Complaint: [redacted] I am rejecting this response because: The reason I filed this Revdex.com complaint is because it became rather apparent to me that this business, as a standard business practice, has and continues to illegally engage minors in contracts Their response reaffirms that this business continues to overlook the fact that being an authorized user of a credit card account does not guarantee that a potential customer is a legal adult Credit card issuers allow minors to become authorized users The only way they can verify age is by requesting identification, which they clearly did not do If they would’ve verified my son’s age by asking for identification, they would’ve clearly seen he was only when the original agreement was supposedly signed and when it was renewed The fact that they failed to verify his age, not once, but twice, is very concerning, as anyone could come in, write down any information and present anyone’s credit card If they don’t verify the identity of new clients, which should be a standard business practice, it makes me question all of their business practices and policies Nowhere in the contract, or in any of the paperwork that I received, does it state/verify the age or date of birth of my son I refused to sign the cancellation because I was never aware of, or a party to, the original agreement and I didn’t want to be held responsible for yet another one of their ridiculous fees ($ cancellation fee) I was also advised not to allow my son to sign the cancellation as well since he is a minor and the original agreement should be null and void under the circumstances, and therefore, no cancellation should be required Within the agreement itself, it clearly states “Any member who is under the age of must have a parent or legal guardian co-sign the agreement” which I clearly did not doI am however, enclosing a copy of his driver's license, so they can now verify age, since they didn't do it at any point previously Their response takes no responsibility for their actions: they didn’t verify age and therefore contracted with a minor Yet, they have no issue with calling my son and me liars They basically stated that my son provided an incorrect date of birth, from which they inaccurately determined he was I don’t believe this to be the case at all; my son had no reason to lie to them They either didn’t request the info or overlooked his age They also stated they have a “strict” policy of calling, emailing and mailing delinquent accounts prior to sending to Collections and I dispute this as well I work from home and at no time did they call or write to this address and I would know because I am here all day and receive the mail as wellWe did not become aware of this situation until we were contacted by the Collections Company who quickly closed their file once they determined my son was a minor and I immediately contacted the businessI still want all of the fees collected under this illegal agreement refunded In addition, I want to be reimbursed for the Collection fees assessed as well, since at no time did they attempt to resolve this matter prior to sending it to Collections and furthermore, it’s illegal to send a minor to Collections since they cannot get credit in their own name and are not legally able to enter into a binding agreement Attachment/Enclosure: Copy of J [redacted] drivers license Sincerely, [redacted]

In response to the forwarded complaint, one of our primary focus' here is receiving and inputting correct information, especially regarding billing. When the customer's son came into the business to become a member, he himself was to fill out the paperwork and we then check the paperwork...

accordingly. We check the date of birth, we check for the correct signatures, we check thoroughly to ensure that the credit card he had provided belonged to him and only him. It was in fact her son's name on the credit card he provided so of course, we went ahead and accepted it. We also had checked the date of birth and per the date he had provided, her son was not considered a minor. At that point it is not policy to check ID when a clear date of birth was written. The customer had clearly stated in her complaint to the Revdex.com that she had intentionally authorized his use of her credit card and that his name was clearly on her account. We would have had now way of knowing if the son was underage, or that the credit card was also in her name, as her name was not listed on the card. We still to date, have not received proof in any form that the son is or was underage, even after kindly asking the customer on the phone to stop down to the business and meet with the General Manager to fix the issue. I had asked for proof of ID and also for a quick signature so I would be authorized to cancel his current account. I informed the customer that I would do my best to help her in any way I could when we spoke via phone and that I would be willing to cancel her son's current agreement to simply avoid any further issue or upset. I informed the customer via phone that I would be unable however, to refund her for the past months invoices, and also for the amount paid in person by her son toward the collections amount. Our agreement clearly states that once signed, all monthly amounts are due promptly each month and that if any change to the credit card or account may occur, that we must be notified immediately to avoid any late fees or penalties.  When the customer's account became delinquent it is strict policy for us to notify all parties both via phone, email and mail that the account is then past due. It is simply not possible that they were not informed of the past due balance. We do our best to avoid having our customers end up in third party collections and make all efforts to prevent that from happening. Our policies are clearly stated in the agreement her son had signed and my staff followed all proper procedure to ensure that the agreement was done properly and legally. The customer clearly refused to sign a cancellation for the newest agreement, despite us trying to work with her and had clearly authorized her son the use of her credit card for which his name was printed on. The customer's son's account is currently cancelled and no further monthly dues will be charged to the son's credit card. As stated above, we are unable to issue any refunds for previously paid amounts as they were within the terms of the signed agreement. We do apologize for the confusion and the upset and wish the best for the customer and her son.
