I was home from a military deployment for a short amount of time and needed to reseal my driveway I had accomplished this before but didn't know if it was worth my time to just pay for someone to do it for me I requested quotes and Collegiate immediately came back with a quote for $ In the request for a quote, I gave them my address They said they could schedule in five days, so I asked them to come out then I rearranged my schedule for this service and chose not to do myself, trying to accomplish other tasks before I deployed againWhen the crew arrived, they wanted an additional $ I talked to their supervisor and he said the manager was unavailable but would have him call me the next day I had them conduct the service figuring management would stand by their quote The next day came, and I ended up calling the manager as I didn't get a callThey were aware of the situation but stood by their higher quote If the original quote wasn't so low, I would not/NOT have had business planned with them I would have accomplished myself, but now time was running out and five days have passedI am shocked the president of the company was apprised of the situation and was willing to stand by the higher quote $must mean something significant to them If they would have waived it, I would be a repeat customer and a strong advocate writing rave reviews and recruiting more customers Unfortunately, the president's limited view on a dollar in the bank is more important than honest brokering and having a good customer base I don't expect them to change their mindeven over a measly $52, but this should be reported Customers beware! Low bidding and improper quotes are used Your price will likely go up

Dear *** ***,
class="MsoNormal">
Here is our identical response to *** ***’s grievance
that he filed with the *** County.
1.
It was a discounted rate. In our price to seal the driveway at
*** *** *** was $66.00. Our
mailer stated that we would beat any written estimate by $5.00. He received a flier from a competitor,
*** Sealers, with a price of $61.00.
$- $= $
2.
*** *** states that it was a ‘lousy’ job. Not every driveway turns out the same we’re
at the mercy of what we start with. I’m
relatively certain that it’s the original driveway to the house, which was
built in 1995. That makes the driveway
years old. It’s a fact that most
asphalt driveways in our area last -years & sealing / crack filing
will only do so much for older drivewaysThe sealer is not watered
down. *** *** is making a
statement & he has no idea what he’s talking about. Our sealer is mixed exactly to manufacturers
specs and every crew goes out with the same mix design. *** *** failed to mention that the last
time we sealed the driveway (prior to the job) was in 2011. He complained about that job also. We sealed it on June 18, and went back
at his request and redid the job on June 25, 2011.
3.
The fact that Sean left him a voice mail asking if he’d
like to schedule a reseal isn’t necessarily an indication that we recognize the
poor quality of the original job. It’s
that we recognize we have a customer with expectations that exceed what our
service can do for his driveway, but we were willing to give it another shot at
no charge ALMOST A FULL YEAR AFTER THE ORIGINAL SERVICE
4.
With respect to the cracks, could we be any more up
front about our limitations when it comes to crack filling? We tell the customer up front, before they
even call us for service. If they don’t
like what they read, we can only hope they will call someone else. This following was printed on our mailer which states:
* WE CANNOT GUARANTEE THAT CRACKS WILL NOT
REOPEN OR SETTLE
* We recommend keeping a bottle of crack
filler on hand to refill as needed
* WE DO NOT RETURN TO REFILL CRACKS THAT
REOPEN OR SETTLE AFTER SERVICE.
(Please see attachment)
We have done nothing wrong. We provided the service we advertise, and
went back and redid the job at no charge.
*** *** calls us almost a full calendar year later and expects us to
refund his money. Who does that? We are not refunding his money and we
consider the case closed.
Sincerely,

Dear *** ***,
Please see the attached contract that the customer signed before any work was performed On page in the signature box, it states 'One year guarantee against potholes.' (This is all that I need to present & the matter should be
resolved We have done nothing wrong.)
On page it states no warranty against erosion, minor cracking, settlement, or sinkingShe knows there was a one year warranty but is upset that she allowed a roofing dumpster to be placed on the driveway and she now feels we did sub-par work Quite frankly I'm surprised there aren't four depressions in the driveway from the dumpster, we see it all the time in this businessPlease don't hesitate to contact me if any further action is neededSincerely,

