your internet response system, without the proper contract copies, photos and other relevant supporting documentation.
#1 - Refrigerator was disconnected by a professional moving company. Sale was for 3 days and for the rest of the weekend, there was no problem with the Ice maker faucet. Due to the corroded and worn seal, the faucet began leaking on Monday, which is when the Realtor found the leak. Realtor didn't even turn off water, instead, he called us and we drove 40 miles to shut off the water and assess the situation. A plumber was call and the customer was informed as to what the cause of the water leak was which was corroded plumbing. We asked her if she wanted them to repair the faucet, she said absolutely not and that she would have her realtor take care of the problem. I have photos of the faucet and the bill from the plumber which identified the problem. We did make sure that the water was turned off to the house to keep the water from continuing to leak. As stated before, photos of the faucet, cabinets and walls are available, recorded telephone conversations between both us, the customer and the realtor.
#2 - The reason messages were left with the customers niece was that she was traveling and staying with her niece or in the hospital during this incident and there was no other way to contact her.
#3 - The carpet is white and was filthy before we ever started the sale. We even asked if she was going to have the carpets cleaned and she said she didn't think they needed it. I also have photographs of how dirty the house was when we first came in and how soiled, faded and stained it was. I also have photographs of how clean we left the customers residence after the sale.
We did an excellent job cleaning up, setting up, conducting and cleaning out the customers house for her estate sale.
ALL THE ABOVE CAN BE PROVED WITH PHOTOS, TEXTS AND RECORDED TELEPHONE CONVERSATIONS.
Last, our contract specifically states, which the customer willingly signed:
"Seller warrants to hold Auctioneer, Clutterby's Auctions and their employees harmless from, and indemnify Auctioneer, Clutterbys Auctions and their employees against, any claim, action, suit, cost, damage, deficiency, expense, loss, or liability of every kind, including attorneys' fees and costs of defense, asserted by any person, real or artificial, or by any entity of government, against Auctioneer, Clutterby's Auctions and their employees in connection with the offering or sale of the property. Seller agrees to pay sale expenses including: Auctioneers Fee and any dumpster/trash removal.
A copy of the contract with customer is also available for your review.
The customer's complaint is unwarranted and appears to be a bogus attempt to get our company to pay for faulty plumbing and her carpet cleaning.

I have not anticipated being reimbursed for expenses incurred by the estate tag sale. [redacted]'s attitude has been evident from the outset.
My property and possessions were [redacted]'s responsibility when the refrigerator was sold and moved by a "professional moving company." She should have monitored that company as it caused the damage. The refrigerator was bought new and installed on 9/20/2013, so the assertion that the problem was caused by a corroded and worn seal is doubtful! My realtor found the leak on Wednesday evening following the sale (not on Monday, as stated by [redacted]) and notified [redacted] immediately. [redacted] told him that she could not come to turn off the water to the house as she was conducting another estate sale. She said she contacted a "plumber" and reported to me that the "plumber" said there was no problem. Why would [redacted] then inquire whether I wanted the "plumber" to repair it?! My realtor contacted the contractor who stopped the leak and repaired the damage. The damage would have been much less extensive and costly if [redacted] had turned off the water when my realtor called her attention to the problem.
The carpet is tan. It was professionally cleaned on 2/14/2014. I saw the carpet after the moving van had loaded my possessions and have photos from two sources and observations of several people who stated that the carpet needed to be vacuumed. Any filth occurred before, during, and after the tag sale. (Items that had not sold during the tag sale were removed the following weekend.) [redacted] had keys to all outer doors and the gate, so there was no need for someone to walk in the house after being in the back yard. [redacted] had told me that she would cover the carpet with plastic and route traffic one way. Friends who came to the tag sale told me that neither of these conditions was met.
[redacted] had my Rochester, MN phone number and had used it. When she stopped answering her phone, I could have no conversations with her but left recorded messages on her answering system. She promptly responded by texting my niece. [redacted] knew how to reach me!
I feel that the ethical thing is to document what happened so that others can know the truth. It is not a "bogus attempt to get our company to pay for faulty plumbing and her carpet cleaning" as stated by [redacted].

Since Ms. [redacted] threatened me in one of her recorded messages, text messages were sent for documentation; and although I requested an email for Ms. [redacted], one was not provided. I am not able to print these texts but would be happy to forward them to you in an email. Also, if you wish to hear the recorded phone messages, you can call and I can play them for you.
As stated by Ms. [redacted] herself, the realtor was at the house on Wednesday after the sale (as my docs also show). We were at the house Friday, Saturday, Sunday and Monday for the sale, and there were no leaks from the refrigerator faucet. As you can see, the faucet is old and sometime between Friday when the refrigerator was removed and Wednesday, the water pressure obviously caused the faucet to leak. Had the faucet been leaking during the sale we would have noticed and shut off the water and called someone to repair the faucet. It is beyond me why the realtor was not smart enough to turn the water off to the house and instead let it run until I came to the house from Coarsegold later that day. The carpet, whether white or tan, was dirty before we started setting up for the sale, and as you can see, the outside patio door has a concrete patio going into the house and would therefore not allow the ground in dirt in the carpet as Ms. [redacted] claims over a few days. However, as you can see from the photos, there is no dirt in the patio doorway.
Also as you can see, there were many calls and conversations with Ms. [redacted] to help her resolve this problem, but none were satisfactory to her and she told me (in a recorded conversation) that she did not want me to have the plumber fix, that she would have her realtor take care of it.
I have also sent you a copy of the contract as well as the Final Settlement Acceptance of the sale sheet.
Once again, the contract states "Seller warrants to hold Auctioneer, Clutterby's Auctions and their employees harmless from and indemnify Auctioneer, Clutterby's Auctions and their employees against, any claim, action, suit, cost, damage, deficiency, expense, loss, or liability of every kind including attorneys' fees and costs of defense, asserted by any person, real or artificial, or by any entity of government, against Auctioneer, Clutterby's Auctions and thier employees in connection with the offering or sale of the property."
I am sorry Ms. [redacted] had the water leak problem, though no fault of Clutterby's, it was just an unfortunate accident, it would have happened to anyone who disconnected the refrigerator.

[redacted] of Clutterby's has not proposed a resolution. She has only accused me of wrongdoing. However, I had left my property and possessions in her care while she conducted the estate tag sale on my possessions.
My goal in reporting the damage to the Revdex.com was to document what happened so that others who might be considering Clutterby's can know the truth.
I am closing the complaint.
