Unfortunately, this individual is manipulating and twisting information to execute this frivolous complaintMy business owns numerous parcels of land in Central Florida which I am in the processing of sellingThe property in question is a acre corner lot in Marion County FloridaI verbally agreed
to a sales price with Mr*** *** of $1,for the propertyMr***'s comment that I will not put anything in writing is completely false I emailed him an unsigned Purchase Agreement to review on 12-18-and in that email my exact words were "For payment, I accept bank wire, bank certified check, money order, Western Union, Venmo payment app or Facebook Messenger Payments. If you would like to pay another way, please let me know and we can discuss it"Mr*** confirmed he received the Purchase Agreement and replied "Good Day Miguel,Thank you for the email and attached documentsI am a bit concerned on our first deal to send money and then hope you file the deedI recommend the following procedures to insure we are both taken care of:Create a PayPal invoice for $sent to ***@gmail.com and create the terms as the deed will be e-filed by the seller and once recorded, proof shall be sent via PayPal email for verification and immediate payment requested through PayPalYou will be responsible for paying efile fees and transfer tax as proof you properly recorded the deed transfer(Very low Cost due to purchase amount) I will provide you with a Land Trust Deed "*** *** *** *** *** **Payment will be made immediately on PayPal once deed recording has been verifiedPROTECTION: If the payment is not received you can always file a corrective deed. I look forward to the corrected contract with the name of the buyer as: *** *** *** *** *** ** * *** *** *** "I replied that I prefer not to use Pay Pal and offered other suggestions " Hi ***Hope all is well I have no major issues with the deed you sent over just some minor thingsThe vesting deed does not have my middle nameI am on the road right now but need to confirm the Legal description as wellUnfortunately I do not feel comfortable signing, notarizing and recording the deed without payment.Here is what I suggest; you hire a mobile notary (I will split that cost) for my area and send them a bank certified checkI sign your deed, they notarized and collect the deed and give me the check at the same timeThey can then scan and email it to you as well as mail you the originalPlease let me know your thoughtsThanks"Mr*** replied " MiguelThanks for the email. When dealing on the internet, it is always the person who is transferring the funds that is at full risk. Procedures should address this risk to insure that the deed is recorded and recorded properly to convey FULL interest in the propertyEven at Title Companies the deed is signed first (legal transfer) prior to delivery of paymentI would be willing to do the following to mitigate risk:I will deliver good faith down payment through PayPal of 20% (with a amended contract) to reflect these stipulationsSeller will E-File the Warranty Deed and supply proof of filing to buyerBuyer will call and verify with Marion County that the deed has been filed and recorded properlyBuyer will then issue final payment through PayPal for the remaining 80%"Mr***'s comments about me talking him into PayPal payments are completely false On 12-28-I had created and emailed Mr*** a PayPal invoice for the $we had agreed upon and at this time Mr*** had an issue with a sentence in the Legal Description of the Deed that reads "No commercial enterprises without permission of Grantor." Mr*** replied " We will be using the land for commercial purposes and as such we cannot have cimmercial restrictions in the deed "I called Marion County and spoke with the Recording and Appraisal Depts and was explained that I would need an attorney to get that restriction removedAs per my attorney, Larry Callaway from Klein & Klein LLC, the restriction "appears to have originated in the deed from Hasty-Greene Investments, Inc., successor to *** *** *** ** *** ** *** **dated February 3, 1995, recorded February 15, 1995...To get rid of the restriction, you would have to get a release from Hasty-Green Investments, Inc., and each grantor under each successive deed."I was unwilling to pay attorney fees and take the time to get this done and AS I STILL HAD NOT RECEIVED A DEPOSIT OR SIGNED PURCHASE AGREEMENT I continued to market the property for saleMr*** did indeed submit a $deposit on 2-6-days after the invoice was created and then submitted a Purchase Agreement (signed by buyer BUT NOT signed by seller) on 2-7-days after original Purchase Agreement was sent to himBy this time another buyer had already sent in an executed Purchase Agreement (signed by both buyer and seller) with full payment on 2-1-BEFORE Mr*** submitted his deposit and unsigned Purchase AgreementMr***'s comment that I just take people's money is completely falseI notified Mr*** that the property was already under contract with another buyer and returned Mr***'s deposit Mr*** began issuing threats of law suits so I engaged my attorney to review all emails, documents and exchanges between myself and Mr*** and was advised that Mr*** did not have a legal case as we do not have a Purchase Agreement, signed by both buyer and seller, and the deposit money was already returned before any legal threats began and that I was legally bound to sell the property to the buyer who I did have an executed Purchase Agreement with and accepted their payment, which I did.Mr*** continues to harass me and my business with complaints and legal threats even after I explained the discussion with my attorney and after I showed him Section Florida Statutes provides that no action may be brought under any contract for the sale of land unless the claimed contract is in writing and signed by the person against whom enforcement is sought.I have tried to resolve this amicably but have not been able to effectively communicate with Mr***The Attorney General of Washington State immediately dismissed/closed this frivolous complaint on 2-26-18I look forward to hearing back from youThanksMiguel R***CMReal Estate LLC321-430-