Mrs. [redacted] is mistaken in saying they used us a year ago. Prior to sealing the driveway on March 20, 2015the last time we sealed their driveway was April 27, 2012. Had we sealed their driveway in 2014, when they font-size: 11px;">called us on March 16, 2015 for service we would have advised them not to seal the driveway again this year(we recommend every 2-3 years). Most of our customers are prompted to call us by the flyers we mail to previous and potential customers. Ourflyer clearly states our policy on crack filling:I don’t think we could be anymore upfront about the limitations of our service when it comes to crack filling. We don’t want customers to think we can “fix” cracks with sealcoating.
In addition to the policy statement on the flyer, on the day a customer calls to schedules service, they receive anemail the same evening with this attachment:
If the customer chooses not to read our policy on crack filling, I do not consider that to be our fault.Mrs. [redacted] also states that they “…had asked them to come and fill some cracks in our driveway, WHICHwe explained upfront about the cracks and they said no problem.” When a customer brings up the issue ofcracks in their driveway on the phone with us, NO ONE in this company would say “no problem”.She goes on to say, “They DID NOT fix any of the cracks and just sealed our driveway again, which wasn’tnecessary.” We do not offer a service for “fixing” cracks that does not include sealcoating. If she had her driveway sealed in 2014, it was likely with Academy Sealers, but it was not Collegiate Sealers &Paving. If that is the case, she should have called Academy to come “fix” the cracks.Had we not completed the service we advertised we would be happy to re-visit the driveway or offer a refund, but that is not the case.

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.
I have met with the owner and made the agreement stated in the response.  They have made the effort to satisfy the companies issue.  I thank them for the response.

 Complaint: [redacted]
I am rejecting this response because:

I unsuccessfully submitted a complaint to [redacted] County.   Shown below is the response I sent via email to Prescott Barbash in response to the letter they forwarded to you. Collegiate
Sealers is clearly an unethical, dishonest business and I demand a
refund.
Thanks
for the opportunity to comment further.
Let
me responds to the 4 points made by Collegiate Sealers in their
letter to you dated September 14, 2014 and attached to your letter to
me dated October 3, 2014.
However,
I am not satisfied with their response and still seek a full refund
of the $56.00.
1.
The price they quoted was $5.00 less than any other written
estimate. That is the offer they quoted on their personalized
postcard addressed to me. If they want to say they gave me a
discount for accepting the offer printed on their card, then fine but
it changes nothing.
2.
There are multiple points to be addressed in this one. Yes, it was a
lousy job and they did use watered down sealer. As for not knowing
what I'm talking about, I have extensive oil refining industry
experience including the production and manufacture of asphalt and
asphalt emulsions (sealer). I most certainly do know what I'm
talking about.
They
commented that my driveway is 18 years old. If my driveway is so old
and in such poor condition, then why did they offer their service to
me in the 1st place?! In other words, if they know their sealer
service is inadequate for driveways 15-20 years, then why dothey
solicit business in Virginia Run. They should know their
product/service is not "fit-for-purpose" and my house is
one of the newer ones in this neighborhood.
I filled the cracks and sealed the
driveway myself using crack filler and sealer purchased from [redacted]. It's been 3 months and not a single crack has opened up.
Also,
if they want to travel down memory lane to 2011, remind them that I
called them immediately after their crew left an open 5 gallon bucket
of sealer in the middle of the street. I'm sure they have
conveniently lost the record of this phone call. I saved them
hundreds or even thousands in damages in paint repairs had the bucket
been hit by a car.
3.
It wasn't ALMOST A FULL YEAR WHEN I FIRST CONTACTED THEM and they
told me to "get lost" as they weren't going to do anything. Again, I
sealed the driveway myself and it looks great with no cracks.
4.
I would contend that sending me a personalized cards with my
individual quote implies they believe their service is
"fit-for-purpose" for my driveway.
If
they are now saying my driveway was "too far gone" for their limited
capability service, then they shouldn't have given me a proposal and
quote for filling in the cracks and sealing my driveway. That is
false representation.
I
have to say the tone of Mr. Cornicello's letter concerns me as he
appears to be someone with anger issues. If I receive any damage to
my property or my family or me are threatened in any way, I will be
directing the police his way.
Please
let me know if you would like to discuss the matter further.
Regards,
[redacted]

The customer is asking us to warranty the work for longer than the warranty that was agreed upon when she signed the contract.  Please understand that there is a reason our warranty is for one year against potholes (not depressions, cracks, or any other issues).  Asphalt is a relatively soft material compared to concrete or paver blocks.  A major factor in the stability of an asphalt surface lies in the ground on which it is constructed and we have no control over that.  Asphalt driveways typically have a 4” base of 21A stone and a 2.5” layer of asphalt on top.  We cannot determine if the ground underneath the base has soft spots or if there are underground water issues.  When we remove the asphalt, we address any visible low spots and roll & compact the base prior to placing the new asphalt (as it states in the contract), this is all we can do.  The option to repair the area where the small depression is located would involve cutting out the area and repaving it.  We don’t recommend it because:
1) The patch will be much more noticeable than the small depression.  We cannot cut into asphalt, repair it, and make it look as if nothing was done.
2) It’s expensive work.  Our minimum charge to mobilize a paving crew is $1,700. I can understand her being upset, but I do not understand the expectation for us to warranty the work for more than what is stated on the contract.

