The West Pace Village Cooperative District is a governmentally organized public corporation formed under Chapter 99B of Title of the Alabama Code as a political subdivision of the State of AlabamaThe district is completely independent of our business enterprises, and we have absolutely no control over the district nor representation whatsoever on the district’s board of directors, the members of which are appointed by two other public entities, the Commercial Development Authority of the City of Auburn and the West Pace Village Improvement DistrictThe City of Auburn authorized and consented to the formation of the cooperative district, but the district is completely independent of the City and the City has no responsibility for the license fee The cooperative district was created to provide the developer of the overall site in which our dealerships are located a means to obtain the funds to improve the property (primarily by building the roads) through the issuance of governmental bondsThe district has levied a license fee pursuant to Alabama law to provide funds to repay debt service on the bonds it issued to pay for the public infrastructure in the development Please understand that the district license fee is levied by the district, not our business, and that it is non-discretionaryBecause we are a business located in the district, we must collect the fee on every sale we consummate, and that fee must be applied by the district to pay debt service on the district’s bonds All the of charges and fees associated with every purchase are completely disclosed on the relevant purchase documents
Why would we admit to being dishonest when we haven't? Our response was not genericIt directly stated that our actions are legal and approved by all necessary governmental agencies in accordance with Alabama law
The vehicle was advertised as having a keyless entry system because it did in fact have one Also, the system functioned properly for months based on the complaint The vehicle was several years old and purchased used and "as is" except for a month 3,mile powertrain warranty which was included at no cost As stated in the complaint, we did offer to assist the customer with locating a replacement system but that offer was declined Aftermarket or third party accessories are a popular and affordable choice for many consumersOften, vehicles are traded with such accessories and they are of equal or better quality than the original supplied or offered by the manufacturer and make it difficult to determine if in fact they are or are not originalEspecially, when the make/model is different from our own franchise make We made an honest attempt to resolve the issue and the customer declined There was no "shady" behavior on our part as the complaint alleges
