I am not sure if this notice was sent to the correct property In the persons complaint, she stated "Clear Creek Apartments", we are "The Ridge at Clear Creek" located right next door to Clear Creek ApartmentsIn response to the complaint, [redacted] is to take pictures of all vehicles prior to towing them to verify that no parking permit was present I have not heard from a resident or Guarantor regarding this incident but we would suggest that they ask for a picture of the vehicle before it was put on the tow hitch The Management Company gets absolutely no kick back from the towing company, we are contracted with [redacted] as a courtesy to our residents With being so close to campus and the campus permits being costly, our parking lot is used as a school parking lot unless it is patrolled on a regular basis, to ensure that our residents have ample parking when they get homeEvery vehicle that parks in the parking lot, must have a parking permit issued by the office Every apartment receives visitor parking passes that are to be given to their guests while visiting to avoid being towed The only parking areas that can be parked in without a pass are directly in front of the signs that display, "Visitor Parking" In other issues where a vehicle has been towed, [redacted] has been able to provide proof that there was no permit displayed in a visible area in the vehicle The Ridge at Clear Creek is not liable for any vehicle being towed, cars are towed at the owners expense as that is displayed on all of the signs throughout the property In any case where [redacted] has towed a vehicle without proper cause which can be proven, [redacted] would be responsible for the reimbursement of the cost.Thank you, [redacted] ***Community ManagerThe Ridge at Clear Creek

Beginning on January 28, 2015, notices was distributed to all residents' doors on multiple occasionsFurther, copies of this notice was displayed in the commons areas, to include the office, mail box area and fitness amenity areas. Copies were also left in the leasing office for viewing.This notice expla ined how the community has been experiencing significantly increased numbers of vehicles (nonresidents) parking in the parking lot during the day as well as the eveningsThese drivers walk towards the NAU campus assumedly to attend classThe majority of these vehicles that we witnessed had the yellow guest passes, which were easily sold or traded/borrowed out to these non-residents.We recognized that this was seriously inconveniencing our residents, so in a logical attempt to remedy this issue, we determined that the only way to stop this activity was to change out the parking passesWe switched from the yellow guest passes to green parking permitsThe notice stated that residents needed to come into the office and we would switch the permits for themWe gave all residents until February 13, to trade in the yellow passes; a full two weeks and with several notificationsThe notice also stated that any vehicles that were parked with a yellow pass after the February 13, would be towed, without warning, at the owner's expenseOur contracted vendor, *** *** is came through after the deadline and began *** vehicles that were in violation due to this change.Our contract, attached, does not provide for, no do we require or accept, any "profit sharing" or other "kick back" for these servicesWe simply provide these contracted services to reduce the events of the residents not having places to park when they come homeWe have received several complaints from our residents regarding this and as the situation worsened, had to act.We feel that the residents were given proper notification to the change the permits and ample time to obtain the proper permits for their vehicles

According to Clear Creek Village management, flyers were put onto apartment doorsThis platform of communication is inefficient and certainly not proper notificationFor such important information, jamming a note into a door crack is unreasonableThe flyers were not posted multiple times, nor were there notices by the mailbox areaThis poor communication resulted in my lack of knowledge of the pass change altogetherAdditionally, ample time was not given for residents to trade in passesThe lease states that any community policy may be changed at any time, subject to a 30-day noticeThe notices were supposedly distributed on 1/28, and the change took place a mere days later on 2/It is understandable that neither management nor residents desire a crowded parking lot due to NAU studentsHowever, the car was towed on Sunday night (2/15) at 10:30pm, the day before a holidayCertainly, this was not a student walking to classThis occurred only two days after the pass change, with a pass that shows no expiration date, when the office was not open, at an unreasonable time, and not remotely close to school hoursThe lack of incentive for this car to be taken makes the situation suspiciousDespite the formal contract, I believe that Clear Creek Village and *** *** are in fact profit sharingThe day after the car was towed, all the cars with yellow passes (like the one in mine) had large green warnings on them, which my car did not receiveThe car was wrongfully towed and *** costs should be reimbursedRegards,*** *** *** ***

The flyers were not posted multiple times, nor were there notices by the mailbox area. This poor communication resulted in my lack of knowledge of the pass change altogether. Additionally, ample time was not given for residents to trade in passes. The lease states that any community policy may be changed at any time, subject to a 30-day notice. The notices were supposedly distributed on 1/28, and the change took place a mere 16 days later on 2/13. It is understandable that neither management nor residents desire a crowded parking lot due to NAU students. However, the car was towed on Sunday night (2/15) at 10:30pm, the day before a holiday. Certainly, this was not a student walking to class. This occurred only two days after the pass change, with a pass that shows no expiration date, when the office was not open, at an unreasonable time, and not remotely close to school hours. The lack of incentive for this car to be taken makes the situation suspicious. Despite the formal contract, I believe that Clear Creek Village and [redacted] are in fact profit sharing.
