On 5/15/at 2:p.m [redacted] from Cine' Fine Jewelry called me at my home She told me she had read my complaintShe told me that when she sold(by layaway) my earrings that she had not looked at the tag on them the morning of the 29thShe said the lady that bought them put a 20% down payment on themI told her that since the contract was up on the 28th that she shouldn't have sold themShe said in the future just so I knew that that could happen since she had not pulled them yetI told her that this had "left a bad taste in my mouth and that I would never put anything on consignment againShe said that she was off until Tuesday and that she would call the lady that she sold them to and she if she would change her mindShe said she would call on Tuesday and let me know what she saidI forgot to ask her why she put the sale(layaway) date down as the 28th when she clearly stated it was the 29th she sold themWhen we hung up I was under the impression I might get them back and I might not

I am rejecting this response because:Cine’s Fine Jewelry Contract Term # states that a check for SOLD items will be processes within days of saleSale items will be listed by contract number.9/23/ At our initial meeting I had gold scrap rings that *** asked to purchase directly from meShe stated she would pay me $for BOTH rings & I would receive the total $I asked when I would receive that money*** stated Term #of her contract of the days after sale & said “the end of October 31st would be that payoutThe $would be included with the monies of any contracted items that had sold*** then listed this in the contract:Contract # Dated 9/23/Item #25 Qty2 Description SCRAP RINGS PRICE $25On 10/31/the $sale on the SCRAP RINGS was DAYS PAST SALE DATE & I received NOTHING, no money & no accounting.This is a BREECH of CONTRACT TERM #on ***’s side11/31/after days into this contract I still have received NOTHING, no money, no accounting, & no contact from ***.12/1/I called *** to check on the sales of my property & inquire when I would get a checkI had to leave a message & never received a response back from ***.12/2/My husband & I went into the store to end a different contract with another owner in the storeThis contract ended with a dispute/disagreement with *** who ordered me to leave her store & NOT RETURNWe immediately went over to ***’s Jewelry counter where I have this contract & jewelry consignedI asked what items of mine had sold because I had never received any money for ANYTHING*** then stated “Nothing of yours has sold, sales have been slow but the Holidays were coming up & she expected to sell lots then.” I told *** I needed to end my contract with her since I was not welcome in the store anymore*** agreed to end my contract & scheduled an appointment for Sat 12/5/for the RETURN of all of my property since it HAD NOT SOLDMy husband was present for the entire conversationThere were no harsh words or any problems with *** was very apologetic about the problems I had with *** & she assured me they were separate people & she would never do that. We shook hands & left on good termsThis means that there were NO SALES FOR THE ENTIRE CONTRACT TERM & I still did not receive payment for scrap rings purchased 9/23/& *** still had all of my property.12/3/@ 4:00pm *** called my home to cancel the 12/5/appointment for the RETURN of my property*** stated “She thought about it & decided that she WAS NOT GOING TO RETURN my property & my contract would expire some time in Jan. She would be sending me a check at the end of Jan& if I didn’t like it I could take her to Small Claims Court.” I told her I would still be coming on Sat to pick up my things*** stated “If you come to my store you better bring the Sheriff.” I told *** “DO NOT SELL ANY OF MY PROPERTY.” My husband was present for this conversation also*** then slammed the phone down & has refused ALL communication with meI have never returned to the store.12/9/My husband did get an appointment to pick up my property from ***He did go & collect a FEW ITEMS of mine that *** was willing to return but ANYTHING of great value or gold was kept by *** stated “anything circled on the contract HAS BEEN SOLD & will be paid out at the end of January.” Item #on the contract is a GOLD NUGGET PENDANT & RING SETThis was CONSIGNED as a SET & was never to be broken up*** agreed & wrote it down as a SETOn the contract *** circled the Gold Nugget Ring & STATED YOU SOLD IT FOR $This is the second BREECH for this contract for by *** for not RETURNING THE RING & claiming it was sold*** also circled everything she kept & claimed it was SOLDWhen did it sell? With ***’s own admission & above time table clearly shows that NOTHING SOLD I have never been given an ACCOUNTING FOR ANYTHINGI have not received a DIME from *** & she has cut off ALL COMMUNICATION. 1/23/It has been MONTHS that *** has had my propertyI have received NOTHINGThere has never been an accounting, there has never been any money received by me for any sale, & there is no contact from herI have no idea what the RESTOCKING FEE is as there is NOTHING in the contract about it*** isn’t restocking anything because she KEPT my property*** now states she “found” my beaded purse & I can come pick it up at her storeI will not step in that store againI will be contacting the Media about this case so the public will be aware of the scam *** is conducting at this business & stealing property. I will be filing Small Claims Court & *** Warner can RETURN ANY PROPERTY or PAY THE RETAIL PRICE TO ME FOR MY PROPERTY IN COURTI WILL NOT ACCEPT ANYTHING LESS

I am rejecting this response because:*** has NOT returned my propertyShe has refused to give me an accounting or pay me for any property soldI requested the return of my property on Dec1, *** set an appointment then called an cancelled saying she was not willing to return anything & I will have to bring the Sheriff & take her to small claims courtI want the RETURN of a gold nugget ring that belongs to a set, & the return of the silver & black purseI also want an accounting with dates & prices of items sold with payment in full for the items*** has NOT given me ANYTHING No money no accounting & she refuses to return my property that she has has since 9/23/Her business phone is now disconnected & she is REFUSING to contact me

The most recent communication from *** *** does not make sense to meI have mailed *** ***'s final check less the 5% restocking fee because she breached her contract and picked up her items earlyI have left messages for *** *** to pick up her beaded purse at the storeShe can pick up the purse at any timeI am finished with this matter and do not feel any further communication is needed at this time. Hi [redacted]To follow please find my response to the complaint:On September 23, 2015 [redacted] consigned 26 jewelry items with Cine' Fine Jewelry. [redacted] signed a consignment agreement to consign her jewelry thru5/23/2016. [redacted] also signed an agreement that if she removed...

her items before 5/23/2016 there would be a 5% restocking charge. On 12/2/2015, [redacted] came over to my jewelry store counter and started complaining about the other store I share space with, [redacted] and the owner [redacted].  I calmed her down, and she proceeded to demand that I give her all of her jewelry and she ranted she would not pay a 5% restock fee!!!! [redacted] said she had had a bad experience with [redacted] and wanted to remove her things. I had never had any problems with [redacted] up to this point. I also was in the store all afternoon when [redacted] was removing her items with [redacted]. I did not see any problems or unhappy behavior from [redacted] when she was dealing with [redacted], the owner of [redacted].[redacted] told me she wanted her 26 items now, I told her it would be next Tuesday, because I did not have any help. [redacted] said no it would have to be on Saturday. I told her I would try, but Saturday's were busy sales days.We set a time on Saturday, 12/5/15 at 4pm.  I called [redacted] on Friday, 12/4/15 to reschedule the appointment to the following Tuesday. [redacted] was rude and belligerent and said no that was not acceptable. I apologized and explained I did not have the help to pull her 26 items. [redacted] screamed at me that she would be at the store on Saturday or she would be bringing the Sheriff. I told her do what she needed to do and her items would be ready Tuesday. I NEVER said I was not going to return her items. [redacted]'s husband has picked up her items weeks ago. Cine' Fine Jewelry sold a few of her items and will mail a check per her signed contract less a 5% Restocking fee.I have spoken to all associates at [redacted] and all concerned said [redacted] was happy when she picked up items from them.
