I am complaining about not honoring the full commitment of the contract I signed with [redacted] and her company.On Oct 4th 2013 I reached out to [redacted] about a service that she was advertising on [redacted] for getting a medical sales position even if you don't have experience. I emailed her asking her about her service and resume writing. She emailed me back giving some details about her service than scheduled a phone conversation that same day at 12pm. I spoke with her and was very interested in what she had to say. In the conversation she stated that many people miss out on jobs because they do not get their resume to the direct decision maker. She said if you do that you will have a lot better consideration and could get a job. she went on to tell me that if I joined her service I could get a job in 3 months. She told me how she got a women who had not worked in 10 years a medical job and a young lady who was a trainer with no experience a medical position. I first chose to have her write my resume which was very good. I got a lot of attention and a lot of compliments as well as more resume looks and phone calls from employers. She also sent an ebooklet so I can better look up people on [redacted]. The cost of that was $325.00. After a month I chose to get her full service as from she told me she would be very involved in my job searching aspects. after I singed the contract the next step was for me to sign up at 2 different job sites which I did and a her sending me about 400 contacts of direct decision makers from medical companies that she said she has used in the past. I sent my resume to about 200 of those contacts and to this day have not received any contact back. I also had to put a folder together of about 35 emails that did not work. I tried a number of times to reach out to [redacted] and all she did was tell me to wait. I did not get any coaching advice as well as no follow up. I emailed her twice that I was having phone interviews and she was suppose to call me and she did not. [redacted] has spent more time advertising and hunting for customers than helping out a paying customer that went off her word she would guide me through the process. [redacted] believed she would go off of the contacts she gave me with no effort on her part. She failed to follow through with her phone calls and follow up. I was very disappointed with her service of helping me find a job. I had to take a job outside the medical device positions I was searching for. I got this job on my own without her coaching which is still disappointing. Desired SettlementThe part of her writing my resume was a good service that I am not complaining about. She did a great job and I can add onto it without recreating the template she started. However, her coaching, guiding and contacts were not up to the quality she had me believe them to be so there for that part of the service and payment of $450.00 should be refunded. I waited and was very patient with [redacted] hoping she would reach out, give me some searching ideas as well as help with better contacts.Business Response In numerous phone conversations I stressed to [redacted] that the search for medical sales jobs was a process and the average duration of the search was 120 days. I provided him with the contacts and had numerous conversations. He received the contacts and instructions to begin his job search on November 6th, 2013. In less than 4 weeks, he was unhappy that he had not received interviews. Also note that there was a long holiday weekend during this time. I also stressed again that it was entirely too soon and that he needed to continue with the process. Please note the following attachments, including the contract for services. The contract he signed shows that I cannot guaranty employment. I provide tools and guidance. I conducted an interview preparation session on December 5th and discussed again the importance of the process. On December 21 I received an email demanding a refund. I was at a loss. There is not time listed for delivery of services in the contract. My commitment is to work with a candidate UNTIL THEY ACCEPT A POSITION. You will note in the email in the document listed as [redacted] he did in fact accept a position. It is my belief that his demand for a refund is based on his accepting a position and changing his mind about pursuing a medical sales job. His accepting a position actually fulfills the contract obligations from my side. He did receive the company contacts (not available for sale because of high value), which he used, He received interview preparation services, which are charged at $75/hour. There was no lapse in the delivery of service or breach of contract on my part.I have an email where he states he has accepted a position in the telecommunications industry.Services and Confidentiality Agreement between [redacted] (Client) and Clinical Strategies (Company) .This agreement defines scope of services provided to Client to assist in the job search and interview process. It is acknowledged that the processes and services provided are proprietary to Clinical Strategies and shall be treated as confidential information. By accepting the terms and conditions of this contract Client is agreeing to treat all information obtained as confidential and will not disclose to any other parties. Any information provided to Client is solely for their personal job search and will not be shared or distributed.The Clinical Strategies program is customized based on specific Client experience and needs. The program provides active job search support until Client has confirmed employment. CONTRACT as signed by [redacted] By entering into this agreement you acknowledge that you are entering into a partnership designed to support and enhance your job search. It is understood that there is no guarantee of employment, stated or implied. While the Clinical Strategies program is designed to greatly improve your chances of finding employment, the Company has no control over hiring managers or hiring decisions. As part of this partnership, below are outlined general statement of services provided and expectations for Client. Client Expectations: * Client will fully disclose any negative information in employment history that may impact job search;* Client will respond to all inquiries or request for information and approvals by Company within 72 hours of request;* Client will notify Company in writing within 24 hours of any major changes impacting job search. Company Services Overview:* Analysis of current job search strategy & guidance on new strategies;* Review and revision of resume, development of cover letter (e-mail) to market oneself;* Optimization of LinkedIn profile;* Training on how to identify potential employers and "non-advertised" positions;* Contact information (e-mail addresses) for decision makers in pharmaceutical/medical companies;* Interview preparation and debriefing with audio taping, to include assistance/editing of follow up documentation, assistance in development of 30-60-90 day plans (business plans) and support during salary negotiations as needed.
