Mrs [redacted] is mistaken in saying they used us a year agoPrior to sealing the driveway on March 20, 2015the last time we sealed their driveway was April 27, Had we sealed their driveway in 2014, when they called us on March 16, for service we would have advised them not to seal the driveway again this year(we recommend every 2-years).Most of our customers are prompted to call us by the flyers we mail to previous and potential customersOurflyer clearly states our policy on crack filling:I don’t think we could be anymore upfront about the limitations of our service when it comes to crack filling.We don’t want customers to think we can “fix” cracks with sealcoatingIn addition to the policy statement on the flyer, on the day a customer calls to schedules service, they receive anemail the same evening with this attachment: If the customer chooses not to read our policy on crack filling, I do not consider that to be our fault.Mrs [redacted] also states that they “ had asked them to come and fill some cracks in our driveway, WHICHwe explained upfront about the cracks and they said no problem.” When a customer brings up the issue ofcracks in their driveway on the phone with us, NO ONE in this company would say “no problem”.She goes on to say, “They DID NOT fix any of the cracks and just sealed our driveway again, which wasn’tnecessary.” We do not offer a service for “fixing” cracks that does not include sealcoating.If she had her driveway sealed in 2014, it was likely with Academy Sealers, but it was not Collegiate Sealers &PavingIf that is the case, she should have called Academy to come “fix” the cracks.Had we not completed the service we advertised we would be happy to re-visit the driveway or offer a refund,but that is not the caseSincerely, John P***John P***Collegiate Sealers & Paving

The customer is asking us to warranty the work for longer than the warranty that was agreed upon when she signed the contract Please understand that there is a reason our warranty is for one year against potholes (not depressions, cracks, or any other issues) Asphalt is a relatively soft material compared to concrete or paver blocks A major factor in the stability of an asphalt surface lies in the ground on which it is constructed and we have no control over that Asphalt driveways typically have a 4” base of 21A stone and a 2.5” layer of asphalt on top We cannot determine if the ground underneath the base has soft spots or if there are underground water issues When we remove the asphalt, we address any visible low spots and roll & compact the base prior to placing the new asphalt (as it states in the contract), this is all we can do The option to repair the area where the small depression is located would involve cutting out the area and repaving it We don’t recommend it because: 1) The patch will be much more noticeable than the small depression We cannot cut into asphalt, repair it, and make it look as if nothing was done2) It’s expensive work Our minimum charge to mobilize a paving crew is $1,I can understand her being upset, but I do not understand the expectation for us to warranty the work for more than what is stated on the contract

[To assist us in bringing this matter to a close, you must give us a reason why you are rejecting the responseIf no reason is received your complaint will be closed Administratively Resolved] Complaint: [redacted] I am rejecting this response because: I appreciate their response and understand completely with what they are expressing However our problem remains that our driveway was NOT repaired correctly the first time or we would not have had this issue and they are not willing to stand behind their work They are quite frankly hiding behind their warranty I understand there are terms for a warranty but there are always exceptions and when the work is not done correctly the first time then this should be one of those exceptions They are simply not a business that strives to keep their customers satisfied as their phone message implies Regards, [redacted]

May 21, To Whom It May Concern, On July 27, 2011, Collegiate Sealers and Paving paved [redacted] ’s driveway for $2,(not $4,as stated in the complaint)In November we received a call from [redacted] with concerns regarding settling near the concrete apronAlthough we do not warranty settling, a manager stopped by to evaluate the situationWhen the manager evaluated the driveway, he noticed that due to a poorly poured concrete apron a low spot was forming in the asphaltThis was explained to [redacted] and he stated he understood At that time, part of our paving service included a free seal one year after the driveway was installed [redacted] scheduled his free sealcoating for July 25, When this appointment was made, no concern regarding the driveway was brought up On April 22, 2013, Collegiate Sealers and Paving sealed the driveway and filled the area between the concrete and asphalt at no additional chargeFilling the gap between the asphalt and the concrete is something we do not normally do, however an exception was made for [redacted] [redacted] was still not happy with the crack filler, so on April 25, 2013, our crew dropped off a jug of crack filler, free of charge, to allow [redacted] to fill the cracks as neededEach time [redacted] spoke with a manager it was explained that we have done everything we could do to prevent the minor settlingWe feel we have done everything within reason to accommodate [redacted] ’s concerns Our records indicate that we had no contact with [redacted] in Please note, our estimate clearly states we only have a one year warranty against potholesIt does not cover settling or cracking At this point there is nothing more we can do to help [redacted] with the minor settling in his driveway Thank you, Dan C [redacted] Vice President Collegiate Sealers and Paving ###-###-####
