Sold vehicle to me with encumbrances (no clear title) in violation of Bill of Sale purchase agreement. Will on refund money nor state taxes. Colom Construction aka(Colom [redacted] Auto)sold a vehicle to me on April 10th, 2014. According to purchase agreement /bill of sale the vehicle was supposed to be clear of liens or other encumbrances. I was told by seller that I could return in 1 week to get paper to register vehicle to me. Each week when I returned, I was provided another Bill of Sale which last for 7 days. This continued until July 2014. I was provided many excuses as to why I could not get the proper registration information. In July I was told by owner that I could return the vehicle or get a different one. I chose to return the vehicle, however, the owner/operator stated that he does not give state tax refunds and that I would only be entitled to $750 of the $3,000 which I was allotted for the trade-in of my personal vehicle during original transaction.I have attempted to resolve this matter without litigation--to no avail. I'm a disabled Navy Veteran and full time college student (criminal justice). Please Help.Desired SettlementI am seeking financial settlement in the amount of $2,375.00 which is the remaining balance after deducting the $750.00 cash which he returned to me. I was allotted $3,000 on my personal vehicle trade-in. $750. was returned to me. I did not make a payment during the month of July because we made arrangements for me to return the vehicle at the end of the month, so I subtracted July's payment in the amount of $259.99.The total outstanding balance owed to me is $2,375.Business Response September 18, 2014To whom it may concern:RE: Case #: XXXXXXXX There was absolutely nothing wrong with the auto that the customer purchased from [redacted] Brothers Used Cars. It is to my belief that the customer just used our auto for his personal purposes. He was moving into a new home and needed a way to move his personal belongings to his new location. He called us several times asking to borrow a truck. We would not let him so he traded in his and purchased a truck from us. He called us every week, several times a week stating that the vehicle was not drivable and he needed paperwork to get his tag. Yet he drove the auto daily to move. He called and we gave him appointment after appointment to come in to get the paperwork and to get the auto checked out but he would never show. Week after week he kept stating that he was moving and needed the truck. After he had finished moving he then returned our auto. We had this vehicle inspected and found no mechanical problems.However, it had physical body damage that we had to have repaired from him hauling a trailer. We have receipts available if needed. He signed agreement stating NO refunds, but the day he returned the auto I still gave him a partial refund because I am a business man. He made it known that he was a college student and I try to do the right thing. He signed an agreement stating that we owed him nothing and he owed us nothing. Now he is trying to obtain a financial gain for personal matters. Their was nothing nor is their anything wrong with the auto he purchased and returned. Mr. [redacted]Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Because it is not the truth.Final Business Response As we stated previously, their was nothing wrong with the auto. The customer signed a purchase agreement stating that we do not issue refunds and a copy of this agreement can be provided if needed. But being an understanding and trustworthy business owner, I gave the customer a refund in the amount of $750.00 in which he signed and agreed that neither he nor I would any longer be indebted to each other. A copy of this can be provided if needed also. All accusations are false and their was nothing wrong with this vehicle. Again I felt my kindness as a business was taken for granted. After I agreed to let the customer return the vehicle, I was under the impression that all business was settled and handled. The customer agreed to this amount and all was satisfactory.
