Hi ***, I appreciate the response from MrB***I have been striving to resolve this outside of a courtroom I have never met or spoken to MrB*** before, during, or after any of the work was performed on my house, and I'm am unsure if he had any knowledge of the situationThere are a few inconsistencies to point out My house was listed for 650k (not 850k) and I purchased for 643k, and this is public record I have been told the roofer has not been paid, but I did not deal directly with the roofer; the services I received were contracted through Cleveland Custom Contractors, Inc (MrB***'s company), and the roofer was subcontracted through them, so that should be a matter between those two parties themselvesThe main concern I have is that while I was given a written estimate prior to the commencement of work (which I requested), I was never informed that there was going to be any change to the estimate, nor did I authorize any changes to the estimate, or did I authorize any additional costs on top of the estimate I was told by Ron R*** (the contractor I dealt with) numerous times that we weren't going over the estimate. The Ohio Administrative Code 109:4-3-states, among other things :"(D) In any consumer transaction involving the performance of any repair or service it shall be a deceptive act or practice for a supplier to:(3) Fail, in those cases where an estimate has been requested by a consumer, and the anticipated cost of the repair or service exceeds fifty dollars, to obtain oral or written authorization from the consumer for the anticipated cost of any additional, unforeseen, but necessary repairs when the cost of those repairs amounts to ten per cent or more (excluding tax) of the original estimate"MrB*** should be aware of thisThis is to protect the consumer, to give them the right to obtain additional estimates elsewhere If he has written authorization from me consenting to additional costs above and beyond the original estimate of $20,000, he should produce them But they do not exist because I never authorized additional repairs. I would like to keep this out of the courts, although I have legal counsel and am prepared to go to court if need beI have also not filed a complaint of MrB***'s company to the Geauga County Building Department, but if we cannot come up with a resolution I will need to do that as well I am willing to adhere to the estimate of $20,as outlined plus an additional $for painting the exterior.Thank you very much. *** ***

The issue at hand is not the type of stone as the contractor claims, but how it was applied, the fact that areas of stone were to be removed and replaced with only section being completed, and flashing applied that's supposed to keep water away from the stone is so small it's barely visible. The contractor refused to return phone calls from the seller, me, or our agents. Rather than return phone calls and act in a professional manner, he placed an illegal lien on the house putting my family in a position with no place to live The seller took issue with the contractor because he didn't do half of the work. Because the seller is an upstanding human being and wouldn't allow my pregnant wife and two-year-old son to be without a home, he paid off the lien. He could have taken this man to court and fought the lien, but we would have been without a home. This contractor never set foot on the property, sent men to do a terrible job, and when only half of the work was necessary to be completed, insisted on being paid the full amount of the quote. The pictures speak for themselves. You'll see that 1" mortar joints were made to skimp on buying enough stone for the job. The house has 1/2" mortar jointsMoreover, white mortar was used when the rest of the house is grey

Business sent the following response:I am responding to Mr*** *** as you requested on 9/10/First, I have no knowledge what so ever about what his house was listed at or sold forSecond, dealing with subcontractors such as carpenters or roofers is a common practiceThird, yes Mr*** was given a written estimate prior to commencement of workThat is exactly what it was - an estimate - based on viewing the exterior of the houseUnseen problems would be dealt with as they appeared during the work which included some demolition and repair to the exterior of the houseAs work progressed our firm was within the estimated amount quoted.During the course of demolition and repairs we noticed needed additional repairs not covered in our estimateThese additional repairs represented serious health and safety issues to Mr***, his family and guestsHe never requested costs or estimates for these additional repairsHe was told extra charges would apply and said to go ahead with the additional repairs as they were necessaryWhich we didAs an example, the additional repairs included demolition and rebuilding of the rear patio ceiling, the deck above the patio, and the pillars on the deckMr*** was shown the need for all these additional repairs before construction started on them, so he was aware of the urgent need for them, although the full extent of the damage and rotten wood could not be determined ahead of time.I do not understand why Mr*** refuses to compensate us for all the additional work we preformed with his approval.Regards,Ronald DR***Cleveland Custom Contractors, IncMaplewood RoadMentor, Ohio 44060440-346-

