Review: Coldwell Bankers, namely A[redacted] and S[redacted] of Coldwell Bankers, have failed to comply with contractual agreement. They have withheld money rightfully owed to us. They have deducted arbitrarily from our deposit. They have been untruthful to their word and to their own written agreements. They have purposefully employed delay tactics to avoid dealing with problems at present. They merely pass off requests and demands that we make based on contract for further review.Desired Settlement: We request that our full deposit to be returned.

Review: I have Power of Attorney for my parents. Coldwell Banker has managed my parents' rental property: [redacted]. My parents sold the property 6/26/13 over 2+ months, 11+ weeks ago. Despite numerous, repeated efforts, contacts, communications to Coldwell, my parents' account w/them has still not been settled and closed. Coldwell was supposed to shut down all utilities immediately after my parents sold the property. A water bill of $231.61 for dates 6/5/13-8/7/13 went way past the date my parents sold the property 6/26/13. I'm at a loss why Coldwell chose to pay the bill out of my parents' account when the majority of it was for after my parents sold the property. It's Coldwell's responsibility to obtain those funds from the new owner for expenses and mistakes Coldwell made. It is not acceptable for Coldwell to remove funds from my parents account to pay for bills that occurred after they sold the property on 6/26/13 nor to provide Coldwell an interest free loan. We gave Coldwell a deadline of 8/30/13 to complete all outstanding actions, return my parents' money and close their account. Coldwell failed to meet this deadline leaving us no other options but to take the appropriate follow up actions. Coldwell claims they're attempting to collect $148.38 from the new owner and plan to refund my parents after they receive it, however because this was Coldwell's mistake, Coldwell needs to return that money to my parents ASAP. My parents have waited over 2+ months 11+ weeks. Coldwell can wait for and keep the new owner's check when they receive it. Additional details: On 5/23/13, I gave Coldwell notice that we would be selling the property. On 6/1/13, I gave Coldwell notice that the estimated sell date of the property was 6/28/13 to continue basic maintenance. On 6/21/13, I gave Coldwell notice that the confirmed sell date was moved up to 6/26/13. On 6/26/13, our real estate agent informed Coldwell that the property was successfully sold and settled.Desired Settlement: Send $148.38 to my parents' account electronically ASAP: [redacted] & [redacted]. This is the portion of the bill that occurred after my parents sold the property 6/26/13.

The local property manager has been working to obtain the reimbursement from the new owner of the property and actually received the reimbursement of $148.38 this week. It will be sent out to the owners as requested on Friday, September 13, 2013.

Please note the account has been closed out here with the exception of this detail.

I primarily do not accept this response because:

As of 9/19/13, we still have not received the return of all funds due my parents from Coldwell. After ~3 months, 12 weeks from when my parents sold the property on 6/26/13, we're still waiting and this is an unacceptable timeframe to return my parents' money. Coldwell clearly made a mistake on the final water bill and unethically used my parents' money to cover their mistake. Instead of admitting and apologizing for their mistake and returning my parents' money immediately, they absolutely refused to return my parents' money immediately and instead continue to insist on waiting for the new owners to pay Coldwell first before Coldwell would return my parents' money. Wrong order. My parents are elderly and on a fixed income. Coldwell should have returned my parents' money months ago, and we're still waiting for Coldwell to do so.
