To whom it may concern,We had an appointment to have the house appraised on the 10th of October and we were to close on October 20th . We left town for a week and when we returned home they and not done one thing toward getting the house finished. They wanted us to sign a form that gave them until the 7th of November to finish the house.We just moved here and were staying in corporate housing and told all involved that we were under a time frame to close on the home by the 25th of October. The company extended our stay until November 7th to accommodate the change.When the 7th came and went they wanted us to sign another paper giving them until November 21st. We no longer had a place to stay and rented an apartment. All apartment require a lease and we had to sign a 6 month leaseWe met with the Guild mortgage the first week of November to talk about the mortgage because the appraisal did not come in for the amount need to loan on the home, [redacted] at [redacted] pointed out that the appraiser had some construction concerns and the cracks in the stucco and the sheet rock were something we needed to be made aware of. [redacted] and I went to the home and really look at the construction of the house, we started opening windows and door and found that all of the windows and door on one side of the house would not open and close because of the stress weight on them. There was a crack in the sheet rock in the arch way in the master bedroom that was over 1 in. wide. Every window had cracks on the inside sheet rock and the outside cracks in the stucco. (this new home hasnt even had a snow load on it yet) One of the windows wouldnt latch it was so bowed. The sliding door in the master had to have a considerable amount of weight applied to it to even get it to match up with the frame. The guest room door would not even close, we told them about the issues and their fix was to run a screw through the door jam until it broke out the molding at the top and no longer made a nice corner. [redacted] (from [redacted]) called us and told us to go ahead and buy the house because there was a one year warrantee on the home, our thoughts were if they wont fix it before we give then the 300K why would we think they will fix it after we give them the money. And there is no fix for the foundation and baring walls, There are other issues that are not listed here yet, cracks in the concrete, the beautiful granite slab we paid for is not installed right when you bump it is vibrates, the tile we paid for as an up-grade is very uneven, you can see light around all the exterior door. Paint job is poor and has flashing spots of overspray from the casings, electrical outlets are not flat or square, the rain gutters drain the water under the house instead of away from it and will add to the already existing foundation and baring wall problems.Product_Or_Service: home on [redacted]Desired SettlementOur realtor ([redacted]) and [redacted] have threatened us to sign and take possession of the home with its faulty construction or they will not give us back the 10K dollars we put down and spent on the up-grades on the house. We do not want to take possession of a home with construction and load bearing wall issues because we will always have problems with it.We want our money back for the up-grades we paid for. And the deposit. Deposit was $2500.00Up-grades were $8000.00 and are as follows: All the appliances- Granite slab in kitchen and extra deep sink- Toilet in bathroom- Tile in bathrooms, closet and kitchen- Tape and texture garage.Business Response [redacted] had agreed to release funds to the [redacted] prior to this complaint. All funds that were deposited to the title company by the [redacted]' were release on December 15, 2014. Please update or remove this complaint from your website.
