I am rejecting this response because:We never denied that rain was not a factor in the delay process.  We stated that there were over a month’s worth of days that the house was accessible that no one was out here doing work.  June 4, 2014...

was the start date for construction with December 4, 2014 being the 6 month deadline.  Whether or not construction started then, that is when funds were available. Regardless of rain, road, no work days, etc.; there was not adequate supervision of sub-contractors which resulted in poorly executed work.  Coleson Homes cannot expect to come out for 30 minutes to an hour or more a day, at times once a week, and for work to be performed properly by sub-contractor’s hands with no supervision.    We never questioned whether the concrete was cleaned properly before initial stain was applied. The implication made by Coleson Homes that we were the ones that walked on the floor after being instructed to not walk on them for 48 hours at which point they would be covered is completely outrageous.  Why on God’s green earth would we want to damage the staining process of our home? The stain was absolutely gorgeous when initially applied.  We are not complaining about how the concrete took/didn’t take the stain or the cracks in the concrete.  We are not happy with the fact that when the final steps were taken the floor was NOT cleaned properly.  The floor was not kept covered through construction therefore, it was filthy.  Lindsey was told by Zach Robason when discussing foot prints and hole in front entry way that there was no need to worry about either issue.  That the staining process was a multi-step process and that they would be back several times to sand down and reapply and sand down and reapply before the sealant and waxing were done.  On a separate occasion with Robbie, Zach Robason, and Lon Coleman the discussion of the foot prints was brought up again and again he was told the same as Lindsey. That it was a 6-step process and to not worry about the foot prints that they would be concealed before final sealant. In attached pictures you will find the final product where indeed there IS dirt, grass, and hair sealed into the floor along with paint from touch up work that was never cleaned off and we cannot remove either.  To address the initial tile work issues… we claimed there were no spacers used initially because they were not used.  Our initial complaint had nothing to do with the fact that the initial grout lines were too narrow, it was the fact that they were not even.  The tiles were not level with each other... to which the tiles were to blame instead of the installer putting grout only on the outer corners of the tile and not compensating for any imperfections the tiles might have had.  Although, when we laid several of the tileson the floor to see just how imperfect they were… they were completely level with each other.  Tile is not waterproof and neither is sealant, but we thought that it was common practice to apply sealant to tile that was in wet areas. As stated before, we have purchased and will apply.  There is not an email that re-tiling was satisfactory.  There is an email that states “Everything is good (we can handle making better)... except the floors.”  from February 5, 2015 simply because we were tired of the poor attempts by Coleson Homes/sub-contractors.  Attached you will find pictures of first attempt and final attempt at tile work. First attempt is where they applied tile paint to fix one of many problems.  Final attempt pictures include the excess grout left on tile and the spacers that were used still sticking out and visible.  Kitchen Countertops: We chose Formica because we WANTED Formica… still do.  As you will see in attached pictures, the initial attempt to install the countertops was NOT more than acceptable by any building standards.  There were stress lines in all corner pieces, if not completely cracked.  There was a block installed on top of bar to cover the fact that he had cut the piece too short and used block to “hide” the shortage.  There was not one seam that was flush.  There were puzzle pieces around edging.  The backsplash was not adhered well to wood before installation and therefore was bulging out off of the wood.  As stated by Coleson Homes, we had no other choice but to take the offer of the granite of their choosing or leave the Formica in place.  We did indeed opt for the granite at no additional charge.  We still are not clear why they are refusing to give us a typed up list of the abbreviations on the breaker box.  While on the topic of the breaker box, we have already had to replace a breaker.  It was faulty and kept tripping, because as you can see in the picture provided by Coleson Homes it appears by the condition of the labels, the breakers are not brand new.  We will contact the installer of the septic system for information on the septic system.  In response to Coleson Homes’ inspection of the home at the end of January, all the windows and doors may have been operating normally.  That does not mean that they are now.  The second bathroom door does not close without force and you will see in pictures that the back door is not closing properly either and has caused damage to door frame edging.  Also, front bedroom window is not easily opened or closed.  