She stopped by to show us paint that was coming off the rear bumper that we had previously replaced. We replaced the rear bumper and there were no defects in the paint when we delivered the vehicleWe did this repair in September of 2017. We looked at the bumper and she complained about
chips in the paint on the top of the bumper close to the trunk opening. The paint was not peeling like we would see if it was a paint defect. The paint had been chipped down to the raw plastic. We determined it may have happen when she was loading something into the trunk or pulling something out. We can not warranty paint that was chipped from additional damages. There is also a scuff on the right rear bumper she wanted us to address. This was also likely to have happened by running into something else - it was not a defect in the paint or workmanship. Therefore we told her we could not warranty any of the damages she pointed out because it was not a defect in our workmanship or product

I will send the photos to the manufacture of the bumper and to the paint rep and see if they have ever seen that kind of issue caused by workmanship or paint failure. Normally what we see with paint that is failing due to process or paint failure is a peeling away of the paint the primer will pull away from our paint and you can see the primer. However on this bumper it is chipped down to the raw plastic and there is no peeling at the edges. This tells me that the paint was adhered to the bumper in the correct fashion and only after some other kind of impact did it chip. Normally that only happens with damage from impact. Please see attached photos of paint failure and what that would look like

Hi, The tickets issued in this case are still being litigated on both sidesI have attached the files but the video evidence and police reports are subject to change between now and Oct The report has been amended times in between August 12th and Sept There should be a final report ready October 5th concluding investigations by the city of Loveland... The insurance companies are still litigatingMy policy was for liability, full coverage was not an option with my insurance company because of the short time period upon my return from vacation in Mexico, the make, model and year of the car and perfect storm of eventsThe other driver had full coverage, which is why his insurance company is taking their time determining faultThose are issues for the insurance company and civil courts to address after the traffic citations are issued and final. I would like a receipt detailing why the damage was made to the body of my car and why it was caused in the first placeWithout an invoice, those are assumable damages caused by the negligence or incompetence of your mechanical staff and should be covered under your shops insurance policyWith an invoice, Ozzie's is admitting they damaged my vehicle in the process of trying to make repairs outside the insurance company to avoid a claim on their tow company insurance policy and have an unfinished job on their hands. Mr *** vehicle was towed on January - we were dispatched at 10:pm - we arrived on scene at 11:pm we cleared the scene at 11:pm and were done at the yard at 11:pm according to the police vehicle tow report Mr *** was arrested so I'm not sure how he would know when the
vehicle arrived at our impound lot. PUC allows storage of $per day for any part of the hour day that the vehicle is in the impound lot. We are not open on the weekends. Mr *** was charged days storage for Friday, Saturday, sunday and MondayWe will not be issuing a refund for storage fees

I am rejecting this response because: If you look closely, the original chipping appears to be due the bumper not being properly primed. According to the lifetime warranty policy Ozzie’s holds (per Ozzie’s employees) only an accident would breach the warranty. I don’t understand how a business who guarantees a lifetime warranty can pick and choose when to fix their mistakes that they have garaunteed to fix for life.

Thank you, I appreciate the invoice. I am rejecting this claim because of the fact that my Bondo and paint was chipped off causing more damage. the issue was not resolved. there is not a section on the invoice detailing that damage or the repairs attempted to be made on the rear quarter panel of the car. the cars body was damaged at your shop and the invoice was supposed to detail the work/justification of why you caused more body damage to my vehicle (see attached photos). I either want a invoice that says the damage was from an incomplete body repair, or I would like my vehicle actually repaired. I should not have to pay for an extra 5,000 dollars of damages to my car just because you "worked on the rest of the car for free". I was hit by an Ozzie's driver, now I have to deal with the negligence of the owner who said they would "treat me right". bringing a car to be inspected and having minor repair done for free does not justify more damage done to my vehicle.  ill pay for the work done to my car, I wont pay for the extra damages I incurred having my car serviced at your shop.

In the previous reply you said you wanted an invoice showing work done to your car - we provided that to you.  You wanted the name of the mechanic - we provided that for you - no work was done on the quarter panel of the vehicle - no other work was performed other than what was listed on the invoice already provided. We realize the insurance company is still determining liability but we have no control over that process.  I see no other photos showing damage to the vehicle between the time the accident happened and the time you picked it up at your shop.

Mr [redacted] was involved in an accident involving one of our tow trucks.  It originally "looked" like our driver was at fault.  We offered to look at Mr [redacted]'s vehicle instead of him filing a claim with our insurance.  We towed the vehicle in and he went over the damage with Dennis...

