[redacted] moved into [redacted] Apartments on May 18, and signed a lease contract and all addendums including a Security Deposit AgreementThe lease Contract and Security Deposit agreement both indicate that a days-notice is required to terminate occupancyThe contract also specifically states "if days-notice is not fulfilled, you have the option to pay through the remainder of your day notice or revert to paragraph of the TAA lease agreement accelerating rental payment due through the end of the lease"Additionally, [redacted] initialed the addendum agreeing to pay an amount that does not exceed month's rent as liquidated damages if proper notice is not received, [redacted] moved out of [redacted] at the end of November, At the time of move out, our records did not indicate that a day notice had been received for move out and [redacted] was charged for a day notice, termination fee of 85% of one month's rent as well as final utilities and a carpet clearing charge, [redacted] contacted the Regional Manager for the property in January, to discuss the charges, [redacted] indicated that he had provided notice at the end of October, but had left in the office when no one was there and had just left it on the Assistant Manager's deskHe did not have a copy of the notice or anything showing that the notice was received by the [redacted] management staff, [redacted] was able to provide a copy of an email that was sent to a former employee on October 30, to confirm if the notice was receivedUpon receipt of that email from [redacted] , an adjustment was made to his account removing days of rent and a new deposit accounting statement was provided to him on February 10, showing a new balance due of $1,314.21.Upon further review of the charges and the lease contract that was signed by [redacted] , we find that the charges are reasonable and no additional adjustments need to be made.Sincerely, [redacted] Regional Manager [redacted]

Water bills are sent to each resident on a monthly basis so they will know the additional amount that needs to be added to the rentIn the event that they do not have the water bill they can call the office for the amount due.The water bill is due with the rent and needs to be paid on time to avoid a late fee.There is a Utility Addendum Allocation form that is signed by all residents at the time of move-in.The water bills will fluctuate monthly based on usage.The late fees for October and November will both be waived since there was an issue with communication.I hope that moving forward if there are any issues that need to be resolved that the resident will feel comfortable contacting me or the Property Manager at Village East

Tell us why here In response to Revdex.com complaint ID [redacted] and the allegations of an infestation of roachesOur investigation has found that the resident has only requested pest control on two separate occasionsThe first service date is April 14, and the second on May 1, On both occasions the pest control technician noted that there was no evidence of roaches in the apartmentThe resident has not requested any additional treatments until last Friday, September 1, At that time she indicated her health concerns and the property reached out to our pest control provider to develop a specific treatment plan due to her health concerns and that treatment is scheduled for Friday, September 8, On September 6, the Regional Manager and the Property Manager inspected the resident’s apartment and also found no evidence of roaches, but did find dirty dishes in the sink and grease in the drip pansBoth of these issues can be a contributing factor to developing a problem with roaches Additionally, on Friday, September 1, 2017, the resident contacted the office to have her carpet cleaned and the padding inspected due to a leak from her windowOur records indicate that we had not received a complaint regarding any issues in her apartment since June 28, and those repairs were completed on July 7, Our carpet vendor has been scheduled to complete these repairs on September 6, After reviewing the resident’s lease contract and inspecting the apartment, we do not feel that her issues warrant being released from her leaseWe encourage the resident to continue to contact the management office with any maintenance concerns that need attention

Tell us why here...I feel like we are going in circles hereI don't not think that I should have to pay a reletting fee because I am moving because I have to not because I want to Due to the living conditions I was forced to find a new place to liveI put in service requests in March, April, May, June, and JulyThe apartment complex said they completed the work orders until JulyAll of a sudden my request in July could not be completed because they did not have the key to gain access into the apartmentThe last weekend in June I personally gave the maintenance personnel a key to copy Furthermore, the apartment complex did not attempt to fix anything until I contacted the Revdex.comThe apartment complex has numerous issues but I continued to pay my rent on full despite living in an apartment that they did not care to fixI am done with the broken promises and failed attempts to fix itThe apt needs to be fogged repeatedly and the ceiling still needs maintenance, per maintenance notes left in my apartment after the first attempt to fix on in September Please discontinue the fight and let me move in peace

[redacted] moved out on July 25, 2012 without paying rent for June or the days she occupied the apartment in July. When rent is not paid per the lease an eviction is filed. The eviction was filed for non-payment of rent. She owes for the following: The rent for June and 25 days of July totaled... $792.26. A late fee of $75.00 per month was charged for June and July totaling $150.00. The cost for the attorney fee and filing was $300.00. Since a 12 month lease was not completed the pay back of a monthly special is $233.00 per the lease. Damages were charged for a bathroom door, a bedroom painted hot pink, another with flowers and stickers on it, and a broken shower rod. In addition the apartment was left dirty with dog feces left on the patio. On June 6, 2012 [redacted] gave the property permission to give a key to Victoria Benton therefore, [redacted] was not the only person who had a key to her apartment. Based on the terms of the lease and the record keeping of the property I do not see any reason to modify the balance due. We have agreed to allow the resident to vacate her apartment by providing only a day notice, instead of the required day notice, and payment of the termination fee as indicated in her lease contract which is 85% of one months rent We are not holding the resident to the end of the lease which expires 2/28/which will release her of $2, During the inspection of the apartment home with the resident there were no signs of a pest control problems or mold