To Whom It
May...

Concern,
On July
27, 2011, Collegiate Sealers and Paving paved [redacted]’s driveway for
$2,850.00 (not $4,600.00 as stated in the complaint). In November 2011 we
received a call from [redacted] with concerns regarding settling near the
concrete apron. Although we do not warranty settling, a manager stopped by to
evaluate the situation. When the manager evaluated the driveway, he noticed
that due to a poorly poured concrete apron a low spot was forming in the
asphalt. This was explained to [redacted] and he stated he understood.
At that
time, part of our paving service included a free seal one year after the
driveway was installed. [redacted] scheduled his free sealcoating for July
25, 2011. When this appointment was made, no concern regarding the driveway was
brought up.
On April
22, 2013, Collegiate Sealers and Paving sealed the driveway and filled the area
between the concrete and asphalt at no additional charge. Filling the gap
between the asphalt and the concrete is something we do not normally do,
however an exception was made for [redacted].
[redacted] was still not happy with the crack filler, so on April 25,
2013, our crew dropped off a jug of crack filler, free of charge, to allow [redacted] to fill the cracks as needed. Each time [redacted] spoke with a
manager it was explained that we have done everything we could do to prevent
the minor settling. We feel we have done everything within reason to
accommodate [redacted]’s concerns.
Our
records indicate that we had no contact with [redacted] in 2014.
Please
note, our estimate clearly states we only have a one year warranty against
potholes. It does not cover settling or cracking.
At this
point there is nothing more we can do to help [redacted] with the minor
settling in his driveway.

I am rejecting this response because:  I appreciate their response and understand completely with what they are expressing.  However our problem remains that our driveway was NOT repaired correctly the first time or we would not have had this issue and they are not willing to stand behind their work.  They are quite frankly hiding behind their warranty.  I understand there are terms for a warranty but there are always exceptions and when the work is not done correctly the first time then this should be one of those exceptions.  They are simply not a business that strives to keep their customers satisfied as their phone message implies.  Regards,

I was home from a military deployment for a short amount of time and needed to reseal my driveway. I had accomplished this before but didn't know if it was worth my time to just pay for someone to do it for me. I requested quotes and Collegiate immediately came back with a quote for $88. In the request for a quote, I gave them my address. They said they could schedule in five days, so I asked them to come out then. I rearranged my schedule for this service and chose not to do myself, trying to accomplish other tasks before I deployed again.
When the crew arrived, they wanted an additional $52. I talked to their supervisor and he said the manager was unavailable but would have him call me the next day. I had them conduct the service figuring management would stand by their quote. The next day came, and I ended up calling the manager as I didn't get a call.
They were aware of the situation but stood by their higher quote. If the original quote wasn't so low, I would not/NOT have had business planned with them. I would have accomplished myself, but now time was running out and five days have passed.
I am shocked the president of the company was apprised of the situation and was willing to stand by the higher quote. $52 must mean something significant to them. If they would have waived it, I would be a repeat customer and a strong advocate writing rave reviews and recruiting more customers. Unfortunately, the president's limited view on a dollar in the bank is more important than honest brokering and having a good customer base. I don't expect them to change their mind... even over a measly $52, but this should be reported. Customers beware! Low bidding and improper quotes are used. Your price will likely go up.

Review: Collegiate Sealers was hired by my company to seal and stripe the parking lot located at [redacted], VA [redacted]. A week after the job was completed there was heavy rains in the area. The parking lot became excessively slippery to the point that the vehicles were sliding as if they were on ice. There was a noticeable film of chemical on the lot. The Fire Department was called to examine the property. As myself and the Fire Chief walked the lot you get see our foot prints. This was not in one area, but over the entire lot. It was determine that this was a result of the seal coating on the lot. The next day the lot did not even look as if it had a seal coat done the week before. It appeared as if the coating had washed away. We have used Collegiate in the past and have had good experience, but when I spoke to the manager he was rude and did not seem to be concerned with our issue.Desired Settlement: We would like to see the job redone. This company has not made any payments. We are willing to make payment if it is completed properly.

