We received [redacted] letter in June but at that point her account was past dueWe can't cancel an account if it is not currentAccording to our cancellation policy that [redacted] agreed to, a member can cancel their membership without having to give us days notice, as long as they " cannot physically receive the services because of significant physical disability for a period in excess of six months", and send us the proper documentation through certified letterUnfortunately we can not fully process her cancellation until she pays the balance on her accountOnce the current balance is paid the account will be cancelled

[redacted] is claiming that she thought she was under a guest passShe signed up for a membership on July [redacted] and was asked for her CC Info and to pay the first months payment of $Her membership agreement was then emailed to herI believe that its hard to mistake this with a guest pass? Our membership agreements call for a month contract with a month to month automatic renewal after thatAll cancellations must be done through certified mail which is clear in the membership agreement [redacted] called the club asking about cancelling her acct her account on which is strange since she claimed that she was on a guest passAt that time we told her she was still in her contractThe only way this can be removed from her credit is if she pays the balanceThanks, Retro Fitness

We are fortunate at Retro Fitness to record all communications both in the customer files held on our database and via recording of telephone callsI already spoke with *** regarding this matter later in the day of the first telephone call made by herselfThere is absolutely no records of any
communication regarding a pregnancy at the beginning of her membership and it comes as both a shock and surprise to hear of this the first timeWe have many clients who freeze their membership during the gestitation period free of charge, so to hear the comments that are being alleged regarding a conversation, that are not on record, is surprising to say the leastWe are always more than accommodating regarding freezing membershipHowever more to the point of the complaint, after listening to the conversation and the subsequent conversation that was had with ***(also on record) that while Rachel's customer service skills may not of been the best on the day, she was more than curteous at the beginning informing *** that there was no manager on duty till after 4pm and as a low level worker there was nothing she could do to assist herThis did not appease *** and her tone and demeanor became increasingly hostile and aggresive to the point that it became a futile effort in trying to continue to explain to her why her day notice had not been processedSo while *** believed she was correct the fact remained that because she had stopped the credit card on file subsequently allowing her account to be in arrears, and therefore any cancellation request to be null and voidShe was sent an email on the same day her day notice had been received(also on record) explaining all of thisSo while I accept that the conversation wasn't the best example of good customer service most of the blame for the situation would have to fall on the failure to meet the obligations of the member, something that was acknowledged and subsequently corrected by the collection of the arrears and the required payment for the day cancellation monies

There were several correspondences back and forth with Retro Fitness, both over the phone and via emailThe owners tried to
strong arm me into paying a settlement cancellation fee, which I refused because there is no signed agreementWhen they realized they have no way to prove their fraudulent claim and that I was not going to relent, they emailed me saying they would refund me the full amount in three installmentsThey refunded me the first installmentHowever, I had already disputed the full amount with *** ***, so they reversed the credited amount*** advised me not to drop the dispute because if I do, they cannot help me should Retro Fitness decide not to refund me the next two installmentsSo, as of now they have not refunded me the money and my disputes are pending.

I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
I completely understand and have knowledge of the policy of the membership agreementHowever, no individual can be expected to carry the policy on them at all times and know it verbatimWhen I first placed the call early in (February/March) I was not informed by their staff of this informationIt would have been helpful to have heard "Based on the membership agreement, we do not have the ability to stop auto-renewal and in order to cancel your membership you must....."It is clearly a lack of possibly new employees or those not well trained that there is no mention of this phone call in my records at the facilityDuring that initial phone call I was transferred and put on hold several times while the employee "researched" my issue and finally informed me that they will put a "do not renew" note on my account. I am not disputing the legal aspects of the membershipI am however deeply disappointed in the way employees are trained and how they keep records and notesIf I was reminded about my obligations as a member I would have followed all stipulations and instructions in the contract on how to cancel the membership when the time for renewal had arrivedHowever, due to the fact that someone with no knowledge of said contract and policies provided me with the wrong information I am now forced to pay fees that I dont believe I should be paying. Also, upon being told in October that a manager would return my phone call with information regarding my issue, I had to call a week later and was informed that a manager reviewed my issue and made notation but no one bothered to phone me and let me know what I should be doing to resolve this issueIf I had waited for the manager's call I would have had to pay another monthly fee just because the managers did not return my call with this information seeing as how cancelling is time sensitive.

The member was informed she is entering in to a month contract for training just like her gym membershipAdditionally when she signed the contract was shown to her and we informed her she would receive a copy to her emailThe $downpayment referred to was explained as the *** and *** month
of her contractAlla approached us with a desire for training and was never placed with an "intern"The client's account will not be closed and we will hold her to the obligation she knowingly entered herself into