[A default letter is provided here which indicates your acceptance of the business's response If you wish, you may update it before sending it If you and the business have reached an agreement and compliance is set for a future date, we trust the business will comply Please contact us after that time if the matter is not resolved as agreed and we will review the complaint and proceed accordingly.] Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and find that this resolution is partially satisfactory to me I was eventually contacted by the Fath Properties C.OBecky and following that conversation felt she fully understood the nature of my complaint I do not, however, feel that the response made by Corey shows the property's office understands the nature of the complaint.His letter states there was a new employee that did not realize the sidewalk continued - it's a straight stretch of sidewalk That explanation rings disengenuous It is also stated that we received a notification in January about cleaning up after our dog We did not receive any such notice The only notice we have received was the one that prompted the initial complaint to the Revdex.com.Regardless, the complaint was not THAT we received a notice, it was that we received a notice essentially stating they received what amounts to an anonymous phone call claiming we did not pick up after our dog As a result, they were going to take three days to determine if we were getting evicted This seemed overly harsh seeing as anyone could have placed that phone call As far as I'm aware, nobody in the complex even knows my wife and I by name, yet that seems important information to have allowed the office to narrow it downAs I explained to the C.OI completely understand the terms of the lease and have no problem abiding by them What I will not allow without a fight is someone to threaten eviction over a phone call that could have come from literally anybody and a complaint that I maintain was entirely unfounded That, to me, stinks of prejudice at worst or just poor business practice at best.That being said, as mentioned earlier in this response, I am marking "accept" largely due to the conversation eventually had with Becky, which took place after my initial complaint was filed with the Revdex.com which may be why Corey's letter does not seem to understand the point The employee may or may not have realized a straight sidewalk continued We obviously did not get evicted - and even if we had, it would have been a mild inconvenience and nothing more I just felt I had no other defense against a threat over an anonymous phone call Beyond that, I was never seeking anything tangible - money off rent, etc Therefore, to continue this complaint would be silly and pointless I still stand by my complaint but the hope is that the office now realizes there are better ways to communicate with its residents Unfortunately, the only way to know for sure is to see what happens in the future Regards, [redacted]

I have talked to the residents and their interrupter concerning the balance due on this account several times since they moved outThe balance owed includes a water bill of $The fact the residents were away from the apartment for a period of time has no bearing on the amount due for the water billThe property uses a RUB system where all residents pay a portion of the total billThe additional balance owed of $is due to excessive cleaning and physical damages that were caused by the resident in the apartmentI have explained this as wellwear and tear is; we paint the apartment and don’t charge the resident, we clean the carpet, and if there aren’t excessive stains the resident is not chargedThe resident is expected to leave the apartment clean with no damagesIf there is excessive cleaning needed or physical damage; it is billed back to the residentA statement was sent as required by law within days of move-out to the forwarding address provided by the residentIf none was given, it is sent to the apartment address to be forwarded by the post officeColonial Ridge will not be revising the amount due on this accountThe account will need to be paid to show a zero balance on the residents’ credit reportThank you, Donna [redacted] Fath Properties Regional Manager [redacted] ###-###-####

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below The regional manager offered for me to pay 85% of the reletting feeI feel like I am being penalized as if I have not been penalized enoughI am not leaving the apartment because I just want toI am leaving the apartment complex because I have toI waited months for the apartment issues to be corrected even though it should have been move in ready back in FebruaryI have been breathing in mold for the past months and no one should have to live like thatFurthermore, I shouldn't have had to beg for the management to fix my apartmentAnd nothing became priority until I contacted the Revdex.comI spoke with the corporate office back in July and nothing happened until September with this complaintI do not think that I should pay them to relet the apartment considering the fact that I am leaving due to their gross negligenceI am leaving to move away from the roaches and the mold next to my bedI rained next to my bed for months and I doubt that a wet vacuum fixed the issue because I feel the difference when I wake up in the morningFurthermore, the regional manager did not stay in the apartment to see the dead nor alive roaches but you can see the review online where another resident has admitted to having to kill roaches monthly! And they will see the roaches throughout the entire apartment when I vacate the apartment at the close of this monthI would also like to point out the fact that there were a total of work orders, most of which for the roach issuesI went to the leasing office and got the dates from the pest control book and I can provide those dates as well in March, April, May, June and JulyI was interesting to me that the regional manager was unable to find it when I got the dates in a matter of minutes and I do not work for the company Regards, [redacted] ***
