(The following was provided as an e-mail comment to Revdex.com staff - ***. The consumer also provided a copy of the third-party 30 year basement waterproofing warranty and the Home Construction and Purchase Agreement with the company. It included a warranty addendum: "Builder to extend warranty after HBA warranty expires for items not covered under a manufacturer's warranty for an additional 10 years".)***None of the issue I listed originally have been resolved yet. Frank is in hurry to close the complain but he still have not talked to me or visited the property to conform the validity of the issues.1. The basement water issue still persists. They patched the originally wall that was opened from last year, however while they were working in the basement we found another issue with water. Frank's guys told me that they will revisit this matter however I did not hear from them yet. The basement smell like mold and it is causing heath concern for my family. It is unfortunate that because of these issues I can't use my house even after six years and even after I spend several hundred thousand dollars trusting Frank that he will do a quality work for me in building this new house for us.2. The concreate leveling guy came but I was not at home. No one has provided me any updates or resolution on that. The front walk way is molded and look horrible. Previously Frank's guys has blamed the landscaping but the landscaping grading was also done by Frank therefore if it is not concrete leveling issue but the landscaping grading issue then they are still responsible for it. not3. There are no gutter's installed on couple of peaks above bay windows so rain water is falling over the windows and causing mold all in front the house. This is also a cause for the water in the basement on one side of the basement. Frank's office told me that they are calling the gutter guy to find out how to resolve this issue. However, I have not received any updates or solution to this problem yet. It is ridiculous that all front of the house has mold visible from the street. It is my brand new house and it looks horrible.4. The flies coming in from second floor light fixture during all summer months. Frank has provided no solution to this issue yet.5. From the time of closing, we have issues with the tiles in Kitchen and in Bathroom. Frank's agreed several times that he will send his guys to resolve tiles related issues. He even said that in one of his reply to you. However no one showed up yet to assess the tiles issues in my house yet. The tiles are uneven, Cracked and loose. The grout are not filled evenly.These are some of the issues related to construction warranty that I listed originally in my complain. As per my agreement I have 10 years of construction warranty. All these issues are construction related and on the list from the time of closing.Please note that there are several other issues in the house which I realized are the maintenance related issues or not in warranty anymore. I do hire individuals to fix those issues at my cost. In many cases I have used Frank's guys and paid them myself to resolve these issues.The issues listed above are construction related issues and on the list from the beginning.

*** To: Mr. ***, We are in the process of scheduling 2 of our employees to go to Mr. house the week of October 22, 2018. Mr. is correct in the fact that he has been waiting for us to do the work in his basement that was damaged by a water issue that we corrected on October 2, 2017. A copy of our email to Mr. explaining our findings is attached. At that time we had the owner of our rough carpentry company, who has more than 40 years experience and Tim, who has been our employee for over 35 years, dig up the foundation. They re-water proofed the area in question, and backfilled it with stone. The wet drywall in the basement has been removed and left off. Also, on April 17, 2018 an inspection was performed by an '***, Victor F, CMI, CMR, CHI to inspect the area and test for mold. A copy of his findings are attached. Although it seems like a long time has passed, we did want to make sure that the area was fixed and that the water proofing worked. The interior will be re-inspected, cleaned and the drywall will be replaced. I have addressed many of Mr. issues over the years. In my professional opinion I don't think there is anything wrong with his kitchen tile, but I will replace up to 5 tiles only. Also the bugs that are entering is a mystery to me. The fan exhaust box where Mr. thinks the bugs are entering is located under the overhang and is a city requirement. I will try to get our siding company to come up with a solution. Regarding his comment stating we use the 'cheapest subcontractors'. Colabianci Construction Inc. has been in business since March 1988. We have built homes that range from $200,000.00 to $3,000,000.00, we have done numerous multi-million dollar commercial project all using the same sub-contractors that were used at Mr. house. So the that is an unfair statement . Also, the lack of complaints made against us at the Revdex.com should also prove the quality of work we have performed. Please review the attachments. Date: January 24, 2019RE: ID# ***Mr. ***, Mr. is correct, we extended the one year *** Homeowner's Construction Standards Guide & Limited Warranty'. A copy of the warranty is attached