Customer's statements regarding deposit information contained in the application form are false. The application form reads as follows: "The deposit is refundable only in the event that the applicant is not approved by the landlord. If the applicant is not approved, the full deposit will be refunded...

to the applicant within three banking days from deposit."I have completed hundreds of rental transactions using this application form and this is the first customer who has claimed to be confused by it. I also have firsthand knowledge of other real estate companies throughout the Rochester area that use the same application form and these companies have completed thousands of rental transactions without incident.Customer's statement that she gave $450 is unknown at this time. Customer's first check for $450 bounced. Customer submitted a second check for $462, equal to the amount of the first check plus $12 bank fee. There was also a problem with the second check. Funds from the second check were not available at time of deposit. Deposit receipt ticket reads as follows: "Amount delayed $462. Checks with this deposit may not be paid because of information we've received from the paying bank or due to information we have within our own system. Further review may result in additional availability delay."Customer's statement that a large sum of money was accepted is false. Customer and customer's roommates submitted a deposit equal to one month's rent. This amount is standard local custom to our area. Moreover, this amount is low compared to other regions of New York State and other areas of the country where a one month deposit, first and last month's rent are required.Customer's statements that I refuse to accept phone calls and only correspond via email and takes her some time to answer are false. It was only after the customer and her roommates backed out, breaching the contract, that an email was sent to the customer's roommate, Christian Martinez, informing him that all further communications must be in writing. The emails that were received from customer's roommate, [redacted], that required a response were replied to within one day.Customer's statement that no customer service was provided is false. In the email I received from customer's roommate, [redacted], he apologized for any inconvenience they had caused me and thanked me for my prompt work.The customer made an offer to rent the property starting April 1st, 2016 and the offer was accepted by me. This resulted in a binding contract. A clear written approval statement was provided to the customer as follows: "Everything checked out good with your application forms. You have the apartment!" No rewording is necessary. The terms in the application form will be followed and no refund will be given to the customer.
