[redacted] and CounselI am in receipt of your original complaint notification letter
dated 6/27/2016 by [redacted], which included a copy of the consumer's original
complaint.I will respond by telling the real facts and then to each. and every
line of...

Ms. [redacted]'s complaint.1. "On Monday 6/20/2016 my family purchased a new Collie puppy that we found online from Collie Country Ranch at 4205 Snodgrass Rd. Mansfield, Ohio 44903."This statement is
true. The sale of the puppy was on this date. The sale of a puppy is not
forbidden by law, however there was an agreement between the parties that the
[redacted]'s would take the puppy that day to baby sit the pup and they would trust
their veterinarian to give shots and medically check out the dogs since they
begged and continued to beg to take the puppy with them that day.2. Their website clearly states these puppies are 8 weeks old and other websites they advertise on states "all shots, wormed and normal eyes and hips vet checked".Collie Country Ranch
(hereinafter known as CCR) does not have a website, our Facebook page states
each puppies birth date and photos. If there are other websites we advertise on
that state such a things it would not apply in this situation due to Ms. [redacted]
knowingly, willingly and convincingly stating that she either worked for or
used to work for a vet: she was told the age of the pup at that date: knew it
would be an illegal delivery if not agreed to be babysitting and checking the
progress of the pup.3. "As we were checking out the 3 male puppies with the adult daughter [redacted] the father Attorney [redacted] came out telling us that these were only 6.5 weeks old and that its illegal to sell before S weeks but this puppy is in such good health and I s so much biggerr that the rest of the litter that he would take a chance and sell him to us."I will have to respond in parts because the horrible English of
this run-on sentence. Ms. [redacted] fails to disclose and admit that the [redacted]'s
were informed on the telephone and when the pups were brought to them that they
knew the age of the pups. She also failed to disclose and admit that they
continued to question and request my daughter to deliver the pup they had
chosen. She also fails to disclose and admit they kept trying to convince her
to do such things when my daughter continued to refuse their requests. After
personally refusing their request and their continued insistence on delivery
that day, my daughter came back inside and they asked to further speak with me
about delivery.I then came out for the second time after approximately 30
additional minutes of them harassing or trying to convince my daughter about
delivery. My daughter and I stated the pups were scheduled for their shots and
vet visit shortly and had not received them. They talked to me about Ms. [redacted]
either working for a veterinarian, or had worked for a veterinarian and
insisted that they would pay for the shots and have their vet check him for
everything.I never
told them I would "take a chance and sell him to them" because I have
sold pups on their actual birth date and I can sell pups at anytime, it is the
complete delivery to the family that matters. After telling the [redacted]s again
they could not take delivery I returned to my home, sat for just a minute,
discussed it with another family member and returned outside to the [redacted]s. I
stated that I could allow them to
take complete delivery of the pup but I could allow them to baby sit. I did say
that I would consider doing the
babysitting arrangement because the pup was in such good health and one of the
biggest in the litter. As they could see he was active and playful and in good
health.We discussed the arrangement: I still owned the pup until his 8 week birthday; that they would baby sit;
that if anything was to go wrong or any negative vet that I would refund their
money; that they would pay for the vet at their cost; Amazingly they
call stating the pup had parvo and they would not return the pup.4. So we paid $800.00 plus tax $856.00 and took the puppy "[redacted]" home to [redacted]. The [redacted]s paid the amount stated with tax and took the puppy on the agreement that they would be babysitting the pup and sale would not be final until both parties agreed things were fine. I do not have enough knowledge to either admit or deny whether the [redacted]s traveled to their home in [redacted] or where they might've gone, stopped or whom they visited.5. On Tuesday 6/21/2016 we took [redacted] to [redacted] and our vet Dr. [redacted] gave [redacted] his first set of shots and the basic exam.I do not have enough knowledge to either admit or deny whether the
[redacted] took the pup for his first set of shots and basic exam. What I do notice
in this description that the [redacted] did not state any problems noticed of the
pups. The facts state no signs of problems at the initial visit.6. On Wednesday [redacted] appeared worn down and vomited we figured reaction to shots which isn't uncommon. I do not have enough knowledge to either admit or deny whether
the [redacted]s observed pup as uncommon. However
I again notice no mention of any or all of the places, people or animals that
the [redacted]s took the pup. I do not know what reaction they believe is not
uncommon, however the shots have never affected my pups in any unusual manner.
I will add that a change in diet, surroundings, other pets, or a shift in
schedules does affect pups.7. "On Thursday 6/23/2016 [redacted] was still vomiting, we knew owning countless pets over the years this isn't normal so we took [redacted] back in to be checked out."I do not have enough knowledge to either admit or deny. There is no
evidence of this behavior by the pup except the statement made by the
complainant. They claim still vomiting however stated he vomited
once the prior day. Again, change in surroundings, handling, other pets, diet,
water and etc. can surely upset a pup's digestive system.8. "Dr. [redacted] called me and said [redacted] tested positive for Parvo but he was going to call the vaccine company to make sure he wasn't getting a false positive reading because the shot on Monday, he called right back and said this puppy is testing for Parvo and would need to be treated there for about 4 days and he still could pass."Each time a pup
receives a parvo vaccination it will show false results on a test given within
a day or so. The complainant lied either to you or to me because they said they
were at the vet at the time of the test given to the pup when they called me.
