I am responding to the above complaint that was filed against myself and my companyI do think it is fair to let concerned parties, the Revdex.com as well as any future customers know that this particular situation is under review by not only my attorney but *** *** as wellThe homeowner is correct
about thing and that is she did pay me a 25% deposit on or around July 19th which according to her is unreasonable, however at the time she signed the contract she had other proposals that she showed me and they also asked for a depositI require a total down payment of 50%, 25% at the time of signing the contract to bind it and to secure a place on my schedule with the remaining 25% due upon start of prep work which includes power washingAs a matter of fact something she obviously is not aware of that most painting companies have the same deposits as this including the largest painting company in Northern ColoradoPerhaps she should do her home work before she makes this type of accusationsProbably the most important thing that she has conveniently left out was the fact that we did discuss a number of times (And yes I have witnesses to this to be exact) was the start of her painting would be based upon the removal of her old gutters and downspouts.because she was replacing them with newI met a gutter and roofing company at her house to go over the details, someone that I have done a ton of work for over the last yearsThis individual knows that before I paint I want the old gutters to be removed so the fascia can be inspected for damage as well as prepped and paintedAgain this information was relayed to this home ownerThe first time this was discussed was when I did her initial walk through with my lead painterThe August start date was only if I had the qualified painters available because I was really busy and was at least a month and a half outThe first gutter company could not get her scheduled and she had another company call me and we agreed to meet at her house on September 10thI did not here from this gutter company so I called her on September 10th and was told she had fired him as well so I told her that I need to go ahead and get this started and was there on September 12th to power wash at which time she paid me the other 25% of my deposit( she had the check made out and gave it to me with out me asking for it)I told her in the contract that I let my houses dry for a week after the power washingOne week to the day I hauled my equipment to her house which would have been the th of September and on the 21st while I was on her way to her house to begin the work she called and said that she was going to find someone else to do the painting and wanted a refundShe knows full well that everything was held up because she took her sweet time in finding a gutter companyHer gutters were finally removed on September 16thIf she was to actually admit this she would shoot holes in her argument that I was the reason her house wasn't painted in a timely mannerIf I would have painted her house prior to gutter removal I would have had to haul equipment back over to her house and it would have ended up costing her additional moneyThis particular homeowner obviously thinks that contracts do not mean any thing, however my attorney feels differently about thisHe is also reviewing a libel law suit against her as wellThere is nothing wrong leaving a review about poor service, but when a homeowner fabricates the facts to justify her own shortcomings and continues to spin these lies that is when I will fight back and explore all legal options available to meShe is guilty by omission and she knows full well that she is because when we first met she was concerned about not having her new gutters installed before she had her house paintedShe has obviousl forgotten that I have witnesses that have agreed to furnish a deposition to attorney if need beSincerely