K[redacted], the owner.  We replace the throttle cable, did an alignment and checked the rear suspension to make sure the vehicle was safe to drive.  We did not charge Mr. [redacted] for these repairs.  No other repairs were made and no estimate was written to address the total cost of repairs.  We were notified by the reporting officer at the accident scene that our driver was not at fault and that Mr [redacted] was cited for unsafe lane change .  Because the accident was deemed to be his fault we called Mr [redacted] to come and pick up his vehicle.  He filed a claim with our insurance that was denied because the accident was not the fault of our driver.  His vehicle had been repaired prior to the accident and there was excessive bondo and body filler used to cover up extensive rust in the quarter panel.  When the accident happened it caused that body filler to chip away from the rust because of the thickness of the body filler that was used.  There is very little to no metal support in the quarter due to the extensive rust.  As Mr [redacted] drives the vehicle the body filler will continue to fall off the vehicle as the body flexes.  The damage done to Mr [redacted]'s vehicle is in our opinion his own fault.

Center cap is on order - will be to our shop on Monday 6/29/2015 - we will notify customer as soon as we have it in our shop and will have her stop by so we can put it on for her

The bubbles you see are caused by moisture getting under the paint where it is chipped - We use a waterborne paint so when the clear coat and paint is chipped off the moisture collects under it and causes bubbles - if it was a paint failure you would see bubbles in areas that were not chipped.

I am rejecting this response because: I do not have an invoice detailing the damage he did. Just because he didn’t put it on the invoice doesn't mean that he didn't do any work to that side of the car, it just means he won’t admit it. I have photos of it, I don't know what else I can give you to provide an answer to your questions. You have gotten me everything I have needed so far, the invoice just wasn't complete. Bottom line: the owner of ozzies tried to settle with me outside the insurance company and advised me no to have his insurance claims representative look at my car until he did first. My insurance company has the original pictures sent to them on my claim the day after the accident. I took the car to ozzies body shop to resolve this issue and he damaged my car more and told me to pick it up because he wasn't "liable". I don't care about the other work done to my vehicle because I didn't ask for that! The deal was that he would prep the body for a new quarter panel and give me a new rally wheel. I didn't ask for anything that is listed on that invoice. He just did that, that’s why he didn’t make me pay for the work that he did. Then he told me it was to make my car "safe" to drive so I wouldn't purchase a rental car and report those expenses to his insurance company to justify what he did to my car. I never signed any papers or anything.. That’s why there is no paper trail. Please help me. He damaged the body of my car saying that he would fix it. Then he left me high and dry and told me to pick up my car after he made it look worse. He did the first step in the body work: stripping the car down. Then he just left it that way. He left my car stripped worse than it was from the collision with his driver. Also he advised me not to have his claims representative look at my car until he did because they aren’t ”trained” on estimating damages on classic collector cars. Luckily my insurance company has the original pictures and claims which I provided to you also. He has avoided all contact with me and giving me an invoice for a month. Then I contacted the Revdex.com and he is still playing games. He won’t acknowledge what he did because then he is liable. I just want some kind of retribution for this because it messed up the entire claims process and most of all my grandpas’ car that was a gift to me on my 21st birthday. That is not better business. That’s called manipulation and deceit just to maintain a good image with an endorsement that helps him get more business. He is lying to you about the service he did to my vehicle. This will have no trouble standing up in court, but that’s beside the point. That fact is that other people need to know what this man is capable of. Lying to costumers, not being accountable, and horrible communication is something that others are entitled to know about. I only have photo evidence of what happened because he would never contact me or give me an invoice for the work done. Please, help me. I don't know how I can make this any more understandable. I tried to contact your office and leave a voicemail but I haven't received a call back in 2 days.

Ive attached more photos and video. forgive my language on the [redacted] video, but it the only thing I have to prove the car was damaged and didn't move until it went to his shop. it sat in the same cul de sac. the tow truck driver picked it up at my parents house because the car could not drive safely. the throttle cable came out of the carburetor housing so the car wouldn't move when you hit the gas pedal. the car still idled without the throttle cable and that's how I got the car home. the car was unsafe because it had a max speed of 5 mph that would cause a traffic jam if I tried to get it to his shop a crosstown. I was also laid off my job that Monday so I couldn't afford having my car towed. so ozzies offered to tow my car to the shop that Tuesday (4 days after the accident) so dennis could inspect it before the insurance companies  the reason I didn't take a picture of the opposite side of the car was because I never expected the situation to get this complicated. plus I only had my car for 1 day before it got hit. I didn't take any pictures. I went and showed my lady in person that night and I got hit that same night. so all the picture I took where from the GOOD sides. I avoided that spot of my car because I wanted to have pictures of my car seeming nice without the damage. I didn't get to enjoy my car or take pictures before I was hit so I took them of the good side. I was excited he was going to fix my car so fast. I didn't not take these pictures thinking I needed to document the bad side of my vehicle to prove that he damaged the car more while it was at his shop. in hindsight I probably should have taken pictures of the opposite side too. I also should have put full coverage on my vehicle before I even turned the key. its ok because im learning from my mistakes. please trust me, I can give you witnesses. he just made this situation so hard for me and it seems like he is going to get away with it. its unfortunate I was struck by a tow truck body shop. they know exactly how the process works and how to blur the lines.. Thanks,               [redacted]3 Attachments

