4/9/15PREFACE: *** *** is the Dallas area Franchise owner who Mr*** hired and paid for marketing services for his son on November 10, We are the home office in San Antonio (Franchisor).SEQUENCE OF EVENTS RE: *** ***:Mr*** contacted our office on 1/26/via telephone

Yesterday we received Mr***'s response to ***'s e-mail, at which time we all agreed that e-mailing back and forth was counter-productive and a personal phone call to Mr*** was in orderAs an owner of the company, I made the decision to make the callI attempted to get specific names of coaches or schools that Mr*** asserted that he had asked *** to call and did not believe that his requests were fulfilled, but he never gave me any other names except the West Texas A&M complaint that we had rectified two months earlierI kept asking him, who do you want us to call; what have we not done that you would like us to do? I also explained to him that Coach *** was a Franchise owner and that is who he would need to contact regarding his request for a refund and that we would use this situation as a learning experience to educate our Franchisees and make our suggestions to Coach *** as to an appropriate resolution to Mr***'s complaintWhile I was talking, Mr*** talked over me and said, "Are you going to keep talking or are you going to let me talk?" I said I was going to keep talking because I was talking and had not finished my comments, to which he yelled at me, "Well, you can just *** off then and talk to my lawyer", and hung up on meI NEVER said I (or we) were right and he was wrong, nor did I EVER say "absolutely not" to his question about stopping talking so he could talkAs previously stated, I was, in fact, trying to get him to give me specifics of his generalized complaintsThere were five people in the office listening to the conversation.We are more than happy to provide documentation of the voluminous amount of marketing and personal phone calls made on behalf of Mr***'s son in the just five months since they enrolled with Coach ***, and we will continue to do anything that Mr*** requests of us as long as it is not unreasonable*** received a substantial amount of recruitment and interest from college coaches, but he was not interested in alot of the schools that were interested in him. In conclusion, if Mr*** wants to pursue this matter further in an effort to be given a refund because he did not receive the results he was expecting or wanted, he will need to take it up with Coach ***, a sole proprietor Franchisee.Please feel free to contact me if I can provide any further information.Thank you,*** ***College Promoters of Texas*** ***

I am rejecting this response because:The signed contract I have is with College Promoters of Texas (CPOTX) with your address in San Antonio; it does list [redacted] as a representative of that company (not a Franchise Owner as you described).  Therefore I will deal with you and you can deal with your representative, Mr. [redacted]. Mrs. [redacted] did call and ask those questions--repeatedly, but never let me answer.  She was talking non-stop.  Literally, she did not stop talking the entire duration of the phone call.  I did talk over her to ask if she was going to let me talk and she did say verbatim “absolutely not”.  My point of view: 1.    Lying employee (Mr. [redacted]) 2.    Company violating contract 3.    Owner calling to yell at client At that point lost my cool and used profanity, which I immediately regretted and later (15 minutes) called back and apologized.Background: I had asked Mr. [redacted] on several occasions to call several schools and the response I got from him was always vague.  I suspected he was lying to me, so I asked him to call West Texas A&M (WT) and let me know how those call went.  I followed up with a text to ask if he had talked to WT.  He said he had.  I then called and talked Coaches: [redacted], Nesbit and [redacted].  None of them had heard from Mr. [redacted].  I then asked Mr. [redacted] whom he had talked to at WT, and he said Coach [redacted].  I told him I just got off the phone with Coach [redacted] and he had not spoken with [redacted].  Mr. [redacted] then stated that he talked to [redacted].  I told him I just got off the phone with him as well and asked would he like to try again. The simple fact that [redacted] did not call as requested and subsequently lied about calling these coaches proves a violation of contract “UNLIMITED phone calls”.  Having the ‘corporate office’ call after the fact does not change the fact that my requests were in fact LIMITED.  It also does not change the fact that all the previous requests were treated in similar fashion. Mrs. [redacted] was asking [repeatedly] whom they haven’t called and what they haven’t done.  From her attitude, the only thing she wanted was a list of schools to call (now—after the recruiting season is over); which she apparently and mistakenly believes will satisfy the contract.  She did not want to hear my answer:  there is nothing you can do except to give me a refund.  If she wanted to know what schools to call, she should be talking to her representative Mr. [redacted] and/or her Director of Football Operations [redacted]—not the client; since I have told both of them.  Personally talked with and told them schools I wanted contacted; to date the only confirmed school contacted was WT. I will not drop this complaint without refund.  I don’t care if CPOTX sends the refund or if you have Mr. [redacted] personally send it.  In an earlier email, I only asked for half of my fee to be refunded, but after Mrs. [redacted]’s call I demanded a full refund via Revdex.com.  I am willing to accept half ($897.50), if delivered by the end of this month.

Please be advised that we want to resolve this complaint fairly for all parties involved. As such, in exchange for Mr. [redacted] dropping this complaint against the San Antonio office and having it removed from the Revdex.com complaint file, we are offering to refund Mr. [redacted] $500. His son will continue as an active participant in the program and we will continue to help him in any way possible throughout the remainder of his amateur athletic eligibility.Thank you,[redacted]
