merchant. We are very satisfied with the outcome once the merchant became aware of our concerns and the reality of the problems. They immediately offered to repair the home, or relocate us. I am rejecting this response because:The issue of the property description/photos was not resolved quickly nor do I believe that it was my responsibility to make sure it was done properly. My tenant called me concerned that [redacted]t Coldwell Banker had not returned her email and she was unsure of what to do next. I was having the same difficulties getting in touch with someone at that office so I told her to send the rent to me and I would handle the fee with Coldwell Banker. When I finally received a response, it was from a brand new assistant whose information was incorrect and had no knowledge of the situation. Via email, I informed [redacted] and [redacted] of my arrangement with the tenant and again, there was no response. As usual, I had to contact them today regarding the fee. I was threatened with legal action even before the promised amendment was sent to me. This is unnecessary and unprofessional. I am in no way trying to avoid paying the fee, however I believe it was not earned due to all the work I had to put into it almost daily. Not to mention that I was lied to on multiple occasions and my calls and emails were ignored. The last time I leased this property, I went through a local realtor and was very pleased with her. This time however, I thought that it may rent quicker if I used a larger office. How wrong I was. This was a nightmare.

CBDHR has researched your dispute and has found the charges to be valid.  We have before pictures (before the tenant moved into the property) and after the tenant moved out of the property.  We have pictures to validate every charge.  All charges were for damages to the property....

 The owner does not have an obligation to repair the property.  If you would like to see the pictures of before and after we are most willing to send them to you.  Please let me know.  [redacted]

We cannot charge the owner for something that is working properly and has been not been found to be malfunctioning.

Your response is not true. I was trying to be nice and ethical by keeping the agent even though she has no ability to find me a house and I found the house by myself through Zillow. I could terminated her immediately after I found my own house and there are plenty of agents in the town who advise to take half of the commission which is only 1.5%. That immediately would save me be over $6,000 commission from my purchasing price. I don’t care about the technicality that the seller paid you from paper. I hired you and I want you to do your job. I am the buyer and if I don’t buy no one gets paid. I paid you 3% so I can get good service which I am getting none.
To date, I have spent $15,000 in home repairs and there is another $10,000 damage need to be repaired. All these could be avoided if you all are an ethical and responsible firm do what you suppose to do according to the contract. When did you all try to address any of my concerns? I sent all the all above information to the D’Ann Harper managements along with all my supporting evidence Not only is the firm not apologetic for what they had done but instead they threatened me not telling anyone for what they have done or else. This is from a certified letter they sent to me from your [redacted] [redacted] date on November 5, 2012. You are doing the same thing here.

Sir,  I have reviewed your file and have found the following.  CBDHR has provided you with pictures and all invoices paid from your security deposit.  These charges are all tenant responsibility per your lease.  Move out instruction explaining what needed to be done was given to...

you multiple times...at move in, tenant handbook, and when notice to vacate was given.  All charges stand.

After researching your account I can positively say that CBDHR has pictures to substantiate every charge that went against your deposit.  All charges stand.