Hi, I'm attaching images of my car before I had it painted, after I had the car painted gray, the car when it was painted green, the damaged car before I took it to Ozzie's, the car on the Ozzies' tow truck, and the vehicle damages after I received the car back from Ozzie's ... also I included a proof read and updated response to Ozzie's. if you could replace the old submission with this one it would be greatly appreciated. Thanks,               [redacted]I am rejecting this response because: Ozzie's body shop and the relationship they have with the Loveland police department is undeniable. With a lot of business done for the city picking up the streets and towing wrecked vehicles the city surely has a need for a local 24/7 tow service. I would like to start of first by stating that the (ticketed/at fault driver) is under review along with the police officer by the professional standards/internal affairs unit within the Loveland police department. The driver of the tow truck took away my right away which I have no problem proving with an attorney in a court of law.Officers are there to determine facts of the law, not decisions of who is at fault. There is documented video evidence of the accident and at fault driver proving the facts of the case, which is why the officer who wrote the report is under review. The relationship with the police department can surely influence a lot of key decision makers within the legal system especially when the officers can ticket at their "discretion".  Beside that lovely part of the story, there is a whole second side too which is incorrect. I have documented evidence of the damage before the accident because the car was painted twice with no "rust" issues.  Only after Ozzie’s body shop received my vehicle and promised to make repairs OUTSIDE THE INSURANCE COMPANY was I made aware of the rust with further damage to my vehicle.The gross negligence of the shop and its owner are admirable. Documenting every step of this process for fear of being manipulated, it was also made aware that the at fault driver has "disappeared" no statement, no records or anything. Not to mention that there was an amended police report 2 times without insurance information of the at fault driver of Ozzie body shop. His insurance info was finally supplemented into the report Sept 2 at the beginning of the month.  Dennis told me that a claim would drive up his policy by at least 4,000 dollars a month with 10 tow trucks and those tow truck being high liability (while I had the insurance info of Ozzie’s  from the beginning and my information was submitted to the DMV all three times)Not only has the relationship with Ozzie’s and the city of Loveland influenced those two situations there is a third part of the story that is also incorrect involving the insurance companies. I was issued my ticket for an illegal lane change on highway 34 headed westbound on the 18th with no traffic coming or accident resulting. The citation I received is irrelevant and that’s why the insurance companies are deliberating (the accident happened 243 feet down N. Taft heading southbound when my RIGHT AWAY was taken away by a driver that tried to turn into a parking lot through an oncoming lane of traffic). The re-issued ticket also caused a delay in the liability decision with the insurance companies. Andrew Schmaltz delayed the process 3 weeks stating that he requested the supplemental which he did not. I called the Loveland courts record's office and contacted [redacted] which is [redacted] insurance’s third party document obtaining service. I stated to Andrew I was aware of what he was doing and the DORA Colorado insurance section was notified to SPEED along the process of determining liability which has not been determined yet officially (1 month).The structural integrity of the car was damaged from the collision and so were the cosmetics, not the bondo. Don’t let this man manipulate the situation any more than he is. The Bondo being on the car is irrelevant because the car’s body isn’t supposed to flex as you drive that is what suspension is made to do… the bondo broke because of the collision, the rust was inhibited prior to the application of bondo(standard procedure and you can tell by magnet test to the metal). Otherwise the car wouldn’t have been painted twice because of the obvious warranty issues of the PAINT FLEXING AND CRACKING. The car is a [redacted] with heavy [redacted] options. The car is extremely rare and worth 40,000 high end retail. I was only made aware of the after obtaining a rental car and having my vehicle towed to a CREDIBLE AND RELIABLE service center that measured the frame and made other measurements, ran the vin number on the body and the engine  and assessed damage opinions. (No such thing as aligning the rear of a car when the axle is in a fixed position....)The manipulation of the incident by Dennis is incredible and led me to seek legal advice. Once a liability decision is made with the insurance companies I will further contact Ozzie’s body shop to seek repairs if my car is not repaired. I would like paperwork for the service done to my vehicle for "free" and time spent. I want the mechanics name who worked on my vehicle and I want the invoice as detailed as possible since all of those services that were done between the 4 HOURS of 8-12.I don’t know of many Revdex.com accredited business that do work for free and don’t give receipts. That’s a violation in itself. Reputation is everything and Ozzie’s reputation will surely be damaged if this issue is not resolved.. Regards,6 Attachments