The pup has been internally injected with thousand of the "live"
(alive but stated to be unable to actually cause the disease) of the parvo
virus. There are thousands of articles written on this very subject of a false
positive and the position that it puts the pups "owner" when vet says
may be false positive but treat or pup may die?9. I inquired about cost and he said if I wasn't a regular customer that they would require $600.00 deposit.I do not have
enough knowledge to either admit or deny what the vet may have said. However
only after being asked 5-10 different times when the [redacted]s called and
requested I give the authority and agree to pay cost of their vet would they
then tell me "if I wasn't a regular customer they would require $600.00
deposit. Immediately, I refused and told them they did not own the pup, I did.
It would be my responsibility because it's my pup and that I would come get the pup immediately. They continued to refuse the
refund offer.10. "We called Collie Country immediately one to warn them about the virus since they had about 20 puppies and to tell them they had sold me a very sick puppy and without immediate treatment would surely die."The [redacted]s requested that I pay for the veterinarian bill for the
pup. It was immediately apparent that the [redacted]s were trying to extort money
from my business. Not caring anything about my other pups. I repeatedly
questioned the results due to the recent vaccination and stated none of our
pups have symptoms or signs of parvo, requested the pup be returned as per our
babysitting agreement and refund I would refund their money. Then, I could have my vet appropriately diagnose and treat the pup if it were true. Have a more thorough blood test done and save the lives of our other
pups. When the [redacted]s refused with such excuses as they were too attached and
their grandchildren were too attached, I stated "what about me, my family
and grandchildren have raised him for 7 weeks. That the treatment hadn't
started that they just found out I told them if they were not the legal owners
at the time. If they were claiming legal ownership they had to pay for their
treatment to their dog. I still
owned the pup legally and I was not
allowing them to spend my money for the vet she claimed to work or did work in
the past. I stated this a minimum of
10 times, yet they would not allow me to have my pup whether I picked the pup
up from their vet or their residence. The [redacted]s accused me that I would not
treat the puppy and they would not let it die. They continued to refuse the
refund after explaining the situation over and over
again that I owned the pup and our agreement was to return the pup upon any
issues, if they continued to believe that they owned the pup they had to make
the decisions to treat the pup.Cussing and swearing at my daughter and stated they were suing.
This was the plan from the beginning and we will not bend in our position.I contacted
our vet and he claimed the pups showed no sign, our adult dogs were properly
vaccinated and some immunity would transfer. He quickly researched and claimed
the pup could be showing a false positive on the test and suggested we get that
pup back, keep it separated because it could effect the whole litters, he then
suggested the pup could have gotten panto from anyplace they may have taken it,
and to watch all of the other pups for symptoms,All pups from Collie Country, that litter or any other litters
have never had Parvo. It would be impossible for that pup to have Parvo caused
by CCR. How is it that just the [redacted]'s pup was affected and none other? It is
highly contagious and would wipe out the entire business. They are regrettably
mistaken and they have spread unjust rumors and lies about our business. The [redacted]s have continued to try to extort my business and I will not pay them a cent. They have
been posting false and misleading statements and continuing to ask for more and
more monetary consideration to discontinue their actions. They will be proven
wrong in a court of law and I welcome the opportunity to defend their continued
lies and sue them for defamation of character in both their libelous and
slanderous actions. They "stole" or committed civil conversion, did
not have the right to have medical treatment on my dog, assumed all
responsibility and cost for such when refusing the return and refund. This would be a disastrous situation for this business
and the average life span of an infected dog is 5 days, it is simply not true.11. [redacted] answered the phone and said she would tell her father.[redacted]
approached me crying and near hysterical stated that this family had claimed
our pup had Parvo and requesting her authorization to pay for the vet bills.
She did state to them that it is not her responsibility to answer their request
and that she would talk to me first. I contacted
them within minutes to resolve the issue.Parents are
vaccinated and the pups are immune through the parent for a short time. It is
highly unlikely that any pup would have the disease ifthe parents were
immunized at such a young age that is why it is recommended to begin the
vaccine at 8-weeks.12. When [redacted] called he was very abrasive and said I have no right spending his money and bring the puppy back and would have the puppy treated there.Correct. Also I
told him they could have a full refund and refund the vet cost, as well as,
stating that I would make the trip immediately.Their
"Desired Result"-"In the few
days we have had [redacted] my grandkids my Wife and I have fallen in love with [redacted]
and want [redacted] to have the best chance at a good life. We don't want a refund. We
want what we paid for a healthy puppy. We don't want to take [redacted] back to die.
We want Collie Country to reimburse the vet bills up to the $856.00 purchase
price..1. "In the few days we have had [redacted] my grandkids my wife and I have fallen in love with [redacted]"Again, at that
time the [redacted]s in this complaint claim they purchased on Monday, vet visit
Tuesday, issue on Wednesday. Not a lot of time to be attached or in love. The
fact of the matter is that they did get a result that the pup tested positive
for parvo, and I'm sure the vet told them it could be a false positive. The vet
would give them the option to treat to make sure the pup was fine, send for a
blood test or wait a little longer. The [redacted]s decided to treat immediately.
They also decided to treat the pup after knowing that I requested a return and I would provide a refund so that I could treat
the pup. They have now committed defamation of character, libel, slander and
interference with business. Promising to be our "worst nightmare."2. "We don't want to take [redacted] to die".Very dramatic
statement and they stated that was one of their reasons, but not a solution to
send to Revdex.com.3. " Want CCR to reimburse the vet bills up to $856.00 purchase price."They had that opportunity plus the vet bills
they incurred. Due to their actions during this and their further actions WE DENY.Daniel * P.
