This is in reply to your letter dated March 6, with reference to the above mentioned complaint[redacted] did purchase the property from CNY Home Rentals,LLC (CNY) in May of CNY acquired the property in the summer of from a Tax Foreclosure Auction, had no specific knowledge of the property's history and completed all questions on the attached disclosure to the best of our knowledge.Attached, please find signed and accepted copies of the Purchase Contract and Property Disclosure along with a signed (declined) Home Warranty WaiverPlease note page section of the property disclosure which states a portion or all of the property may be in flood zone X.Also note the attached Fema Flood Zone Page which states the property is in moderate flood hazard area in addition to the buyer declining the recommended Home Warranty.Section of the purchase contract states that a property is sold AS ISThat is why buyers obtain independent inspections prior to closing.No representations were ever made to the buyers by CNY in regards to possible prior floodingThe only direct contact with CNY related to specific customized items the buyers requested and issues identified by the buyer's independent structural/home inspection which was provided for in the attached purchase contractAll said items were completed and or corrected to the buyer's and inspector's satisfaction prior to closingCNY is unaware of any representations made to the buyers by the Realtor, since the Realtor was the Buyer's independent agent and not acting under CNY's direction or supervision.In summation, the buyer had the property inspected by their own inspector, in addition to completing two individual FHA appraisalsThe Buyer purchased the home knowing it was next to a stream and that all or a portion of the property was in a flood zoneIn addition, the buyer declined the recommended home warrantyUpon signing the Property Disclosure, Home Warranty Waiver and closing with that knowledge, they assumed the risk of ownershipWith regard to any repair items they are referencing, we must defer to the fact that they had a professional inspection done and accepted the property in AS IS condition at the time of closingWhile it is unfortunate that the parts of the Village of Herkimer experienced flooding in July of 2017,CNY has no further obligation to the BuyerIt is CNY's opinion that this complaint is baseless, has no merit and we request that this complaint be removed from our file.Sincerely yours, Steven [redacted] Manager
