week regarding complaint ID ***As I detailed to you in our call, I inadvertently wrote a check from a bank account that was closed by my wife recently as she is the one in charge of the finances and accounting of Cocoa BarUnfortunately, as you may remember, we had a serious and ongoing family emergency for which my wife has had to be out of the country for several months and thus has relinquished her duties to me during this timeThis was a miscommu***ation on our part that has since then been sorted out
I will reiterate that *** ***, the filer of the complaint, managed to consume the entirety of the "Busy Bee" dessert, despite deeming it "inedible" in his complaintRather than being 'inedible,' it seems the dessert was simply not to *** ***'s taste, even though the description is listed clearly next to the cakeThis description has been posted next to the "Busy Bee" cake for over ten years and has not received a single complaint.
Though not a standard business practice for any restaurant or cafe, we decided to honor his request for a refund anyway in the spirit of keeping our customers happyUnfortunately, the mishap with the bank accounts occurred for the aforementioned reasons having to do with our family emergency
Additionally, our website has been under construction for some months, also interrupted by our family emergency and thus all the correspondence received through the website had inadvertently been filtered into a junk/trash mailbox in our email accountFor this, we again apologizeHowever, we would like to note that our phone numbers for both the Manhattan and Brooklyn locations are readily available online, but no calls have been received from *** ***, to-date
Finally, as *** *** notes himself, on his *** *** of Cocoa Bar (attached), his second complaint was not necessaryHe alludes my having lower ethical standards because he assumes I am a "foreigner," as he saysThough not from New York, he continues on in this public forum to insult me and my business
In conclusion, I originally intended to issue a new check from the correct bank account; however, it has become clear that *** ***'s complaint is not a business matter but rather a personal matterAccordingly, I feel it best to disengage with this individual completelyPlease feel free to contact me if you should have any questions or require any additional information

This issue has evolved to become a personal attack on the [redacted] of Cocoa Bar, [redacted], who, at this point, has already made several attempts to resolve the alleged complaint. On the other hand, it seems the accusing party, who has visited Cocoa Bar once while vacationing in New York City, remains disgruntled many months after consuming the entirety of one of our most popular dessert cakes.
 
As you are already familiar with the details of this dispute over $7.10 that has now become a personal and public attack on the internet, I believe the best way forward is to refund this individual's money (as previously attempted several times), contingent upon his public and private issuing of a formal apology to the [redacted], [redacted].

Review: Back on October **, 2013, I purchased a chocolate dessert called Busy Bee. However, it didn't taste like chocolate at all. The baker had smeared marzipan all around the interior of the dark chocolate coating, thus voiding the chocolate flavor. It all tasted like almond paste and nothing else. The confection was more or less inedible. I've complained to the business several times since then, via their online contact form, via direct email, and leaving a comment on their website. The business owner has never responded.Desired Settlement: A refund of the $6.52 I paid for the Busy Bee, plus the appropriate amount of sales tax.

Review: This is my 2nd complaint against Cocoa Bar. My first complaint, from last month, you will find pasted in below. I had thought the matter resolved when Cocoa Bar's [redacted] mailed a check to me for the amount of $7.10 as a refund for the "chocolate" dessert I purchased in October 2013 that turned out to be all marzipan with no chocolate flavor at all. I sent the [redacted]s check to my bank for deposit, and today the back returned Cocoa Bar's check to me. The check was apparently written on a bad or closed account. I photographed the returned check, along with the reason for its return, and can provide these photos as proof of Cocoa Bar's failure to provide a refund.
