Called business to be sure I didn't have to do anything to cancel my membership. I was told "No". Drafts continue from my bank account.I called Clubworx in February 2014 inquiring about my membership. I did not want to continue membership. I asked if I needed to do anything to have it cancelled and their representative said, "No. You don't have to do anything." Now they've drafted my bank account for two months and refuse to refund it because I didn't come in with a letter. I spoke with someone in the billing department and she said she can't do it. I've worked at a bank for five years and I know that companies can do whatever they want. I currently have been a teacher for 12 years and if I treated students with this level of unfairness, I'd lose my job. Desired SettlementFees for March 2014 and April 2014, $110.00. It also clearly states that cancelation by phone, fax or email is not accepted. This policy has always been in place and our staff handles dozens of calls each month directing people to get us their cancelation request in writing. I can't imagine that she would have been told she didn't need to do anything. We would be happy to extend Ms. [redacted]'s membership an extra 2 momths even though we have done nothing wrong.Consumer Response /[redacted]/I do understand that the cancellation policy is written on the agreement that I signed. I don't appreciate basically being called a liar ("I can't imagine that she would have been told she didn't need to do anything.") Why would I do that? I didn't remember the policy so I called and that IS what your representative told me. I am a school teacher. I understand about being diligent and following through. I also know that I don't remember every little thing, so if I forget, I ask. That is what I did. I was told that I didn't need to do anything. When the pool was closed for half the summer last year, I was disappointed. That was one of the main reasons I joined. All we got was a "We're sorry." I didn't ask for a portion of my money back even though you were not giving me the entire product I signed up for. Apparently Clubworx has a different standard they hold themselves to than what they hold their customers to. I don't want two more months. My doctor told me to only stretch at this point. The workouts and machines were hurting more than helping me at this time. I'm not asking for a refund of anything other than the two months after my year membership. I never used it during those two months and not much prior due to my doctors orders and the fact that the few classes I took were not that useful, due to my muscle condition. When my doctor told me about not working out at a gym last fall, I decided that since I signed a contract with you, I would not ask you to cancel my membership early. I had made a commitment. I take commitments seriously. When my year was up, I called your establishment and I WAS told that I didn't need to do anything; only to let you know if I was going to want to continue the membership. I am 56 years old and have worked at a lot of places in my life. I have NEVER been treated with such nonsense. I would never treat anyone else with this level of arrogance. If I treated my students, parents, peers like this, I wouldn't have a job. Final Business Response /[redacted]/The member has contacted us through other channels within our allotted time for us to respond to her request through the bureau so we will need to use those means to settle this matter. However, we would like to address the statement that the "pool wsa closed for half the summer last year". ClubWorx has both indoor and outdoor swimming pools. We went back to check our records and found that the outdoor pool was closed on 5/24/13 & 8/13/13. We also shut the pool down early for 3 swim meets. The only other times the pool was closed was due to thunder and lightning. Our indoor pool is open all year round and was open both of the days the outdoor pool needed to be closed. Therefore, a swimming pool has been available to our members daily. With reference to the member's medical condition, we have nationally certified personal trainers that would have been able to help the member with her stretching as well as some other possible exercise alternatives to the machines. We often work in conjunction with doctors to help their patients improve their condition. It's unfortunate that member has a medical condition and we hope that she continues to improve moving forward. This will end our correspondence through Revdex.com. The alternative method will now be used to finalize this matter.
