Revdex.com:I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.[To assist us in bringing this matter to a close, we would like to know your view on the matter.]Regards,*** ***First and foremost I wish to take the time to thank the Revdex.com for their professionalism and focused resolve to my complaintWithout this avenue, I'm afraid we the consumer would be consistently taken advantage of without recourseNow, as for MrW***'s response to my complaint, I'm afraid he too seems to have several facts of this incident that are inaccurate and can easily be proven by witnesses at the sceneMrW*** states that he received a call at 3:AM on Sunday, July 9thand he then called his tow truck driver and gave him instructions to recover this vehicle at *** *** *** *** ** ***While MrW*** is correct that the homeowner had called because there was a vehicle on his lawn, there WAS NOT an operator or ANY other person on this homeowners porch at ANY TIMEMy son was the operator of the said vehicleWhen he accidentally drove the vehicle onto this lawn after missing the stop sign at the end of a hill, he immediately attempted to drive the car off the lawn but could clearly see that the car was stuck in some mud since this yard runs alongside the *** *** and we had just experienced some very heavy flooding in this areaMy son did not want to tear up this persons lawn nor did he want to wake him/them up at this time in the morningHe decided to call a good friend who lives close by and has a truck to helpIt is when his friend arrived that they realized the car was IN FACT, OUT OF GAS! My son and his friend proceeded to go and get some gas to put in the vehicleI might add that at the time these guys left this scene to go retrieve fuel, the homeowner was not present nor were there any lights on in the house to indicate he/she had been awoken. When the gentlemen returned with the fuel, the homeowner was standing outside with his phone in his hand and his wife explained that he had called since they could clearly see there was a vehicle on their lawn, but did not see any victims and they were concernedWhen the *** Police Department arrived on the scene, my son acknowledged he was the driver of the vehicle and cooperated with any and all further questioning by the officerWhile my son was being questioned, his friend walked over to the vehicle and proceeded to add fuel to the car so that it would startWhile it's quite clear to me that MrW*** prefers telling his version of this story, (I'm not really sure why he would want to include such personal details of someone who he doesn't know), he states in his argument that he sent his tow truck driver to the scene, therefore, his edition of this fiasco is complete hearsay.I do not feel the need to pick apart MrW***'s response as he did mine since it's quite clear to me that he feels strongly that he and his company, Clinton Auto Service, simply answered a "business" call and handled it mundanely as they do every other callI would like to add that ever since this incident occurred, my wife and I have mentioned the outrageous cost for getting our vehicle back from this business to friends and neighborsIt's alarming to hear that we are definitely not the first family to be taken advantage of by Clinton Auto.Throughout these passed few weeks, we have heard from COUNTLESS people who reside in this community and each and every one of them have been consistent with their own negative encounters with this business.I have many reliable sources who have expressed the need to bring this story, and others as well,to the attention of the *** Town Council as the people of Clinton are fed up with the way this business continues to take advantage of consumers by price gouging and bad mouthing citizens of the community with hearsayUnfortunately, my son and our family became one of Clinton Auto's victims and we payed a hefty price for itHowever, from this day forward my wife and I will keep our eyes open and continue to educate the folks from our town of the untrustworthy practice of this business.Thank You,*** ***

This letter is being written in response to complaint# ***.I received the call at 3:am on Sunday, July 9th, I contacted my tow truck driver and instructed him to recover a vehicle at *** *** *** *** ** ***, as instructed by the operatorThe homeowner at that
address had called because there was a vehicle on his lawn, and the vehicle's operator was found on his front porch.According to the arresting officer, the vehicle's operator (the "son" of the plaintiff) had been *** for ***Certain points of the plaintiffs complaint are inaccurateFirst, the vehicle was not out of gasWhen the vehicle was unloaded from the flatbed, the tow truck driver drove it into one of the shop's bays so it could be locked up since the shop was not open for business as typical of our Sunday scheduleThe person the plaintiff came in contact with on Sunday was not involved in the recovery of the vehicleNormally vehicles towed in for impound purposes are locked away in the body shop, which is where our employee initially looked when prompted by the plaintiffOur employee would have not known why the vehicle was locked away in a shop bay, especially since many vehicles not yet completed with their repairs are left in bays overnight and/or on the weekend.Second, the $per day storage fee is per day or any part of a day, just as any car rental company charges its customers for renting a vehicle in the same mannerThe vehicle was on our premises Sunday July 9th and Monday July lOth, hence the days of storage charged.Storage fees, as car rental fees also, are not based on a 24-hour clock.Third, the car was not winched out of a ditch but had gone over a hump and down a slight embankmentThe vehicle was 30-yards off the road, and both driver-side wheels were packed with mudThe vehicle had to be winched off the lawn, up the embankment, over the hump and onto the road so it could be loaded onto the flatbed.Fourth, the plaintiff was given, at the service counter when he arrived to pay for and pickup the impounded vehicle, an itemized bill and a detailed explanation of all the charges incurredHe was by no means just given an itemized bill and told "thank you" as the plaintiff stated in his complaint.Fifth, we do not believe any refund or settlement is justifiedThe charges incurred include our standard response fee with weekend and after-hours fees applied; standard fee for winching a vehicle that has gone off the road; the aforementioned standard storage fees, and the fee to load the vehicle on the flatbed, transport it to our shop, unload the vehicle, and drive it into the shop bayFees of this nature and amount are consistently covered by insurance companies when vehicles are totaled and picked up by salvage companiesPlease see the attached invoice for reference. Please contact me if any other information is required.Respectfully,Rick W***, Owner Clinton Auto Service, Inc
