Coast Materials, Inc(CMI) signed an agreement to dig a acre pond on May 1, The shape of the pond was hand drawn and mutually agreed upon by both partiesBy the time CMI moved off the property in December the size of the pond had been expanded to over two acres as per complainant's
verbal requestThe edges of the pond were well sloped and safe when we moved out. One reason we stopped working in December was due to the toerrential rain in our areaThis act of nature caused the water table to rise almost three times as high as when we started working rendering it impossible to dig as the pond must be kept dry to remove sandAfter numerous attempts to reach the desired depth of this pond, which was constantly changed by complainant, CMI realized we would never satisfy himThe depth originally agreed upon had been surpassedThere was never a blueprint or design drafted or agreed upon in any contract other than the hand drawn map that no longer resembles what is currently at the property.Secondly, CMI began to be questioned by complainant about the amount of material being removed from his propertyCMI has documentation of every cubic yeard removed and documentation of every payment (cents per cy) made to ComplainantWe became leery of continuing business there as a simple operation of digging a pond became a constant struggle due to continual changes, complaints, and mistrustCMI did meet with complainant in January and verbally agreed to try and continue digging his pond as soon as weather permittedHowever the excessive rain prevented us from working on the pondThe harassment by complainant towards one of our supervisors led CMI to the decision to no longer do business with the complainant.Coast Materials, Inchas no control over the personal lives or personal actions of our operators when they are not on the jobIt is true that several different operators worked on Mr***'s propertyHowever Coast Materials has strict guidelines to make sure operators work safely and understand the operation of their assigned machines before beginning workIt is true that one operator was arrested while working on the property however his arrest had nothing to do with that jobsite and Coast Materials could have done nothing to prevent this from happening.CMI built a limestone base driveway on the property to make a temporary road for our trucks to travel onThis road cost in excess of $We decided to give complainant this material as he expressed a desire to keep it. As recently as last Monday we sent a representative of our company to meet with complainant to try to resolve the matterAfter being threatened with a lawsuit we feel it in our best interest to stay away from the job. Please see attached a statment from *** *** our Operations Supervisor The next part of this statment will be from me personally (*** ***, Operations Supervisor) I was the primary supervisor involved in the digging of Mr***'s pondMy experience in this type of work is more than fifteen years and entails the digging of countless ponds, five of which I have personally dug, operating an excavator for Coast Materials, IncIn my professional opinion, Mr***'s pond looks wonderfulThe depth is at a level that should constantly retain waterThe repose of the edges are uniform, safe, and designed to remain intact as well as possible during heavy rains or windostormsI went to great lengths to please Mr*** in every aspect of his "vision" to no availThe constant "nit-picking" and changes made to the design, depth, and requests of extra work wanted done on the property caused a tremendous amount of extra, non-profitable work for Coast MaterialsMr*** constantly harassed me on my personal telephone by text message and telephone calls, asking when we would be back, even after he met with Coast Materials and spoke with the owner, understanding that weather was the determining factor in continuing workIn my opinion nothing on this property looks "unfinished"In December when we moved our equipment out of the property, I took a front-loader back to Mr***'s property and personally levelled all remaining piles of material, and graded out all remaining areas that needed attentionMrBeckwish was happy with the work I did with that front-loader and agreed that the property was safe, and looked goodFurthermore, Mr*** has now stocked his pond with fish rendering it impossible to drain the pond and continue any excavation of materialIn my opinion continuing work on this property or with Mr*** would be pointless and non-profitable for Coast Materials as Mr*** does not have a stopping point for work he would like doneAnd will never be happy with the work done there
