Review: I had a contract with [redacted], she was suppose to make a website and do marketing for me. In the contract it didn't mentioned what are the consequences if any party terminated the contract. She totally misrepresented herself and gave false hopes. she also charge me over $2200 for making a website and one month of marketing. When I found out that she has been misrepresenting herself, I terminated our working relationship.she is refusing to send me the website zip-files nor she refunds my money. she insists that I have to pay her for the hosting agreement and marketing for the next 7 months which is about $4500. She started charging for the "hosting" form the first month, before she even created the website.I will not pay for the services that she has not provided and would like to take my money back or the website that I have fully paid for. she claims that she has paid for the second domain and she wants refund. I have prove of purchase for the domain. I think she sees me an ATM machine. Please advise. My attorney advise to follow up on this.Desired Settlement: Either refund the money she charged for the website or send me the zip.file. and the right to use it. I have even communicated to her that I will Sign an agreement for the copyright violation.

Clinician Resources entered into an agreement with Dr. Farhadi (attached) on Feb. 21, 2013 wherein I rendered consulting services to market her psychiatric practice. The agreement has an eight month term and included a variety of services such as brand identity, development of a website and development of referral sources.

The consumer was issued an invoice, in the amount of $2,129.90, for services rendered as follows:

• Brand identity (1 time cost) : $600.00

• Website development: $499.95

• Website Hosting (monthly): $29.95

• Business Strategy/Monthly retainer (8 mo. min): $500.00

• Website Content Copywriting (1 time cost) $500.00

The consumer paid the balance due in full.

During the first month of services I worked with Dr. Farhadi on brand identity, completed development of the website and began working on creating business strategies for referral sources. These efforts included introductions to a prominent psychotherapy practice, which ultimately led to Dr. Fahardi executing an agreement to provide psychiatric care for their patients, a consistent revenue source for Dr. Farhadi’s practice.

During the second month of services I continued developing referral sources in accordance with the agreement. An invoice in the amount of $550.00 was sent to Dr. Farhadi on March 21, 2013 for services rendered as follows:

• Business strategy/monthly retainer (2nd month): $500.00

• Website hosting: $29.95/month

• Additional domain name registration: $20.00

Note: When Dr. Farharadi notified me that she no longer desired to engage my services I subsequently did not proceed with purchasing the additional website domain name registration. Dr. Farhardi may have purchased the additional website domain name but that was not conveyed to me at the time the invoice was issued which is why the cost was included.

During the second month of services I had several conversations with Dr. Farhadi regarding success to date. During those conversations Dr. Farhadi stated that she would be “sending a check” for the respective services rendered. After several “the check’s in the mail” conversations, I informed Dr. Farhadi that I could not host the website online prior to receiving her payment in full for the second month of services rendered.

Hosting the website was delineated in the agreement at a rate of $29.95 per month.

Services in accordance with the agreement were rendered despite the difficult working relationship with Dr. Farhadi. Hours far exceeded those outlined in our agreement and this short endeavor was very successful despite Dr. Farhadi’s grievance. I told Dr. Farhadi that I was willing to dissolve our 8 month agreement but she would need to stay current on her payment into the second month. She currently owes $500.

1. Clinician Resources enjoys a reputation for high quality products and services specifically for healthcare professionals and has built it's reputation on being a valuable resources for building a professional practice in the following ways:

- Introducing professionals that are strategically chosen to benefit one another in terms of growing their practices through cross referral sources.

- Building an infrastructure of solid marketing and branding which include: Branding and Brand-identified marketing materials, SEO-optimized website, Social Media

- Expanding professional resources by specifically chosen networking opportunities and practice-growing techniques

2. Clinician Resources' fees for working with clients are clearly identified in a working agreement that typically spans the time of approximately 8 months (which is the amount of time it takes to create success through "branding", designing and developing a website, determining a brand-identified social media platform combining social media applications that are referral generating through awareness, and developing solid cross-referral contacts). Payment is made by clients for products as well as services at the onset of a working relationship with a signed contract. Retainer fees for referral introduction and networking services are made at the beginning of every month for the forthcoming month of work, as is typical of other businesses. Delinquent accounts determine a seize in services until contracted payments are current.

3. Clinician Resources does not ask for additional money from clients unless additional services are requested. The additional services are estimated and approved prior to billing.

Example: Dr. Farhadi approved the printing for her own business cards prior to being billed. She then paid the amount agreed upon without further discussion until now. Printing takes many shapes such as: Quantities which may vary from 50 to 50,000 pieces; Additional colors or special features like embossing or foil stamping; Shipping charges which are based on quantities/weight - Clinician Resources cannot include printing charges in contracted services rendered unless these unknown factors are determined prior to signing the agreement, and at that they would be included as a line item in the agreement. Most clients do not determine these factors at the onset of an agreement, as in the case of Dr. Farhadi, therefore they are billed as additional charges. If the client did determine these printing specifications prior to signing a contract with Clinician Resources then the specifications would be outlined as a separate charge in the original agreement prior to the onset of performing services.

4. Clinician Resources has a reputation of doing fair and quality service for it's clients. Clients are very happy with the work performed and refer their professional colleagues to C.R. because they believe in the products and services provided... and they work!

I am rejecting this response because:

One of the reason I ended my relationship with this company was that sheila didn't deliver what she promised. I have told her about the cards multiple times and I am not bringing this up NOW. The company's reputation at this point is irrelevant. I paid for the website and she hasn't delivered it. And its OK if I won't get my money back at this time because she hasn't and instead she is preaching about her company's reputation. I will share my experience with every colleague that I have had with this company unless she all return my money and I don't want to hear from her. Thanks
