Since we prepared and mail emergency docs for him, hour cancellation policy is irrelevant hereHe ordered services and received them and paid for themhour Cancellation policy refers to situations where no part of the services were completedClient requested that we commence services
immediately, due to the nature of services offered, as per agreementdespite of the above, client was also offered, as a courtesy, to keep and use the very important and valuable legal documents that were prepared for him per his request free of charge and have a credit with our firm for the $1,fee we keep for years to be used by him and/or his friends or relativesClients also refused this courtesy offer of free services and a creditWe are in the process of filing a lawsuit against MrBasic for the breach of contractIntentional falsification of facts and efforts to publicly damage our reputation and will be seeking compensation for damages and legal fees involved, as per the written agreement, unless all the claims are removed permanently and immediately

 1. Your argument that my English is proficient based on that I have a job makes no sense. You don't know what I'm doing for living nor the English skills required for my job. 2. Your argument that during the phone calls you notify the customer of the recording - is not an argument. Can we simply agree on that you didn't provide me consultation via the phone? So how is it again related to the case?3. Your argument of the form that clients sign at the office is also not an argument. Again the form and the retainer is not in [redacted] except the last page which does not state anything about the recording or cancellation policy.4. Now in terms of Mr. M[redacted] personally telling me during the consultation that everything will be recorded is not true. Once again I'm asking you to upload the audio file which would include Mr. M[redacted] warning me in [redacted] that everything will be recorded and his statement that I will be charged of the cancellation fee with no exceptions. I also wonder if you have a recording in your office between me and you associate in regards to the cancellation fee, since she as well as you promised me no cancellation fee within 24 hrs.5. Your statement about the fees is also not true. Be my guest and check you competitors. Take for instance [redacted], who charges twice less. 6. Now in terms that a customer must pay for the service provided. I want to point out one more time that to pay for the blank files what you are asking for is an overcharge. All the files you sent me could be found on Google for FREE. I gave you the links earlier on.I am asking Mr. M[redacted] to make me a counter proposal as a means to negotiate and find a compromise for both us.

Argument about not understanding.... :Consultation was given in his native [redacted]. The terms and conditions (stated in our retainer agreement) of us agreeing to accept him as a client were explained to him in [redacted]. So he knew and understood all. About the English part - we are sure that if Client has a job he communicates with everyone at work in English. But again, it's irrelevant, he received all info in English and in [redacted].Argument about consent to recording and related ethical matters...:1. Every call that comes to our firm, even before the caller is able to speak with anyone, the caller is told via a pre-recorded notice that "your call and all subsequent communications with our staff will be monitored and recorded... " This is done for quality assurance and other purposes. For example, since people sometimes forget what they were told, those who retain our services and move forward with planning, they sometimes ask us to listen again to the consultation so refresh their recollection about recommendations they received. We make recordings available to them and their relatives for these purposes. Naturally, this practice also assists in situations like this where a person claims they were not told something, were not told in English, [redacted], etc. 2. The form Client signed when came in to our offices in person states the same notice about the recording.3. Mr. M[redacted] also personally, in [redacted], told him that consultation is being recorded. There is a recording of this statement also. Client always hs an opportunity to leave, not sign the form, request for the recording not to take place, and, finally, not to come to our office in the first place after hearing a notice about the recording during the very first call he placed to our office.Fees .....The fees charged were customary and proper and consistent with those charged in the industry for the same type of work and charged by us during the past decade.  Attorneys with our credentials charge much more.There was nothing illegal, unethical or unprofessional done on our end.A person must pay for the services requested and received, damages they caused, expenses he caused us to incur. This is also stated in the agreement and was explained as well.
