The customer paid for and entered into a contractual agreement to have her credit repaired The services has been performed, her credit score has been increased and the services will be continued for the duration of her months contract Consequently this customer is not entitled to her refund

Complaint: [redacted] I am rejecting this response because:Firstly, I don't appreciate being called Shepard that is not my name or the correct spellingYou may call me Mrs [redacted] , Mr*** Secondly, Per your first response you said the contract says: "Retailer shall not be liable for damages from loss of time, inconvenience, commercial or professional loss, loss of use of the manufactured home, incidental charges such as telephones calls, hotel bills or other incidental or consequential damages"This IS NOT on my contractI would appreciate it, if just once you were being truthful! Tell the TRUTHAlso our home was offline at the factory 8-18-so that date is before Harvey, please quit using that as an excuseYou have excuse after excuse ALWAYS blaming someone elsePLEASE UNDERSTAND, our frustration is with the Sales rep telling us the home would be ready ALL he had to do was tell us the truth, I am an adult and could handle the delay but not after tell us that it would be READY The sales rep also showed us a home with the built in microwave, told us it came with the built in microwave only the Legacy brands doHe sent us pictures of the home with the Microwave and we replied back with that photo that, that is the one we wanted Why were we lied to? Per state regulations a dealer may not install a manufactured home onto an unprepared home siteAccordingly a site inspection was completed in advance of delivery and the site was properly prepared by the installation of a caliche base pad and the home was set to state
regulation standardsAs per the customer signed factory build specification the customer did not order nor does the factory offer a skylight option in the master bedroomAdditionally the customer did not pay for nor does this particular factory offer granite counter topsThe customer received the same type counter tops as were shown to her in the display model home.After factory parts were received the dealer dispatched a technician on July 9thThe technician spent two days at the home and completed all warranty work to factory specificationsHowever factory specifications may not be the same as homeowner expectationsThe customer signed the work order and stated, "*** was amazing and there were so many items that were not on the list the he took care of when he was here." When the technician left the home all service items were addressed and repairedIf any additional service repairs are needed the customer needs to contact the factory or the dealer not the Revdex.comGiven the opportunity, our company addresses all service warranty issues in a timely mannerThe dealer or the factory will address any and all factory warranty itemsAdditionally we as the dealer are the licensed installer will send someone out to the home to verify that the home is set to manufacturers specificationThe homeowner has the right to make aesthetic changes to the home but those changes will not be covered under factory warranty nor will the factory or the dealer reimburse the homeowner for thosechanges

I am rejecting this response because: This afternoon is the 1st I have heard of any service issues being addressed and it wasn't until the business received notice from the Revdex.com. As I am replying the service company is at home trying to figure out why the issue with water. No future service has been scheduled and if it has we have not been given any dates or times. This company was suppose to notify us weeks prior to delivery of home and we found out on a Friday that it would arrive on Monday. We were not notified at any time that service would be done prior to Dec14, 2015. The company did come out on Dec11, 2015; not December 12, as stated in the business response. I'm the unreasonable one when the company delivered a product that did not resemble the Model home in quality at allI have over pictures that document the quality of how home was received and not fixed by workers employed by MH. After spending over 80,on a home, this company is saying I'm unreasonable. Does the person replying to this message have a home to decorate for Christmas. As of 3:pm I have not been to home to see if any repairs have been completed and I'm at the point now that the home can be removed from the property. In fact if this home is not completed by Friday, December 18, by 5:pm MH can pick up the trash quality home that I was sold. I had every intention on reporting progress of work by this company until they decided that I'm too much of an unreasonable customer.

Contrary to the customer’s statements this customer rescinded her contract and refused to take delivery of her new special order home after her home was ordered and built. As per the Texas Department of Housing and Community Affairs Manufactured Housing Division, a dealer is entitled to retain 5% of...

the sales price for special order homes built but refused by the customer, as was the case with Mrs. [redacted]. This customer also filed a complaint with TDHCA Manufactured Housing Division and after a thorough investigation her claim was denied and her filed was closed.  Her complaint is without merit! Her description of how the events transpired is completely fabricated and is a last ditch effort to try to receive a refund that the state has already determined that she is not entitled to receive. [redacted]

The increase in demand for affordable housing coupled with Hurricane Harvey has pushed manufactured home build dates back in Texas for all manufacturers.Manufacturer build times are beyond the scope of our control as the manufactured home retailer. Under the Retailer Limited Warranty that Shepard...

signed it states:"RETAILER shall not be liable for damages from loss of time, inconvenience, commercial or professional loss, loss of  use of the manufactured home, incidental charges such as telephone calls, hotel bills, or other incidental or consequential damages."The contract clearly states that we as a dealer are not responsible for weather related delays. Any and all service issues are being addressed by both the factory and the dealer. Additionally Shepard is very difficult to deal because every time we speaks with her she curses, yells, screams and demands things outside the scope of her contract or wants additional items that were not included in the purchase price of the home; then hangs-up the phone before letting anyone speak. Our company will accommodate the customer up to the point of our contractual obligation and nothing more.

I am rejecting this response because:They aren't being truthful, but I expected nothing less. When there rep tells me that the home would be ready August 20th via text message and phone call (because he knew we were speaking with another company that is REPUTABLE) He basically said anything to get the sale. He even told me that [redacted] in Corpus didn't have wind zone 2 mobile homes. Well I am not dumb. That is the only type that is sold here.So they say I curse and yes on 1 conversation I did tell the bigwig that he was full of st after telling him I don't curse. I have the text messages their rep sent me of the home we were getting with a built in microwave. Yet they say it doesn't come with it. Anyone want to know my experience please reach out to me. THEY HAVE OUT AND OUT LIED about almost every single thing. There contractors put our AC in the wrong place. No one ask where it should go, everyone else has theirs in the back of their homes ours is right up front. They are really not to be TRUSTED. When they own up to their mistakes and fulfill their contract (built in microwave) then I will accept this but until then PLEASE if you are reading this DO NOT DO BUSINESS WITH THIS DISREPUTABLE COMPANY.We are still waiting for ALL the things wrong to be corrected. I see by other reviews that will probably be never.  BEWARE we paid 50k CASH all we had to buy our retirement home and this company has SCAMMED US. They lie about everything. I have hung up on them but curse them no, only cursed at Curtis by saying he was full of st but sorry perhaps the truth hurt.  LIES LIES LIES... Weather had nothing to do with the delay. Again ALL they had to say was it won't be ready, but instead LIE and say it is and then after the fact blame the Hurricane... MAN UP REJECTED.... THIS COMPANY IS A SCAM BAIT AND SWITCH!!!!

All dealer and manufacturer warranty service has been scheduled.  The operations team just walked the home on Thursday, December 12, 2015 to ascertain any and all remaining service issues.  There are no major service warranty issues to address, just minor cosmetic service issues. ...

Customer is being overly demanding and unreasonable is her expectations.  Factory and dealer need time to gather parts and scheduled remaining service.