There were no tricks in Alla signing her agreementShe inquired about personal training rates and after meeting with her for about an hour she decided personal training is something that would benefit herAs far as employees walking in to the office I will say she is correct about thatWe run a very successful training program out of our facility and currently employee ten trainersThere are times where they need to come into the office to grab there personal belongingsAs far as the darkness and cramped factor of my office I do not understand where that is coming fromWe have great lighting through my facility and my office has room for myself and three others at any given timeIt was just myself and Alla in the room at this time so I the room had plenty of spaceNow to address my "expert sales tacticsI am in no means a salesman and have never held a sales position in my lifeI am a fitness director and started off in this industry six years ago as a personal trainerI have help changed 1000's of lives and brought my passion of a healthy lifestyle to many people and that is something I am proud ofWhat Alla is failing to mention is that we would gladly waive the balance she owes and have her continue on achieving the goals she set out to accomplishEssentially we would just pick up where she left off and finish off the remainder of her contractWe offer that to all clients because at the end of the day we would much rather have them be a positive representation of what we offer at Retro Fitness than a negative representationWe only have collection policies in place as a last resort to protect our well being as a business. To sum things off our offer is as follows:The client can reinstate her membership and training and continue on the agreement she knowingly entered into. The client can pay off a direct settlement with the gym and not have her account sent to collections. The client can refuse to comply and we will send her account to a collections agency. I thoroughly hope the client chooses the first option

Because I was tricked into agreements I have never saw, and I was made believe that I could cancel at any timeThe actual contract went directly into my spam, and I only saw it when the collection agency reached out to me, and I searched my inbox for Retro Fitness agreementWhat happened? I came into the gym to just try it out and only intended to sign up for $a month to be able to exerciseIn the course of a few minutes, the person at the counter asked me to come see the manager of the Gym, *** ***As I mentioned before, his room was very small and very dark on purposeDuring our conversation, at least a few club workers interrupted by coming into the room - to grab their lunch, keys, phones, etcIt was a very chunky conversationJoseph spoke with me very casually, telling me all kinds of his personal life detailsHe also told me about all kinds of things that sounded as too good to be trueHe NEVER warned about the three days, days cancellation policy, days freeze policyHe did say that if I don't like the program, I can cancel (which was technically true, except he didn't tell me about the days cancellation rule) and NEVER handed to me the contractI did sign something, but when I found the agreement in the spam, months later, it had a few pages - I only saw and signed one pageI only signed one time, one page - however, I received two contracts and do not recognize the second signature, at allI had to take every single word he told me with a grain of salt, but I didn't because this guy, *** *** is a very skillful salesperson, who used very quickly a high pressure sales tactics to persuade me into the troublesome long-term contract that I can't EVER get out off - ONLY IF I AM DEADOn one hand, it looks like it was my fault, but on the other hand, there are so many illegal moments, including the fact that I only signed one page and he never let me read the contract, making me believe that I only agree to the price and can cancel at any timeThese managers are smooth operators. I only walked into the gym times, and ALREADY PAID $to the Retro Fitness ClubNow, they demand $more because they've added all kinds of fees that I was never aware ofIn the end of the day, they'd get $2500+$- $3200, yet, I can't cancel the agreement unless I am deadSo, I am writing complaints to the Attorney General, Consumer Affairs, and the entire social media everywhere I can will see my contracts - I'll make sure that anybody who will do a minimum research will never sign the contract with this club.

"AUTOMATIC RENEWAL PROGRAM (Monthly Dues Member): Provided that Member is not in default of this agreement and subject to the terms and conditions hereof, the membership will automatically renew for the rate indicated belowRenewal terms may be cancelled at any time provided a 60-day written notice
is delivered to the club's addressIt is also understood that the club will not increase the monthly rate above the specified amount below." The above is part of the signed agreement that all members are told verbally upon signing and electronically the moment they sign the agreementIt is clear and concise instructions for the procedures required to cancel the Auto-Renewal or an agreement in fullThere is also a very clear reason why we do not do anything over the telephone as we are proud of the notation system we have in place to ensure that adequate evidence is both provided and used correctly for the benefit of members and staff alike*** ***'s first noted contact with the club was in Oct, there were no notes to suggest she had contacted the facility previously and if she had she would of been instructed of the correct procedures at that timeWith this in mind we will not be refunding any monies based on her obligations to the club and the agreement she signed on joiningA copy of the signed agreement can be provided if required

If you read clearly what I wrote I never wrote that I thought I had a guest pass I said the only time I went to your gym was the first day of the guess pass. I've never set foot in your gym again. And when I signed anything it was to get 19.99 with drawn from my account monthly. I asked the person who I signed up with if I could cancel anytime and I was told yes. I have never used your services. When I realized I was never going to use your services I called so you guys can stop payment on my CC. And was told by the owner who is extremely rude that I signed up for a contract.  I never received any contract when I signed up except a bunch of calls and emails about getting together with one of their trainers for a free session . If

This is the firat I have heard from [redacted]. Our cancel policy is that if [redacted] has orders from the military to move away we are more than happy to cancel his contract. All members are notified upon joining verbally and electronically of their obligations and what is required when membership needs to be terminated. The terms and conditions state quite clearly that all requests to terminate must be sent in writing via certified mail. It is also explicitly...

explained how the contract enters a state of Automatic renewal, members sign to agree they have been thoroughly explained of this matter. There are absolutely NO methods to cancel the agreement in person or on the phone. Additionally the first note in the members account is dated in October when the mother called the gym, subsequently calling everyone is and demanding owed monies returned. There will be absolutely no money returned.