for you to review. It is an extended warranty, not a homeowner's maintenance program. I have also enclosed an invoice for the toilet tank and worn wax ring replacement that was done on October 2, 2018, and the worn wax ring replacement that was done on November 20, 2018. Both incidences required ceiling touch ups. Mr. called the office in both cases and I pulled 2 of my workers from another job and sent them right away. Donna also went to *** to pick up a new toilet tank. I treated it as an emergency situation, there was no time to submit a proposal for approval. As of January 24, 2019 this invoice has not been paid.1. The basement issue has been resolved, we will continue to monitor it. 2. The concrete company that did Mr. house has retired. I sent my new concrete company and he determined that the concrete is within industry standards. He used his level and determined that there is not unusual settlement. Again the concrete is dirty because of the black mulch that is piled up too high above the side walk. When it rains the mulch runs on to the walkway. Also, I'm not sure if the walk way has been power washed and re-sealed since the last time I did it when they moved in. Again, this is a homeowner maintenance and should be done every few years. I can send someone to power wash and seal it, weather permitting. I will submit a proposal for Mr. approval to perform this work.3. Gutter's are not part of the design of this home, I can provide a copy of the approved plan. I am willing to send to Mr., at no cost to him, one of my guys to remove some of the black mulch that is piled up under these bay windows, weather permitting. Again this problem stems from mulch being added to and never removed. The mulch is piled up to the wood on the bay windows. This will cause the wood to rot, splash and run all over. When it rains the water hits the black mulch and it then splashes up onto the bottom of the bay windows. Again this is an issue that is caused by the black mulch that is piled up so high. Our landscaper mulched at time of closing and Mr. landscaper has been adding to it over the years. Again this is homeowner maintenance. 4. This is not a warranty issue. I'm sure a professional Pest Control Company can remedy this situation.Again this is homeowner maintenance. 5. Joel H, the tile installer, was our tile installer at this time. He grew up installing tile with his father. He also made a living installing tile. I know Mr. questions his ability. I can provide a list of our customers that are happy with his work. The C Construction Corporation (also know as C Builders) built our house in 2012. During the construction period Frank C (Owner) was the point of contact for us. During the closing of the house, a list of issues was created which he supposed to repair within 30 days. But Frank did not return a single phone call or email since we close the house and took the possession of the house. As per agreement we have 10 years of warranty on any construction issue however Frank has not repaired any issues reported form the first day. We are facing water issues in the basement from the first year of constriction. he provided 30 yrs. of water prof warranty on basement. But from the beginning, the basement is smelling and has mold which is a health concern. Frank team has opened up the dry wall two years ago to investigate the matter. However the dry wall is still open, smell is still there and we could not use our basement space at all since then. Every time we called Frank's office they say they are too busy and some day they will take care of it. My last call to their office was yesterday where Donna told me again that they are too busy and Frank does not response to her on my issues. We have several other issues like Tiles in Kitchen and Bathrooms were loose and move when we walk on them. The issues is reported on the first day of move and 6 years later Frank still have done nothing about it. Also the Bugs enters in the house from all light fixtures on second floor. They haven't closed the opening around light fixture properly that allows bugs to come in. But even after six years of complains, we got no response on our issues and Frank too busy to even call and discuss. The couple of guys from Frank's team visited on a few occasion but they made comments that we are just complainers, they have issues in their house, and you normally live it. These comments are very upsetting and annoying as we built this expensive house for our comforts but not to cause more headache for us and why should we live with their issues even we paid in full and they took all our money and but took no responsibility for their workmanship. He has used the cheapest subcontractors possible in town who never come back and fix their issues. He has provided the warranty on may stuff but none of these company came back and took care of stuff under warranty. If you require, I can provide a list of all issues and complete log of calls to Frank and His office.
I request Revdex.com to get involve at this time and please help us in resolving these matters. No construction company should take advantage of his helpless clients. This builder even took no responsibility to call once to discuss matter with his client who spent more then half a million with him. We have called him more then 100 times directly and almost daily his office.