Review: Poor quality workmanship of drive way sealing for multiple homeowner pipe stem. Notified company of large cracks not repaired. The company refused to correct deficits. Incorrect billing to single homeowner for drive way sealing for months. Once error was discovered by home owner, numerous attempts were made to correct invoice with final resolution with appropriate corrections.During this process, I received intimidation emails for payment for work that I was not financially liable for. The company was fully aware of the issues involved with the pipe stem ownership but chose to send the invoice to a collection agency ([redacted].) and subsequently I received an invoice for payment for full amount owed. After payment had be authorized and paid by my Home Owner's Association. They were rude and not interested in resolving the issue only payment for poor quality workmanship.Desired Settlement: Since payment has been received by Collegiate Sealers, repair cracks in pipe stem and contact debt recovery agency to remove any real or potential reference to my credit score at the three major credit report agency. A copy of my updated credit report.

Response:

We sealed your driveway and pipestem on August 26th, 2013. We attempted on many occasions to collect payment before sending you to a collections agency. You were sent to that agency prior to us ever receiving payment. We attempted to contact the collections agency immediately when we received the payment to remove you from their records. On April 24th, 2014 you indicated that your Homeowner's Association had received the invoice for the completed work, and that the work had been deemed unsatisfactory. Previous emails had been exchanged in regards to providing an invoice that was acceptable for the HOA, with no mention from you about dissatisfaction with the work. When we attempted to contact the HOA regarding the problems, they indicated that they had not inspected the work. According to the President of the HOA, the homeowner is responsible for payment, and is able to request reimbursement from the HOA upon completion. You, in fact, had told them that the work was not acceptable, further delaying payment.Once again, we do apologize that the driveway sealcoating was not up to your expectations. There is no repairing cracks when sealcoating a driveway. We do attempt to fill the isolated cracks between 1/8" -1/2" wide. We never make any guarantees regarding the cracks staying flush, as a single layer of crack filler will often sink into the crack and the crack will re-open (This can happen as early as that same day or as late as a few months down the road). We do not offer a crack filling service in which we guarantee complete repair of cracks. Please refer to our policy on crack filling which is clearly stated on all our flyers, estimates, and website. Our Policy on Crack Filling:• We will make every attempt to fill isolated cracks 1/8" -1/2" using the cold pour crack sealer described above.• Areas of "spider-web" cracking will not be pre-filled. Asphalt repair is required for those areas.• WE CANNOT GUARANTEE THAT CRACKS WILL NOT REOPEN OR SETTLE.• During the curing process the material may constrict & settle into the crack, causing the filler to open.• We recommend keeping a bottle of crack filler on hand to refill as needed.• WE DO NOT RETURN TO REFILL CRACKS THAT REOPEN OR SETTLE AFTER SERVICE.As you stated, we did have a field manager come out to your property and evaluate the work that you deemed faulty. He arrived on April 25th to complete the evaluation. As we've explained, the cracks were filled as it is outlined on our policy.

Review: The business was to seal a very short driveway at my home. They did come and enough product was applied to do the first part of the driveway, but as the sealer was applied lower down on the drive it got thinner and thinner and eventually not enough sealer was applied to actually seal the drive.

I called the business and sent them a picture, but their response was that's the way it goes. They never promised it would Actually seal the drive.Desired Settlement: come out and do a quality job.

To Whom It May Concern,

Collegiate Sealers &

Paving received a letter from the Revdex.com on 7 October 2013

regarding a complaint filed on 1 October 2013 by [redacted] of [redacted], VA. This letter is being sent in response to that

complaint; in an effort to clarify the situation surrounding the work that was

completed at [redacted]’ residence.

On Wednesday, 11

September 2013, [redacted]’ neighbor made an appointment to sealcoat his own driveway

along with [redacted]’. On the day of our

appointment with [redacted], the crews arrived to [redacted] in

[redacted] at 10:26am and proceeded to sealcoat both homes before departing at

12:42pm.

At 11:18am on

Saturday, 14 September 2013, Collegiate Sealers & Paving received an email from

[redacted] stating concerns over the condition of the newly sealed driveway. That email stated the customer’s opinion that

the sealer had been applied too thin over some areas of the driveway, and that

crack filler had not been used in some instances. In that email, the customer offered to send

pictures of the work for our evaluation.