Unfortunately, this was a bad experience for all concerned partiesThe seller was very difficult to deal with at the end of serviceHe decided that we were charging too much for what we did but was completed via contractThe stone work referenced in the complaint was completed as per the
agreementUnfortunately, the stone had to be removed and the replacement stone did not match completely since the original was out of productionThe seller approved the replacement stone and the final workWe had initially wanted to see if we could appease the buyer in a solution to this situation but vulgar and slanderous comments will force us to bow out of the situation

Business responded to complaint.I am responding to your received complaint from Mr***nt ***. Sorry for the delay but when this was received my associate had become seriously ill and had to be taken in to the hospital for emergency treatment and he is still hospitalized in the ICUThis
put an additional burden on myselfI did not tell Ron about this complaint because I didn’t want to further irritate his situation.Apparently Mr*** has a short memoryWe advised him of every step along the way and the additional cost associated with the additional work. I have sent you pictures posted on my Google Plus account to show you the extent of some of the workThe “LEAK” that he mentions that needed to be located and repaired resulted in the complete reconstruction of that porchThen he was advised about the condition of the columns on that porch which needed to be rebuilt and the cost and lastly the entire thing needed a new roof which we told him along with the associated cost. The pictures speak for themselvesThe original “ESTIMATE” was to address the issues listed in the EIFS moisture report. Lastly, Mr*** realized a $200,Savings on the negotiation of the price of the house which was listed at $850K as I recall because of the problems that were listed in the report. ***, I reviewed the latest response from *** and my response is that we obtained the stone that was the closest match but were up against a size issue and without cutting stones to try to fit the area where old stone was removed we chose to work with the joint sizeSince the exact stone was not available, the only alternative was to change the size of the mortar joint, either larger or smaller so the same issue would have been either wayThe flashing was installed as per manufacturers recommendations, neither seller or buyer were present when flashing was installed. As you can see by the photos we took, the wall does not look that badThe old stone and mortar were discolored by age, thus the new white mortar stands outThe rock face of the stone is slightly different but hardly noticeable looking from a slight distance. The lien was filed because of the owners insistence to try to negotiate the contract after the factThere was a signed contract and after a persistent conversation with the owner (June 19, at Noon) it was my only option but to file the lien on the propertyWhile it may seem a little excessive, it was that or not get paid since the house was ready to transfer.Final Conversation with the owner prompting lien filing.I'm not being difficult I said you needed to change the Estimate once your guys determined the scope of work was not what you quoted I can't help it you did not show up at the job site once It takes about an hour from mentor They showed up days I could add more hours to the billable hours What is the billable rate per hour Your competitors quote was per hour. MY RESPONSE: What does my hourly rate have to do with the other guy? You should have hired the other guyBTW, he's a convicted felonI did this work in good faith, put the crew together and you should have been happy with thatI Charge $for the crew plus material and overhead of 35%.OWNER RESPONSE: I had my builder put together a material list for the job and he was under $ total man hours not including smoke breaks and lunches At dollars per hour comes to $ I have no problem paying you the extra Which would be the difference between my down payment and the real amount you charge for your guys Remember my realtor had you give him an estimate for a caulk job on his home and you came in at $ I'm sorry your a criminal trying to charge me for the same job. I’m finished with this issue and don’t want any more communication regarding this complaintWe did the work as outlined whether they think so or notI’ve attached the link to pictures that we took for your review and the voice message from *** on May 24th regarding the quote.*** In closing I only want to say I have a few regrets regarding this project, biggest is actually agreeing to do the jobWe have been in business for years, I am a disabled Army veteran and have health issues that prevent me from doing things I did when I was a younger manYou can count the complaints against my company on one hand during that time periodI’m sorry *** *** and the owner were not happy with the outcome but I have done all I can doI only hope that all the slanderous comments made by *** *** don’t come back to haunt him*** *** is associated with the *** *** Church and would expect better from him.
