Complaint: [redacted]I am rejecting this response because:

There are a number of inaccuracies in the response from Jafar, which I want to address, as follows:

‘[redacted] then requested an additional discount for purchasing both rugs.’

FALSE - I did not request an additional discount.  Hamid was very keen on giving me ‘a good deal’ on rug #[redacted] from the first day I entered the store.  When he came to the house to show the rugs, he offered that he would give me ‘designer pricing’ for both rugs and that his ‘brother’, Jafar, would be upset if he knew just how good a deal I was getting.

‘After some consultation, we agreed on a package price for the two rugs and two pads, we informed her at that time, that the sale was a final sale and that we would need to order the rug pads.
She did not ask for an itemized receipt at the time or an insurance appraisal.’

MOSTLY FALSE - The package price isn’t something that was discussed between myself and Hamid.  It came as the result of how he decided to write the invoice, which in itself was strange.  When we first sat down, he pushed a blank invoice to me and asked me if I could begin writing the details.  I thought it odd but proceeded to write my name, address, etc. and the detailed specifics that I would expect on an invoice (item #, description, price) while he tended to other paperwork.  When he saw all of the detail, he said that his brother would be upset if he knew how much he discounted so he needed to write the invoice differently.  After much thought and talk from Hamid about how certain percentages go here and there, he began writing another invoice which resulted in the blended price.  As he was completing the invoice, I went to get my credit card.  At that time, he called to me and asked if I could pay half by credit card and half by check.  He said it would really help him out because they get charged a fee from the credit card company and he was already giving me such a great deal.  Remembering the pricing on the sales tags, it did appear that I was getting a great deal and so I foolishly obliged.  At the end, Hamid said they would need to order the rug pads and that he would deliver them when they arrived as well as provide documentationof the value of each rug for insurance or resale purposes.  There was no comment that the sale is final or that there are no returns, however he did say that I could exchange one or both rugs if they didn’t work out.

‘[redacted] did come back to the store a week later and tell Hamid that she may want to exchange one of the rugs, because one of the items was not working out.’

FALSE AND TRUE – I returned to the store on March 14th, two days following the purchase, to say that rug #[redacted] was a mistake and was not working out.

‘Hamid informed her again that our store policy was that all sales are final as stated on our receipt, but he did want to make her happy and he did offer to exchange the rug.’

FALSE AND TRUE– I was not aware of or informed that they will not accept returns until April 12th, the day I attempted to return the rugs, and a month after I had been repeatedly coming back to the store to look for a suitable exchange.

‘[redacted] then came back to the store demanding her money back, she said she had taken one of the rugs to get appraised by Andonian Rug Sales and Service.’

FALSE –Jafar was made aware of the appraisal on April 25th, via an email to him from my husband, with a copy of the appraisal attached, stating that the rug was appraised at $900 and that the appraisal findings showed the rug to be used and defective with color run and many areas of what looks to be small burns in the wool pile.  He also noted that we were sold damaged and defective goods and its quality and value was misrepresented by both Jafar and Hamid.  Lastly, he requested that we return the items for a full refund.  There were several follow-up emails from my husband to extend further opportunities to resolve the issue, however all of those requests were ignored.

‘The appraisal has absolutely no details or accurate analysis.’

‘It does not fairly or honestly reflect the value, construction or nature of the rug, the only thing [redacted] received from this appraisal is a healthy dose of fear, uncertainty and doubt and an un-necessary $150 expense.’

TRUE –Regarding details, I agree that the appraisal needed some additional identifying information and asked the appraiser if he could amend the appraisal to include that, which he did (please see attached).
FALSE –Regarding accurate analysis and reflection of the value or construction of the rug - wesought out [redacted], an independent, reputable, respected rug dealer who is considered an expert on rug analysis, to get an unbiased, professional opinion on exactly that.  His findings are specific and clear.

‘Her statement also makes it sound like the rug pads have never arrived.  This is not true, we have them at our store, we have contacted her and they are available to be picked up at any time.’

TRUE – it was not my intention for it to appear that the rug pads have never arrived and I can see how it can be interpreted in that way.  To clarify, I am aware that the rug pads have arrived but I have not taken possession of them.

‘At the end of the day, we have never not stood by our word.’

FALSE – Selling defective, used, damaged rugs is not consistent with your word that these are new, high quality rugs, which is what I was led to believe.  I was deceived.

‘[redacted] is currently using the rugs in her home and walking on them every day, and these will need to be cleaned and cannot be sold as new.’

FALSE – these rugs have been rolled up and stored since April 12th, the day I tried to return them to you.

NOTE:  As a result of the many unanswered attemptswith Jafar to resolve this issue and the comments via Revdex.com, we have begun legal proceedings.

Sincerely,[redacted] And [redacted]
