I am rejecting this response for 2 reasons. First the check was not mailed until beginning of October and they had the check from warranty company end of August. They just have to lie. The warranty company issued their portion of the check but the dealer does a markup on the warranty company's amount when they sell the extended warranty to the customer, so as per the warranty company, College Hill auto owes us more than just the amount the warranty company sent to them. Also, College hill needs to provide a detailed account of how the amount was pro-rated and what their portion of it was. They have failed to do this. I am not through with this yet. We need the accounting and to see what they gave us in addition to what the warranty company gave them.

Another check for $393.79 was sent to [redacted] late last week.  The amount is based on the warranty program output sheet that was enclosed with the check.

Review: When purchasing my vehicle I was promised the sales tax would be added into my loan to the finace company and at which time it was never added or submitted and the dealership never called me and told me that I was going to have to come up with the sales tax and I was under the impression that the sales tax would be added into my load from the finance company. The dealership had over a month to call me up and tell me that I was liable for the sales tax and again I never recieved a phone call. I eventually got the dealership to issue me a check for the sales tax but they asked for a check from me for collateral for the amount they issued me and I asked them not to cash the check and only hold it for collateral and they assured me that they wouldn't cash the check and I have a witness to this aggreement. I told the dealership that on september 11th I was eligble to request a pay advance from my work but would take at least 2 weeks to get approved and yet the dealership cashed my check against their word that they wouldn't and has overdrawn my account and now I have to cancel my automatic payments for my insurance car payments medical bills because and I contacted the dealership to ask as to why they went against their word and cashed my check to when the owner of the company became really nasty to me and yelling and telling me that it wasn't his problem that I told him I would pay him back by september 11th at which I explained to him I never told him that I would pay him back on september 11th and again I have a witness to this aggreement I told him I could request a pay advance on septemeber 11th and it would take 2 weeks to get approved.

I am filing an affidavite of unautherized draft with my bank because the check was never suppose to be cashed just held for collateral and I am very unhappy with the way the dealership treated me and got really nasty with me and how they trick ppl into buying vehicles with promises that never happen and im not the first person who has been promised the sales tax to be added to the loan amount and then been told had to come up with the sales tax.

When I spoke to the owner of the company he screamed at me that he tried to call me and which I never got a voice mail or missed call from him and couldn't believe that he would lie just to save his own skin and I am very unhappy at the way I have and was treated by this company thus is why I am filing a complaint.Desired Settlement: I desire to have the money refunded to me and so I can get my account back out of the negitive and then when my pay advance comes through I will drop off money to the dealership but with my account being in the negitive my paychecks which are on direct deposit will only go into my account to repay the overdraft money and for 3 weeks I will be repaying the overdrafts leaving my other bills unpaid for and putting everything else in the negitive and this includes having my car reposessed because the payments aren't available because this company has gone against their word and cashed my check which was only to be used for collateral.

I am replying to your letter regarding the above noted complaint that we received on Tuesday, September 24, 2013. **. [redacted] purchased a 2004 Chevy Trail Blazer on 7/13/13 and financed his vehicle with [redacted] Because **. [redacted] resided in New Jersey, he received a 30 day temporary plate. **. [redacted] was told at the time of delivery that he was responsible to register his vehicle in New Jersey by 8/12/13 and that he was responsible for the sales tax at that time in the amount of $794.05. The sales tax was not included in the financing of the vehicle (copy of bank contract attached) and the Bill of Sale (copy attached) shows that no sales tax was collected from **. [redacted] at the time the vehicle was delivered to **. [redacted] on 7/13/13.

I talked to **. [redacted] a number of times before his temporary registration was going to run out and explained to him that he was responsible for the sales tax. Just days before the temporary registration expired, **. [redacted] called me and stated that he did not have the money to pay the sales tax. In order to help **. [redacted], I gave **. [redacted] a check (check number [redacted] attached) payable to New Jersey DMV for the sales tax so that he could continue to drive his vehicle. In return, **. [redacted] gave me a check for the sales tax and asked me to cash the check on Sept. 10, 2013. I waited until Sept. 20, 2013 to cash the check. After the check cleared the bank, **. [redacted] called me and screamed at me for cashing his check, even though we had agreed that I would cash the check for the sales tax after Sept. 10, 2013.

When **. [redacted] gave me his check in August, I showed him the bank contract and the Bill of Sale - which clearly showed that no sales tax was collected. I again stated that he was responsible for the sales tax when he registers his vehicle in New Jersey.

I gave **. [redacted] a check for his New Jersey registration in August to help him out - so that he could continue to drive his vehicle after his 30 day temporary registration expired.