The email conversation between our company and [redacted] can be found at

the bottom of this document.

Our policy regarding

unsatisfactory work is to request pictures from customers; if customers are not

able to send pictures, we send a manager to evaluate the work. A member of our office staff, [redacted], requested

pictures of the work from [redacted] on Monday, 16 September 2013.

The pictures we

received on Monday, 16 September 2013, portrayed instances of what our company

has labeled “spiderweb cracks.”

Spiderweb cracking is defined as an area of the asphalt driveway that

exhibits many interconnected cracks, and these cracks are usually very thin. Spiderweb cracks are not covered under our

crack filling guidelines, as can be found at our website (http://sealmydriveway.com/va_residential_seal.html)

and the postcards that we send to customers.

[redacted]’s response, after having a field manager evaluate the pictures from

[redacted], informed him of our policy regarding crack filling. He told [redacted], “the areas you photographed

are areas of spiderweb cracking, which we do not fill in with our sealing

service. Whether we fill cracks or not,

they will always reopen, there is nothing we can do to prevent them from

cracking back open.” This information is

correct, as the only permanent solution to cracking asphalt is to repave that

area. [redacted] responded that same day

stating, “Sorry [redacted], But filling in cracks is what I call sealing. Whether they reopen is beside the point.”

Our understanding of

[redacted]’ evaluation is that because cracks appeared on the driveway after

sealing, that sealer was not adequately applied in those areas. This evaluation is not correct. Sealcoating asphalt driveways is not a repair

for the driveway, it is simply preventative maintenance to protect the driveway

from further deterioration. Crack filler

is applied to cracks that meet our policy, however that product is water-based

and therefore it does settle. This means

that even when we apply crack filler it is possible for those cracks to

reappear once the filler has settled.

For the 25 years

that Collegiate Sealers & Paving has operated in Northern Virginia we have

stood by our work and made every effort to ensure customer satisfaction. We

take pride in our ability to rectify situations in which our jobs were not

completed to the customers’, or our own, satisfaction. In this case, the product was applied

correctly and to the best of our ability, as evaluated by our field

manager. It is to our great

disappointment that we were not able to please [redacted] in this case, however

the policies which he agreed to by choosing to work with us expressly state our

intent when we agree to sealcoat a customer’s driveway.

Thank

you,

[redacted]

Response:

To Whom It May Concern,

On Monday, 16

September 2013, Collegiate Sealers & Paving received pictures of the

recently sealed driveway at [redacted] in [redacted], Virginia. Our office responded to the email from [redacted] stating that we do not fill the type of cracks that he had

photographed; the cracks shown are

hairline/spiderweb cracks which are intentionally excluded from our crack

filling guidelines due to the reasons named in this document.

Our crack policy

found at our website and the postcard we send to customers expressly states: “Areas

of “spider-web” cracking will not be pre-filled. Asphalt repair is required for

those areas.” Spiderweb cracks are not

filled because filling them in generally produces negative/unsatisfactory results. Cracks that are labeled spiderweb cracks are

generally less than .25” wide, which not only falls outside of our crack

filling guidelines, but also restricts the ability of the crack filler to settle

into the cracks as it is intended to do.

This in turn produces very visible lines, more-so than standard cracks

greater than .25” wide, where crack filler was used on the driveway. We attempt to always leave the driveway in

better shape than when we arrive; this would be impossible for us to do if we

were leaving outlines of every tiny crack on the driveway.

We are willing, in

the case of [redacted], to offer a free jug of crack filler to be dropped off at

the customer’s home for their own personal use in attempting to fill in the

cracks on the driveway that do not meet our policy. However, [redacted] should be aware that the

cracks he will be filling in will leave very visible black lines outlining the

areas afflicted with spiderweb cracking.

We will accept no responsibility for the appearance of the driveway

after providing [redacted] with a jug of crack filler to fill in the areas of

spiderweb cracking.

Thank

you,

However, I did not like that the business manager left a message on my voice mail indicating I had "slandered" the business. I simply provided the facts of the situation.

Regards,

Review: After receiving a solicitation postcard in the mail, I hired Collegiate Sealers for $56.00 to seal my driveway. They implied their service would seal the driveway and they would fill cracks. When I called, I was effectively told to "get lost". I filed a complaint through [redacted] County seeking a return of my $56.00.

After several "back-and-forths", Collegiate Sealers maintained their position that I should just "get lost".

[redacted]Desired Settlement: Return of my $56.00.
