I am rejecting this response because:
We do have a signed proposal from CNS Builders that states a total to build our home at *** *** *** *** ** *** for a total of $270k. 20K was given to CNS Builders to start construction of our home at the signing of the contract as the contract states. It was discussed that this 20k would be used for permits, well & septic, surveys etc.. The 20k is not listed anywhere on his contract nor was it discussed as a "deposit". If anyone is in BREACH of this contract it would be CNS Builders. CNS Builders did not draw our house plans. We paid an architect to draw our house plans for us prior to contracting with CNS Builders. The only permit that was pulled for our construction was for our septic which was installed on February 2, 2017. I would also like to mention at this point that the Septic company he used out of Greensboro, NC to install our septic tank has still not been paid for their services either. Per this company they have informed me that CNS Builders will not respond to any phone calls and email and billings that they are sending to him for this work. CNS Builders states in his response to my original complaint, and I quote him, "Revdex.com knows the ins and outs businesses, no one provides the cost invoices to the clients, businesses generate their own invoices to collect monies from clients". This is an absurd statement. Every business, especially contractors, provide quotes and invoices. This is another area CNS Builders would be in "BREACH" of his proposal/contract with us. His contract states invoices of work performed @ every two weeks will be provided. If he has been "working" on our construction since November 2016, which is when we gave him 20k, why have we not received any invoices at all? We have requested and demanded invoices which he stated to us prior to my complaint that he had and would provide. We still have nothing. This would be because he has spent the 20k we gave him but unfortunately none of our money that was given to him for the construction of our home was spent on our home. Why would I give him more money to build our home when he was not trustworthy with the 20k we have already given him. We have worked and continue to work entirely too hard for our money every day to give it away. Again, we are requesting invoices for the money he has spent on our home and a refund of the money he cannot legitimately account for. The only think I believe he has paid for with the 20k we gave him is $for a permit for out septic tank. In closing, I am not sure why CNS Builders feels we are in breach of contract with him. He is the one that did not use our funds properly. In addition, I would like him to know by law you cannot profit from a breach you can only be compensated for your actual damages. What are CNS Builders damages? NOT 20K

construction from conventional wood structure to ICF (Insulating Concrete Forms) at no additional cost. Plans were modified accordingly. The homeowners were suppose to acquire funding for their house within couple of weeks after signing the contract and the construction of their home should start. Unfortunately they were unable to secure the funding and now wanted to breach their contract and wanted their deposit back. There is no mention of refunding the deposit. I have been in contact with them since September, 2016 and got the [redacted] plans ready with local [redacted] manufacturing company. I met with the salesperson from General Shale Brick company and got samples for their home. Met with sub-contractors discussed their plans and got estimates. Visited job sites several time, met with homeowners several time. Acquired permits for the Well and Septic System. Redrew the site plans for well and septic system so that they do not have to invest extra to install cost prohibitive Septic system. They are in breach of contract, I am still willing to start the project and build their house for them. Revdex.com knows the ins and outs businesses, no one provides the cost invoices to the clients, businesses generate their own invoices to collect monies from the clients. I am in business since 1977 and never had any such issue. They have to fulfil their agreement acquire funding for their project so we can start construction of their house.
