Management first called our company to come and dry out the affected property and signed our work authorization so we could start work drying out ***’s unit*** was the property manager for the unit that caused the water damage to ***’s unit. *** signed our work authorization form because she thought she was acting in the best interest of protecting people and property so we could get started drying out the damaged areas as quickly as possible. When there are cases of multi-unit floods, Clean Earth Restorations procedure is to get the homeowner of each unit we do work in, to sign our work authorization, even though the property manager of the unit who caused the flood had already signed our work authorization authorizing us to start the work. *** signed our work authorization, which we have provided a copy. Even though when the issue started, the owner of unit #*** thought their insurance company would pay for the damages, it was found out much later that the insurance company for unit #*** would not cover the damage to ***’s unit According to the CC&R’s for the Homeowners Association that *** and the owner of unit #*** belong to, Section of the Association’s CC&Rs state that each owner is responsible to maintain and/or repair their exclusive use areas. The homeowner of unit #*** did in fact repair the leaking tub drain as soon as they knew there was a leak. *** is responsible for maintaining her walls and ceilings, regardless of the source of the leak that caused damage. We apologize for any confusion and/or frustration that *** may have about our invoice and demand for payment. We will be more than happy to contact her homeowners’ insurance company and help her to see if her insurance company will cover the loss

To whom it may concern:
 
We have been in contact with the homeowner, [redacted] to provide to perform work on any items that are covered under our warranty.  Clean Earth is going to reimburse the homeowner for the plumber charge of $150.  [redacted] will be sending in...

the invoice for the plumber and at that time the check will be delivered to her.  In speaking with the homeowner we have resolved this complaint.