Review: They lied about repairs they were going to do on a used car I wanted to purchase. They took a 100 dollar hold for the vehicle and when I found out I didnt want the vehicle I asked for my money back and still havent received the refund and when I called and complained the guy cursed at me and yelled at me. Review: I purchased a 2002 [redacted] from this dealer on or about November 11, 2013. There were a couple of outstanding issue's that needed to be taken care of that they in fact did take care of SOME of the issue's. The issue's (in total) were/are as follows: No inspection - they were going to get the car inspected; defective turn signal switch - the left turn signal would not work most of the time; broken front headlights - they were going to replace the headlights; rough starting/running/engine codes - they were going to fix ALL issue's with the vehicle; heated drivers seat broken - they were going to repair the heated seat; a broken or defective high beam indicator light on the dashboard - they would repair this because it was an inspection violation; and lastly they would detail the vehicle because it was not done before I picked up the vehicle.

So far, they have completed the following: Both headlight replaced; car inspected; car detailed (although I found medical records, toys, a pocket knife, a broken cell phone, and trash under the front seats after it was 'detailed'!); car hard start and engine codes corrected at [redacted] in [redacted] after much complaining on my part; the turn signal switch was also replaced.Desired Settlement: They have not repaired the seat heater on the drivers side and they have not corrected the faulty high beam indicator. The dealer, [redacted] in [redacted], diagnosed both of these items the last time the car was in for servicing. (**NOTE: College Hill Auto contracted out some of the repairs that were completed. As to this, after College Hill contracted with this dealer the first time, I was forced to pay the bill of $67 and have not been reimbursed for this as of this date, 01/17/2014 - and I contacted College Hill immediately after this incident and they assured me this would be reimbursed by them.) The seat heater has been estimated to cost $800.00 to repair and the high beam indicator issue is estimated to cost $980.00. I realize this may seem costly, but they agreed many times that they stand behind their vehicles and that they were going to repair these issue's. I have a string of text messages from the salesman, [redacted], stating that they are committed to repairing these problems and I have a voice message from the owner, [redacted], stating that he will reimburse me the $67.00 I paid to have [redacted] diagnose the issue's. On 01/17/2014 I was forced to contact the bank that financed the car and get them involved because I had not received the registration 3-1/2 months after buying the car. The bank called them and got me the registration. ON the same day, I was called by [redacted], the Service Manager at College Hill Auto and was told by him that he had contacted a repairman to come to my house and fix the seat heater. (Obviously he did not in fact do this, because no one has contacted me for directions and the seat heater is still broken.) I brought up again that the high beam indicator was still not working properly and he assured me once again that he would have this taken care of. As of today, 01/28/2014, I contacted the dealer again and left both text messages and phone messages. They texted me back and said I was not to contact the salesman again. They never returned my voice message.

At this time, I want the $1780.00 paid directly to me for the repairs at the [redacted] Dealer. I do not trust them to fix my car and there is now hard feelings between us.

We are in receipt of your complaint and would like to respond as follows:

Review: I co-signed for a car purchase with my son at College Hill Auto and my son totaled the car in late June 2014. The insurance company totaled it and paid the balance of the car loan. Since we purchased an extended warranty but the car was totaled, both College Hill and the warranty company, [redacted] Warranty, [redacted], PA, said we were entitled to a refund for the unused portion of the extended warranty. My son did his portion of the paperwork but College Hill did not. Specifically, Bill R[redacted] did not. I contacted the warranty company and they said once they got the paperwork from Bill they could issue their portion of the refund to College Hill and then they would issue us the rest from their markup. All of this would be pro-rated. The warranty company mailed the check to College Hill on Aug. 26, 2014. A few weeks later we still had not heard from Bill R[redacted] about this. We called and faxed and the warranty comp. rep also called him. He said he didn't know if the check was received. The warranty comp. checked and saw that the check they issued was cashed by College Hill. They informed Bill of this fact. He said the owner was in hospital and would have to check with him. We called a few days later, Sept 25, and Bill said that the owner's wife, who is actually the co-owner, may have written the check and we could expect the check either Fri, 9/26 or sat. 9/27. We did not. Bill was phoned about this today and he hung up on my ex-wife. So we still have not received the check. He has delayed and lied repeatedly to us. This was a relatively simple thing, get the check from warranty comp, figure out their portion and send us a check. We have been lied to and they have delayed sending us what is rightfully and legally our money. We are tired of the delays. There is no dispute that we are entitled to this refund. I am now wondering if they have done something illegal by cashing the check and depositing it and not forwarding the money to us. Is that theft? Mr. R[redacted] also hinted that the delay was due to the warranty company, ([redacted]), but it was not. they acted promptly when they received the paperwork. The delays have been going on now for over a month. We were told initially by College Hill that the warranty company would have to issue the refund that was partially true, but they (College Hill) had to issue the rest of the refund. When Bill was called by either us or the warranty company he always said he would call back but he never did. All of this is documented if you need further information. At this point, we want our refund and want to be done with this and College Hill Auto Sales. I would think they would want this to be over and done with also. I have never dealt with a company that did so much to delay and work on further ruining their reputation in the community. This used to be a respected business. I really wish it had not come to this but there really is no other option.Desired Settlement: We want the money that we are entitled to as soon as possible with a full written accounting of how the figure was arrived at. We want to make sure we are given the proper amount.