You will also see in attached pictures, the small hole in the guest bathroom bathtub.  In supplied pictures from Coleson Homes, the hole is not visible as it is behind the toilet. A walk-thru was NEVER offered before closing.  We never heard from anyone from February 9th until we eventually emailed them on February 26th a day after closing.  To which our email was replied with the offer of a walk-thru.  We were also told in said email, that they gave the keys to the title company.  We were told the jist of the warranty, but have never been told until their response through the Revdex.com when we would receive paperwork on said warranty.    On February 9th, Coleson Homes called to tell us that they had resent the Warranty of Completion form to us, not because we refused to sign it, but because we made them aware that the physical address of the home was incorrect.  Refusal to sign was only after Lon Coleman got hostile in telling Lindsey that he was not going to do anything about the condition of the concrete flooring and that she and Robbie had gotten all the “freebies” out of him.  To which Lindsey questioned what “freebies” he was referring to.  He then stated that she got her granite countertops, insinuating that that is what she really wanted anyway.  No, that is not what we wanted or we would have chosen it before construction began.  There is NOTHING free about this purchase.  Their sub-contractor’s mistakes/poor execution of work performed may have caused Coleson Homes profit margin to decrease, but that does not mean that we received anything for FREE!  Had proper supervision been given there wouldn’t have been near as many problems.    On that note, you will see pictures attached to prove that point.  When water was first turned on to the home there were leaks under every sink.  The cleaners were there that day and Lindsey was told by Zach that he was there for an hour or two and saw no problems.  When Lindsey returned home about 4pm there was no one there.  She went over only to discover water coming out of the exterior of the house from underneath the guest bathroom window.  Upon entering the bathroom, there was water on the floor and upon opening cabinets there was water dripping out of fittings.  The whole underneath of the cabinet was covered with water.  After further inspection, the kitchen sink and both sinks in master bath were all leaking as well.  When she called Zach he replied that the cleaners never mentioned anything to him about it leaking and asked her to please turn off main water supply and that they would be out first thing in the morning with a shopvac.  To which she replied, that we were cleaning the water up that was visible and that water had already been shut off.  Had this water leak not been caught and cleaned up that evening, this could have caused major water damage to multiple areas.  Why, when water was turned on for the first time, was there not a plumber out at the property?  It is because they have too many homes going up and have their sub-contractors spread thin, as told to us by Zach himself on numerous occasions as an excuse for non-work days.   There was no question of the legality of the fact that a representative from Coleson Homes was not present for closing.  The only reason we thought they would be there was because that was the last thing out of Lon’s mouth on the last phone call on February 9th.  Lindsey was telling him about the door frame that was damaged during the installation of the new threshold as an example of things we were not going to complain about and just fix ourselves.  To which he replied, “We will have someone out there right away to fix it.”  To which she replied, “No, we do not want anyone else out here to fix anything, because every time someone comes to “fix” something, something else ends up getting messed up!”  To which he replied, “Fine.  We are done then.  We will see you at closing.”  End of conversation.  There was NO statement made that “we did not want Coleson Homes, nor any of its contractors, to ever touch our home again or step foot on our property”.  That is words being put in Lindsey’s mouth!  She simply and clearly stated above statement with the meaning being no sub-contractor unsupervised would be back out here to “fix” anything else!  The assumption that we had keys prior to having to meet someone from the title company to get them is simply that.  An assumption!  We did not have keys to the home prior to March 4, 2015.  As far as restitution… that is no surprise that they do not own up to the fact that work was not performed at reasonable standards.  There has not been one occasion during this whole building process where they have admitted that work was performed poorly, apologized, and offered to get it fixed as quickly as possible.  Instead, we have had to point out areas that needed attention and were returned with a statement, to the nature of, the job was per their satisfaction but they would address it and let us know what they decided to do. Still, Coleson Homes DOES owe us $1058.00, which is the difference of the initial quote for the water meter.   Attached you will find spreadsheet issued to us through email to reflect this amount. If this amount is not reimbursed, we will have no choice but to seek counsel.
