-----Original Message-----From: [redacted] [mailto:[redacted]]Sent: Friday, January 26, 2018 4:26 PMTo: '[redacted]' <[redacted]>Cc: '[redacted]' <[redacted]>; '[redacted]' <[redacted]>Subject: [redacted]I received a copy of your complaint with the Revdex.com today.  I'm sorry that you decided to go this route without contacting me, as it just creates an adversarial atmosphere, at which time I usually go to the specific terms and conditions of the contract.  Please know that if you have claims for warranty work that are valid, I'm happy to get the work done for you.   [redacted] no longer works for me so please direct all email to me.  I'm sorry if he has not been responsive to your requests.Terms and conditions of the contract are as follows:Contract Paragraph 29(h) requires that you notify me in writing of requests for warranty work.  (I received an email from you 1/18/17) Paragraph 8(c) requires a written punch list prior to closing.  (I've looked through my email for your job and closing paperwork from the attorney and can't find your punch list, however I was under the impression from conversations with Mitch that all your requests have been completed.)  Please send me a copy of your punch list from closing, noting which items need attention.Paragraph 14(h) covers seeding.Paragraph 14(i) addresses shrubs.Paragraph 14(q) addresses leftover material.Specifically addressing each item in your complaint:1) repairs to be completed after closing (through contract)        Please send me a copy of your punch list as soon as possible.2) basement framing        Completed yesterday?  Please advise.  I know there was some confusion about basement framing changes with my framer.3) drain for washer pan        Please elaborate on what needs to be done.  If there is no drain pipe attached to the pan, I'll have the plumber take care of.4) Touch up paint not done.  This is not warranty work, however as a courtesy, we will touch up once.  I'll see if we have any leftover paint we can give you.  Let me know if you need the paint colors for the future.5)  Countertop caulking and trim caulking.        This is a result of humidity changes in wood.  Especially noticeable the first winter of a summer built house.  I'll have the painter to re-caulk the trim and the counter.6)  Front door seal.        I'll have the front door lock adjusted and check the seals for damage as well.7) Master bath tub caulk.        We will re-caulk the tub.8) Shrubs        Send me a copy of the punch list.  If the bushes were dead right away, they probably dried out last Summer.  August is not the best time of the year to be landscaping as the plants need water daily.  It's been a tough Winter on shrubs as well.  I noticed frost damage on several bushes in my own yard.9) Seed and straw.        This is not covered by warranty.  Soil in Hancock Farms needs several applications of lime or Sol-u-cal (I use Sol-u-cal) to get the Ph under control.  The grass will not mature, looking yellow and not really gain any growing height.  I've moved my model home several times in that subdivision and each time we've applied sol-u-cal 4 times, approx. 30 days apart to get the soil Ph under control. I then have the soil tested at Southern States or Virginia Tech to see where it is.  Please note that it can take up to a year to get the soil right for growing a nice yard.  I recommend that you work on the soil chemistry, and apply a pre-emergent herbicide ( I use barricade from Landscape Supply.) this Spring and Summer for the lime. Then plan to reseed around September 15th.10) Electric Bill -  We've had extremely cold weather this Winter which forces the heat pump to turn emergency back-up heat.  Typically a heat pump will activate backup heat when the outdoor temperature is less than 35 degrees.  This is a 10,000 watt strip heating unit that consumes a lot of energy.  Also note that the thermostat can be manually set to emergency heat.  When the unit is set to heat, the word "emergency" should NOT be illuminated, if it is then the thermostat is calling for emergency heat every time it calls for heat, regardless of the outdoor temp.11) Your house is built to a high energy efficiency standard.         An unusually cold winter has caused backup heat to run and raised your electric bill.  Also keep in mind that you are heating over 4,000 square feet when you include the conditioned basement.  If    you have a window or door with a defective seal that is leaking air let me know.  I can get the window rep out and we can order new seals.Please send me daytime phone numbers.  I'll pass your information on to my subs, so you can coordinate letting them in.  Please let me know a few dates that you can be at the house and I'll get the guys scheduled to come over.Finally, I want you to know that I've made arrangements with a contractor friend to take care of any warranty work that needs to be done after I'm gone.  My wife will continue to check my email and coordinate with my subs or [redacted] of Stables Construction as needed to address any future concerns you may have.Jeffrey G[redacted]
