology on plasma TV’s has dropped dramatically over the years, it is
difficult to understand how Mr*** is demanding Clayton’s pay that amount of
money to repair a TV you can now go out and purchase at *** for $800.00.
It is also difficult to understand why Mr*** would refuse to insure
what he is calling a unique item that he was shipping across the country. Clayton’s has also asked Mr*** for a copy of
the *** listing which he has yet to provide Without a receipt, it cannot be assumed that
the TV was even in working condition at the time it was shipped.
Attached is the original invoice for the packing supplies and services as well as a letter authorizating Mr*** to persue the claim with *** directly
