Review: In early January I contacted Club Car NY via the email provided on the website to inquire regarding having a birthday party held at their establishment. I exchanged various emails with the party planner, Audrey, and held one conversation with the owner/chef Brian. Once the date of August [redacted], 2015 had been agreed upon, Audrey advised me that the deposit for to lock in the date would be $2,500. At no time did she say to me if the deposit was, or was not, refundable. I was provided a document on 01/**/2015 titled "Credit Card Form" has the name of the restaurant on the title page and "Club Car Credit Card Form" across the top middle. In the body it asks for name of the person, address, card number, expiration date and date of event. No other words, explanation or details provided. On 01/**/2015 I provided Audrey at Club Car, the above information which was asked for on the Credit Card Form, leaving the last 4 digits of the credit card missing, asking that the restaurant contact me on the telephone for the last 4. I did this as an added security. On 1/**/2015, my [redacted] Credit Card was charged $2,500. On 04/**/2015, almost 4 months prior to the event date, I informed Club Car, via email, that I was going to not be able to hold the event due to other commitments my family was going to be doing in the week surrounding the proposed date. I asked for a full refund since I had never been verbally, or in writing, told the deposit was non-refundable. In a telephone conversation in late April, Brian, the owner told me that I would not be given the full deposit back because it doesnt say refundable and that he would "deicide what was appropriate." I even made an effort to work with them and have them pay me back in installments. To date I have not received any of my deposit back. I have made many good faith efforts, via telephone calls, and emails to obtain my deposit back with no response.Desired Settlement: Full Refund. In a contract, it be me construed most strongly against the party who prepared it and favorably to a party who had no voice in the selection of its language.
